HomeMy WebLinkAboutResolution 2026-34102RESOLUTION NO. 2026-34102 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO IDENTIFY, IN AN LTC TRANSMITTED WITHIN SIXTY (60) DAYS, ONE OR MORE PROFESSIONAL CONSULTANTS TO SET FORTH THE SCOPE AND COST TO CONDUCT A LEGALLY SUFFICIENT SAFETY STUDY TO IDENTIFY WHICH SIDEWALKS IN THE CITY MAY SAFELY ACCOMMODATE THE OPERATION OF ONE OR MORE "PERSONAL DELIVERY DEVICE[S]" AND "MOBILE CARRIERS]", IN COMPLIANCE WITH SECTION 316.2071, FLORIDA STATUTES, WHICH AUTHORIZES THE OPERATION OF PERSONAL DELIVERY DEVICES AND MOBILE CARRIERS ON SIDEWALKS AND CROSSWALKS, BUT EXPRESSLY PERMITS LOCAL GOVERNMENTS TO IMPOSE ADDITIONAL REGULATIONS RELATED TO THEIR SAFE OPERATION. WHEREAS, Section 316.2071, Florida Statutes, authorizes the operation of "personal delivery devices" (PDDs) and "mobile carriers" on sidewalks and crosswalks throughout the State of Florida; and WHEREAS, the statute expressly permits local governments to impose additional regulations related to the safe operation of these devices, recognizing the importance of ensuring pedestrian safety and maintaining the integrity of public rights -of -way; and WHEREAS, the City of Miami Beach seeks to evaluate which sidewalks within the City may safely accommodate the operation of one or more PDDs and mobile carriers, consistent with applicable law and best practices for pedestrian safety; and WHEREAS, to accomplish this, the City Administration should identify one or more professional consultants qualified to set forth the scope and cost to conduct a legally sufficient safety study addressing these issues. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Administration to identify, in an LTC transmitted within sixty (60) days, one or more professional consultants to set forth the scope and cost to conduct a legally sufficient safety study to determine which sidewalks in the City may safely accommodate the operation of one or more "personal delivery device[s]" and "mobile carrier[s", in compliance with Section 316.2071, Florida Statutes, which authorizes the operation of personal delivery devices and mobile carriers on sidewalks and crosswalks, but expressly permits local governments to impose additional regulations related to their safe operation.
