A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF T14E CITY OF MIAMI BEACH, FLORIDA, ACCEPTING A DONATION FROM MALIBU SUMMER 2020 LLC, THE OWNER OF THE PROPERTY LOCATED AT 2318 NORTH BAY ROAD, CONSISTING OF LANDSCAPE IMPROVEMENTS AND ONGOING MAINTENANCE SERVICES FOR THE CITY -OWNED GREENSPACE LOCATED AT 2318 NORTH BAY ROAD AND 23RD STREET; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DONATION AGREEMENT TO MEMORIALIZE THE TERMS OF THE DONATION, INCLUDING THE INSTALLATION OF LANDSCAPING AND A FENCE, AND THE COMMITMENT TO PROVIDE MONTHLY MAINTENANCE AND FERTILIZATION SERVICES, WHILE MAINTAINING PUBLIC ACCESS TO THE GREENSPACE. WHEREAS, the City of Miami Beach owns a greenspace located at the corner of 2318 North Bay Road and 23rd Street (the "Greenspace"); and WHEREAS, Malibu Summer 2020 LLC, whose members and residents are Josh Kushner and Karlie Kloss, owns the adjacent property located at 2318 North Bay Road; and WHEREAS, the owners have voluntarily offered to take on landscape improvements and ongoing maintenance services for the Greenspace, at no cost to the City; and WHEREAS, the proposed donation includes the installation of new landscaping and a fence, as well as a commitment to fund and coordinate monthly deep cleaning, pruning, fertilization, and pest control services, as outlined in the attached proposals; and WHEREAS, the City will continue to provide bi-weekly mowing and general maintenance services, and the Greenspace will remain open and accessible to the public at all times; and WHEREAS, the City Commission wishes to accept this generous donation and authorize the City Manager to execute a donation agreement to memorialize the terms of the donation and ensure the continued public benefit of the Greenspace. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept a donation from Malibu Summer 2020 LLC, the owner of the property located at 2318 North Bay Road, consisting of landscape improvements and ongoing maintenance services for the City -owned Greenspace located at 2318 North Bay Road and 23rd Street; and authorize the City Manager to execute a donation agreement to memorialize the terms of the donation, including the installation of landscaping and a fence, and the commitment to provide monthly maintenance and fertilization services, while maintaining public access to the Greenspace. The administration recommends the Mayor and City Commission formally accept the donation from Malibu Summer 2020 LLC for landscape improvements and ongoing maintenance services at the City -owned greenspace located at 2318 North Bay Road and 23rd Street; and authorize the City Manager to execute the associated donation agreement, ensuring the terms are clearly memorialized and that public benefit from the greenspace is continued. The greenspace at the corner of 2318 North Bay Road and 23rd Street is owned by the City of Miami Beach. Malibu Summer 2020 LLC owns the adjacent private property. The owners have voluntarily offered to enhance and maintain the greenspace at no cost to the City, as outlined in the proposed resolution and supporting vendor agreements. ANALYSIS The donation includes: • Installation of new landscaping and fencing. • Monthly deep cleaning, pruning, fertilization, and pest control services. • Continued public access to the greenspace. • Ongoing bi-weekly mowing and general maintenance by the City Two professional service proposals support the donation: 1. Pest Control and Fertilization Services by Nice & Green Pest Control (Exhibit A): -Covers lawn, shrubs, plants, palms, and trees. 1438 of 3458 -Includes targeted applications of fertilizers, fungicides, insecticides, and micronutrients. -Monthly cost: $300 2. Bi-Weekly Landscaping Services by the same vendor (Exhibit B) : -Includes mowing, edging, trimming, irrigation monitoring, debris removal, and mulching. -Monthly cost: $600 These services will be fully funded by Malibu Summer 2020 LLC, relieving the City of additional financial responsibility while enhancing the aesthetic and ecological value of the greenspace. The proposed improvements and maintenance plan will elevate the quality of the greenspace while preserving public access. Proposal The purpose of this agreement is to set forth the terms and conditions under which Nice & Green will provide landscape maintenance for 2318 N Bay Rd 1. Under this agreement, Contractor agrees to perform the Bi-Weekly services outlined above to include the following: 1443 of 3458 2. The contractor will furnish the labor, materials, and equipment necessary to perform the above services. 3. The client agrees to promptly notify the contractor of any dissatisfaction with the maintenance as performed as per agreement. 4. Client shall pay to Contractor the rate of $600.00 Per month, for 81-Weekly maintenance for the services herein agreed to be performed. 5. The terms of the agreement shall commence in July, 2025, and shall continue in full force and effect thereafter until it is terminated by thirty days written notice by either parry to the other. 6. Contractor guarantees to perform services in a workmanlike manner. Should Clienfs plantings be damaged by any failure of Contractor to fulfill its obligation under this agreement, Contractor shall repair or replace such damaged plantings. The contractor shall not be liable for any damage due to the Acts of Nature. 7. Contractors personnel to be uniformed and trucks kept clean and prominently showing and/or displaying logo and signage identification.
