HomeMy WebLinkAboutResolution 2026-34082RESOLUTION NO. 2026-34082 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO MONITOR THE FUNCTIONALITY OF ELEVATOR SERVICE AT THE FIFTH AND ALTON SHOPPING CENTER, LOCATED AT 1100 5T" STREET, AND TO COORDINATE WITH EDENS, AS THE OWNER, AND WITH SCHINDLER ELEVATOR CORPORATION, AS THE ELEVATOR REPAIR COMPANY, IN ORDER TO PROMPTLY IDENTIFY, ADDRESS, AND PERMANENTLY RESOLVE ANY PRESENT OR FUTURE ELEVATOR SERVICE ISSUES OCCURRING AT THE SHOPPING CENTER, IN A MANNER CONSISTENT WITH EXISTING AGREEMENTS AND APPLICABLE LAW; AND FURTHER, DIRECTING THE CITY ADMINISTRATION TO INFORM THE MAYOR AND CITY COMMISSION, VIA LETTER TO COMMISSION ("LTC"), WITHIN 30 DAYS, OF ITS RECOMMENDED PERMANENT SOLUTION. WHEREAS, the Fifth and Alton Shopping Center, located at 1100 5th Street, serves a dense residential neighborhood and includes essential retail uses, including a heavily utilized Publix grocery store; and WHEREAS, a senior center is located adjacent to the shopping center, and reliable elevator access is critical for residents, seniors, and individuals with mobility limitations; and WHEREAS, Edens is the owner of the Fifth and Alton Shopping Center and is responsible for the ownership, operation, maintenance, repair, and revenue associated with all retail components of the property, exclusive of the parking garage; and WHEREAS, the parking garage serving the shopping center is a shared facility operated by the City of Miami Beach ("City") as a City garage, with revenues and expenses allocated fifty- four percent (54%) to Edens and forty-six percent (46%) to the City, pursuant to existing agreements; and WHEREAS, the property contains seven (7) Schindler brand elevators located within the shared garage facility, six (6) of which are exterior elevators partially exposed to weather and environmental conditions, including rain and flooding; and WHEREAS, at present, one (1) of the seven (7) elevators is out of service, and the anticipated cost to repair the elevator is estimated to range between approximately two hundred thousand dollars ($200,000) and four hundred thousand dollars ($400,000), and the condition of the elevator and associated repair cost may necessitate full replacement rather than repair; and WHEREAS, recurring elevator outages adversely affect access to essential services and impose significant hardship on residents and patrons who rely on elevators to conduct their daily activities; and WHEREAS, Schindler Elevator Corporation ("Schindler") is the elevator service provider for the elevators at the property; and WHEREAS, the Mayor and City Commission desire to promote improved coordination, monitoring, and communication among the City, Edens, and Schindler in order to better identify, understand, and address the causes of elevator outages and encourage improved reliability, without altering existing contractual responsibilities or creating new financial or legal obligations. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, hereby direct the City Administration to monitor the functionality of elevator service at the Fifth and Alton shopping center, located at 1100 5th Street, and to coordinate with Edens, as the owner, and with Schindler Elevator Corporation, as the elevator repair company, in order to promptly identify, address, and permanently resolve any present or future elevator service issues occurring at the shopping center, in a manner consistent with existing agreements and applicable law; and further, directing the City Administration to inform the Mayor and City Commission, via Letter to Commission ("LTC'), within 30 days, of its recommended permanent solution.
