A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING, IN SUBSTANTIAL FORM, AN
EASEMENT AGREEMENT IN FAVOR OF FLORIDA POWER & LIGHT
COMPANY (FPL), FOR THE PERPETUAL, NON-EXCLUSIVE USE OF A TEN
(10)-FOOT-WIDE EASEMENT AREA, LYING IN A PORTION OF LOTS 16, 17,
AND 18, BLOCK 40, OF THE ALTON BEACH REALTY COMPANY'S PLAT OF
SUBDIVISION OF WEST HALF OF BLOCKS 17, 40, AND 45 IN SECTION 33,
TOWNSHIP 53, RANGE 42 EAST, ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 6, PAGE 165, OF THE PUBLIC RECORDS OF
MIAMI-DADE COUNTY, LOCATED AT THE CITY -OWNED PARKING LOT
LOCATED AT 1671 WEST AVENUE ("PROPERTY"); SAID EASEMENT
HAVING APPROXIMATELY 3,511.6 SQUARE FEET, FOR USE BY FPL TO
ACCESS, OPERATE, AND MAINTAIN AN ABOVE -GROUND TRANSFORMER,
TOGETHER WITH THE RELATED BELOW -GROUND FACILITIES, TO
PROVIDE ELECTRICITY FOR THE STORMWATER PUMP STATION
LOCATED AT THE PROPERTY; AND FURTHER, AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE THE FINAL EASEMENT
AGREEMENT.
WHEREAS, on November 8th, 2023, the City issued a partial Notice to Proceed (NTP) for
the construction of a stormwater pump station, at the City -owned Parking Lot P24, located at 1671
West Avenue (the "Property"), as part of the West Avenue Phase II North project, including
installation of underground structures housing the pumps, the water quality structures, and the
large pipes collecting and conveying the stormwater; and
WHEREAS, in addition, the Property will house the above -ground electrical components
and controls for the pump station, a Florida Power & Light Company ("FPL") transformer vault,
and the above -ground bi-fuel auxiliary generator, a new drainage system, decorative lighting
system, decorative screening for the generator and above -ground electrical components,
landscaping, irrigation, and new parking spaces; and
WHEREAS, the construction of the stormwater pump station is currently ongoing, is
approximately 90% complete, and is anticipated to be substantially complete in early 2026; and
WHEREAS, the connection to the pump station system will provide electricity for the pump
station and will require the installation of a transformer on the Property; and
WHEREAS, FPL has requested a 3,511.6-square-foot, perpetual, non-exclusive
easement on, over, under, and through the easement area lying in a portion of Lots 16, 17, and
18, Block 40, of the Alton Beach Realty Company's Plat of Subdivision of West Half of Blocks 17,
40, and 45 in Section 33, Township 53, Range 42 East, according to the Plat thereof, as recorded
in the Public Records of Miami -Dade County, and said easement area being more particularly
described in Exhibit A hereto, to accommodate the transformer and electrical service to the pump
station; and
WHEREAS, the easement is required for the access, construction, operation, and
maintenance of overhead and underground electric utility facilities in order to provide electricity
for the stormwater pump station; and
WHEREAS, the Administration recommends that the Mayor and City Commission
approve, in substantial form, the Easement Agreement, a draft copy of which is attached hereto
as Exhibit "A"; and further, authorize the City Manager and City Clerk to execute the final
Easement Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approves, in substantial form, an Easement Agreement in favor of Florida
Power & Light Company (FPL), for the perpetual, non-exclusive use of a ten (10)-foot-wide,
easement area, lying in a portion of Lots 16, 17, and 18, Block 40, of the Alton Beach Realty
Company's Plat of Subdivision of West Half of Blocks 17, 40, and 45 in Section 33, Township 53,
Range 42 East, according to the Plat thereof, as recorded in the Public Records of Miami -Dade
County, located at the City -owned parking lot located at 1671 West Avenue ("Property"); said
easement having approximately 3,511.6 square feet, for use by FPL to access, construct, operate
and maintain an above -ground transformer, together with the related below -ground facilities, in
order to provide electricity for the stormwater pump station located at the Property; and further,
authorize the City Manager and City Clerk to execute the final Easement Agreement.

The Administration recommends that the Mayor and City Commission adopt the Resolution.
BACKGROUND/HISTORY
The West Avenue Improvements Project, represents a comprehensively defined neighborhood
improvement program, focused on resolving challenges associated with climate impacts and aged
infrastructure. The proposed improvements within the West Avenue neighborhood includes the
replacement of the existing water distribution/transmission systems and gravity sanitary sewers,
installation of a new robust storm water drainage collection and pumping system including the
raising of the paved roadway and harmonization to the adjacent properties, installation of
new street lighting, pedestrian lighting, replacement of existing and installation of new
signalized intersections with mast arms, new landscaping, and irrigation.
On November 8th, 2023, the City issued a partial Notice to Proceed (NTP) for the construction of
a storm water pump station, at the city owned parking lot site (P24), located at 1671 West Avenue
as a part of the West Avenue Phase II North project. Construction activities included underground
structures housing the pumps, the water quality structures and the large pipes collecting and
conveying the stormwater. In addition, the parking lot site will house the above ground electrical
components and controls for the pump station, a Florida Power & Light (FPL) transformer vault
and the above ground bi-fuel auxiliary generator. The parking lot will be fully reconstructed with a
new drainage system, decorative lighting system, decorative screening for the generator and
above ground electrical components, landscaping, irrigation, and new parking spaces.

The construction of the storm water pump station is currently ongoing, is approximately 90%
complete and is anticipated to be substantially complete in early 2026.
ANALYSIS
The connection to the pump station system by FPL will provide electricity for the pump station
and will require the installation of a transformer vault on the City owned parking lot. FPL has
requested a 3,511.E sq ft, perpetual non-exclusive easement within the parking lot legally
described as Portions of Lots 16, 17, and 18 inclusive of Block 40 of "The Alton Beach Realty
Company's Plat of Subdivision of West Half of Blocks 17, 40, and 45", according to the Plat
thereof, as recorded in Plat Book 6, at Page 165, of the Public Records of Miami -Dade County,
Florida, to accommodate the transformer vault and electrical service to the pump station. The
City shall execute the proposed Easement Agreement (Exhibit A) in favor of FPL, as more
particularly described in the Sketch to Accompany Legal Description, permitting FPL to access,
construct, operate and maintain the transformer vault, together with the related below ground
facilities, in order to provide electricity for the stormwater pump station. The easement is required
for unlimited access for the installation of the requested transformer vault, and future operation
and maintenance of the FPL facility.
