HomeMy WebLinkAboutResolution 2025-33975RESOLUTION NO. 2025-33975 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE 2025 MIAMI-DADE COUNTY LOCAL MITIGATION STRATEGY (LMS). WHEREAS, the Disaster Mitigation Act of 2000 (44 CFR 201.6 — Local Mitigation Plans) mandates that local governments maintain and update hazard mitigation strategies, which serve as the basis for the State to provide technical assistance and prioritize funding; and WHEREAS, Chapter 163 of the Florida Statues requires Florida counties to plan for hazards and emergencies and to adopt a local mitigation strategy and have programs to improve disaster preparedness and the ability to protect lives and property, especially in coastal high -hazard areas; and WHEREAS, Miami -Dade County is the designated local coordinator of the Local Mitigation Strategy (LMS) for Miami -Dade County, its local jurisdictions and institutions in Miami -Dade County; and WHEREAS, the primary purpose of the LMS is to establish a continuing process whereby entities within the County identify risks and assess vulnerabilities to all types of hazards, and maintains a comprehensive list of goals, objectives, plans and programs to decrease or eliminate the effects of the vulnerabilities, and prioritize implementation of these plans and programs; and WHEREAS, the LMS must be updated every five (5) years to remain compliant with the above -mentioned legislation; and WHEREAS, the City of Miami Beach has participated in the Miami -Dade County LMS since 2000, and last adopted the Miami -Dade County LMS on September8,2020, via Resolution No. 2020-31378; and WHEREAS, the City's participation in and adoption of the Miami -Dade County LMS will enable eligibility for federal mitigation grant programs; and WHEREAS, adoption of the LMS is encouraged by the State of Florida for the Florida Recovery Obligation Calculator (F-ROC) Program, enabling accelerated reimbursements after disasters; and WHEREAS, an additional benefit of participation in the LMS is an improvement in standing and classification in the Community Rating System (CRS), a voluntary program that recognizes and encourages community floodplain management activities that exceed the minimum National Flood Insurance Program (NFIP) requirements, resulting in more affordable flood insurance rates; and WHEREAS, Miami Beach continues to exceed minimum NFIP requirements, and maintains a CRS score of 5, resulting in premium savings 20%- 25%for property owners; and WHEREAS, City staff from Emergency Management, Grants and Floodplain Management participates in LMS activities throughout the year, including workshops to update the current plan, and provided input on development and maintenance of the LMS. Adopt the 2025 Miami -Dade County Local Mitigation Strategy. Every five years, Miami -Dade County is required to submit an update of the Local Mitigation Strategy (LMS) to the Stale of Florida Division of Emergency Management (FDEM) and the Federal Emergency Management Agency (FEMA) for review. You may view the 2025 Miami - Dade County LMS at this link: hftos://www.miamidade.gov/global/emergency/local-mitigation- strateov.oaoe. The LMS includes a list of proposed, active and completed projects that address risks and vulnerabilities and that track mitigation measures that were/are identified to lessen the impacts of and to reduce long-term risks to communities from the effects of natural disasters. The LMS complies with the Disaster Mitigation Act of 2000 (44 CFR 201.6) which mandates that local governments maintain and update hazard mitigation strategies and FI. Stat. Chapter 163, §3246, directing counties to plan for hazards and emergencies and to adopt an LMS. The primary purpose of the LMS is to maintain a process whereby the County and jurisdictions within the County assess hazards and vulnerabilities and identifies a strategy to address them, creating an ongoing list of goals, plans, objectives and projects that decrease or eliminate the effects of the hazards and, importantly, prioritizes implementation of the initiatives. The City of Miami Beach has participated in the LMS since 2000 and has been in compliance since. City staff from Emergency Management, Grants, Environment 8 Sustainability and the Building Department Floodplain Manager attend quarterly meetings and workshops, share information and were part of the planning process for the 2025 updates. Projects listed in the County LMS include G.O. Bond and Capital Improvement Projects. The current plan expired September 15, 2025, but there is a grace period in which participating agencies and jurisdictions will remain eligible to participate in FEMA HMA programs. The State has asked that Florida counties collect the municipal adoption resolutions by December 31, 2025. The packet of municipal adoptions will then be sent to the State by Miami -Dade County. ANALYSIS Participation in the LMS maintains the City's eligibility for state and federal mitigation grant programs. Additionally, LMS adoption increases the City's percentage points under the Florida Recovery Obligation Calculator (F-ROC) Program, resulting in a streamlined reimbursement process following a storm or other natural or human -caused disaster. 995 of 3458 LMS participation also contributes to the Community Rating System (CRS) score, which results in a reduction in Flood insurance premiums for Miami Beach property owners. By continuing to adopt the LMS updates every five years, the City and our residents enjoy the benefits of additional financial security and a more resilient community. While there is no direct fiscal impact to the City budget, the current CRS rating for the City of Miami Beach is a 5, which results in 20% — 25% savings in National Flood Insurance Program (NFIP) premiums for property owners. Points are given for LMS adoption in the Florida Recovery Obligation Calculator (F-ROC) program, and the City currently has a guarantee of expedited reimbursement of nearly 56% of eligible expenses after a hurricane or other natural disaster. Staff from several departments provide input and ensure that the County includes and prioritizes City mitigation projects in the LMS. Continued adoption of the LMS helps ensure that the City's approach to mitigation complies with County, State and Federal guidance and requirements, enabling access to all grants and other available funding for mitigation projects and support.
