A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA
DEPARTMENT OF EDUCATION TO ACCEPT AND
INCORPORATE, DURING THE RULEMAKING PROCESS FOR
FLORIDA DEPARTMENT OF EDUCATION RULE 6A-1.0998271:
SCHOOLS OF HOPE, THE SUGGESTIONS AND
RECOMMENDATIONS SUBMITTED BY MIAMI-DADE COUNTY
PUBLIC SCHOOLS, AS OUTLINED HEREIN, TO SAFEGUARD
PUBLIC EDUCATION AND ENSURE THE RULE ACHIEVES ITS
INTENDED PURPOSE WITHOUT UNINTENDED HARM TO
STUDENTS, FAMILIES, AND COMMUNITIES.
WHEREAS, the Florida Department of Education is engaged in rulemaking for
Rule 6A-1.0998271: Schools of Hope, which governs the implementation of Schools of
Hope charter programs intended to provide students with alternatives to persistently low -
performing schools; and
WHEREAS, Miami -Dade County Public Schools (MDCPS) has expressed
significant concerns regarding the proposed rule and transmitted recommendations to the
Florida Department of Education during the September 2025 rulemaking process; and
WHEREAS, MDCPS's concerns and proposed solutions include:
1) Other Uses of Space: Protect programs such as VPK, Pre-K, Adult Education,
Workforce Training, and community services, and allow districts to reclaim or
repurpose facilities when needed.
2) Title I Schools and Specialized Centers: Ensure dedicated areas for Title I and
specialized centers (e.g., ESE cluster sites) are recognized and not
misrepresented as excess capacity.
3) Unfunded Mandates: Avoid imposing custodial, maintenance, food service, and
nursing obligations without additional funding.
WHEREAS, on November 18, 2025, the City of Miami Beach Quality Education
Committee (QEC) unanimously passed a motion (11-0) urging the Mayor and City
Commission to support MDCPS's concerns and recommendations regarding Rule 6A-
1.0998271; and
WHEREAS, the Mayor and City Commission recognize the importance of
protecting public education, ensuring equitable access to resources, and maintaining
safe, effective learning environments for all students.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Department of Education to accept and incorporate,
during the rulemaking process for Rule 6A-1.0998271: Schools of Hope, the suggestions
and recommendations submitted by Miami -Dade County Public Schools, as outlined
herein, to safeguard public education and ensure the rule achieves its intended purpose
without unintended harm to students, families, and communities.
