HomeMy WebLinkAboutResolution 2025-34052RESOLUTION NO. 2025-34052 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, PURSUANT TO SECTION 106-118 OF THE CITY CODE, THE PRIVATE PARKING LOT SIGNAGE AND STICKERS, ATTACHED AND INCORPORATED HEREIN AS EXHIBITS "A," "B," AND "C," RESPECTIVELY, TO BE PRODUCED BY THE CITY AND PROVIDED TO OWNERS AND OPERATORS OF PRIVATE PROPERTIES OPEN TO THE PUBLIC FOR PAID MOTOR VEHICLE PARKING, UPON PAYMENT OF THE CITY'S ADMINISTRATIVE COST OF PRODUCTION AS SET FORTH IN APPENDIX "A" OF THE CITY CODE, SO THAT THE OWNERS AND OPERATORS OF SUCH PRIVATE PROPERTIES MAY POST THE REQUIRED SIGNAGE AND STICKERS, IN A MANNER CONSISTENT WITH SECTION 106.118, IN ORDER TO ENSURE THAT MOTOR VEHICLE DRIVERS ARE AWARE THAT THE PROPERTY IS PRIVATE PROPERTY AND IS NOT A PUBLIC PARKING LOT OR FACILITY OPERATED BY A GOVERNMENTAL ENTITY. WHEREAS, Section 106-118 of the City Code provides for the regulation and approval of signage for private parking lots open to the public for paid motor vehicle parking, to ensure clarity and prevent public confusion regarding the nature and ownership of such parking facilities; and WHEREAS, private properties open to the public for paid parking have, on many occasions, continued to be mistakenly perceived by motor vehicle drivers as public parking facilities operated by the City of Miami Beach ("City'); and WHEREAS, in order to further address this issue, the City seeks to provide, at a minimal cost to private parking lot owners and operators, standardized private parking lot signage and slickers to the owners and operators of such properties, in order to clearly indicate that these properties are private and not public parking lots or facilities; and WHEREAS, the signage and stickers to be provided to private property owners and operators upon payment of the City's administrative cost of production, have been designed, pursuant to Section 106-118 of the City Code, in a uniform and readily identifiable manner with a distinct color scheme, to aid in ensuring that motor vehicle drivers are conspicuously and unequivocally informed about the nature of the parking facility; and WHEREAS, pursuant to Resolution No. 2024-33449, the Mayor and City Commission previously approved the 18" x 24" sign depicted in Exhibit "A," which remains unaltered; and WHEREAS, the 3" x 3" stickers required by subsection (a)(2) of Section 106-118 to be affixed to the front of every sign displaying any payment information and to the front of every pay -on -foot meter located within the private property, are depicted in Exhibit "B" attached and incorporated herein; and WHEREAS, the 12" x 18" sign required by subsecton (c) of Section 106-118 to be installed at the head of every parking space designated for use by a disabled person is depicted in Exhibit "C" attached and incorporated herein; and WHEREAS, the Mayor and City Commission find that the approval of such signage and stickers, as attached and incorporated herein as Exhibits "A," `B," and "C," serves the public interest by promoting greater transparency, reducing confusion, and fostering compliance with the City Code. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby approve, pursuant to Section 106-118 of the City Code, the private parking lot signage and stickers, attached and incorporated herein as Exhibits "A," "B; and "C; respectively, to be produced by the City and provided to owners and operators of private properties open to the public for paid motor vehicle packing, upon payment of the City's administrative cost of production as set forth in Appendix "A" of the City Code, so that the owners and operators of such private properties may post the required signage and stickers, in a manner consistent with Section 106-118, in order to ensure that motor vehicle drivers are aware that the property is private property and is not a public parking lot or facility operated by a governmental entity.
