A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF BAY HARBOR ISLANDS,FLORIDA,AFFIRMING SUPPORT FOR THE PRESERVATION OF THE MIAMI-DADE URBAN DEVELOPMENT BOUNDARY (:"UDB")AS IT CURRENTLY EXISTS TO PRQTECT DOWNSTREAM WATER RESOURCES,INCLUDING THE BISCAYNE AQUIFER,REGIONAL GROUNDWATER SUPPLIES,AND CONNECTED COASTAL WATERS,AS WELL AS THE EVERGLADES,WETLANDS,AND AGRICULTURAL LANDS;URGING THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS TO UPHOLD COUNTY MAYOR DANIELA LEVINE CAVA'S VETO OF THE PROPOSED DEVELOPMENT OUTSIDE THE UDB;URGING THE FLORIDA STATE LEGISLATURE TO OPPOSE ANY LEGISLATION THAT WOULD WEAKEN THE UDB IN THE MIAMI- DADE COUNTY CHARTER;ENCOURAGING ADVANCEMENT OF ATTAINABLE AND WORKFORCE HOUSING WITHIN THE UDB TO ADDRESS HOUSING AFFORDABILITY WITHOUT EXPANDING DEVELOPMENT INTO ENVIRONMENTALLY SENSITIVE LANDS; DESIGNATING THE PRESERVATION OF THE UDB AS A STATE LEGISLATIVE PRIORITY FOR THE TOWN OF BAY HARBOR ISLANDS; AND FURTHER,DIRECTING THE TOWN CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE MIAMI-DADE COUNTY MAYOR,EACH MEMBER OF THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS,THE SPEAKER OF THE FLORIDA HOUSE OF REPRESENTATIVES,THE PRESIDENT OF THE FLORIDA SENATE,THE MIAMI-DADE STATE LEGISLATIVE DELEGATION,ALL OTHER MUNICIPALITIES WITHIN MIAMI-DADE COUNTY,AND THE TOWN OF BAY HARBOR ISLANDS'STATE LEGISLATIVE LOBBYISTS. 19 DESIGNATING THE PRESERVATION OF THE UDB AS A STATE 20 LEGISLATIVE PRIORITY FOR THE TOWN OF BAY HARBOR ISLANDS; 21 AND FURTHER,DIRECTING THE TOWN CLERK TO TRANSMIT A 22 COPY OF THIS RESOLUTION TO THE MIAMI-DADE COUNTY MAYOR, 23 EACH MEMBER OF THE MIAMI-DADE COUNTY BOARD OF COUNTY 24 COMMISSIONERS,THE SPEAKER OF THE FLORIDA HOUSE OF 25 REPRESENTATIVES,THE PRESIDENT OF THE FLORIDA SENATE, 26 THE MIAMI-DADE STATE LEGISLATIVE DELEGATION,ALL OTHER 27 MUNICIPALITIES WITHIN MIAMI-DADE COUNTY,AND THE TOWN OF 28 BAY HARBOR ISLANDS'STATE LEGISLATIVE LOBBYISTS. 29 30 WHEREAS,the Urban Development Boundary ("UDB")in Miami-Dade County 31 was established as a core growth-management tool to limit urban sprawl,protect 32 environmentally sensitive lands,preserve agricultural areas,and safeguard natural 33 systems critical to regional water supply and flood resilience;and 34 35 WHEREAS,lands located outside the current UDB include wetlands,agricultural 36 soils,and open spaces that play a vital role in protecting downstream water resources, 37 including the Biscayne Aquifer,regional groundwater supplies,and connected coastal 38 waters,upon which Bay Harbor Islands and other coastal communities depend for 39 drinking water,environmental health,and resilience to flooding and sea level rise;and 40 41 WHEREAS,wetlands and prairies west of the UDB function as natural filtration 42 and storage systems that support groundwater recharge,reduce pollutant loads,and 43 maintain hydrologic connections between inland ecosystems,the Everglades,and 44 downstream coastal waters;and 45 46 WHEREAS,the UDB also serves to protect South Dade agricultural lands by 47 maintaining contiguous farming areas,preserving permeable soils,supporting food 48 production,and preventing land-speculation pressures that arise when urban 49 development expands into rural areas;and 50 51 WHEREAS,in January 2026,the Miami-Dade County Commission approved 52 amendments to the County's Comprehensive Development Master Plan to allow 53 development of a large heavy-equipment facility on hundreds of acres of predominantly 54 protected wetlands outside the existing UDB,raising significant concerns regarding 55 impacts to wetlands,water resources,flood control,and long-standing growth- 56 management policies;and 57 58 WHEREAS,on February 2,2026,Miami-Dade County Mayor Daniella Levine 59 Cava vetoed the proposed development,citing the County's obligation to protect 60 environmentally sensitive lands,uphold the integrity of the UDB,and ensure that 61 development outside the boundary occurs only when there is a demonstrated and 62 compelling public need consistent with long-range planning principles;and 63 64 WHEREAS,weakening or bypassing the UDB through legislative or administrative 65 action risks accelerating sprawl into wetlands and agricultural lands,undermining 66 Everglades restoration efforts,and increasing long-term public costs associated with 67 infrastructure expansion,flood mitigation,and environmental degradation;and 68 69 WHEREAS,the Town Council of the Town of Bay Harbor Islands recognizes that 70 addressing housing affordability is a critical public-policy goal,and acknowledges that 71 developers have argued for expanding the UDB westward to accommodate industrial and 2 72 commercial projects as a means to preserve sufficient land within the UDB for affordable 73 and workforce housing;however,the Town Council firmly believes that such housing 74 objectives are best achieved through strategies within the existing UDB,including infill 75 development,redevelopment,zoning reforms,and infrastructure-efficient growth,rather 76 than by encroaching upon environmentally sensitive lands;and 77 78 WHEREAS,protecting upstream lands and water systems is directly tied to the 79 long-term environmental,economic,and public-health interests of the Town of Bay 80 Harbor Islands as a downstream coastal city. 81 82 NOW,THEREFORE,BE IT RESOLVED BY THE TOWN COUNCIL OF THE 83 TOWN OF BAY HARBOR ISLANDS: 84 85 Section1.The foregoing recitals are adopted and hereby incorporated as if fully 86 set forth herein. 87 Section 2.The Mayor and Town Council hereby affirms its support for the 88 preservation of the Miami-Dade Urban Development Boundary ("UDB")as it currently 89 exists to protect downstream water resources,including the Biscayne Aquifer,regional 90 groundwater supplies,and connected coastal waters,as well as the Everglades, 91 wetlands,and agricultural lands;urges the Miami-Dade County Board of County 92 Commissioners to uphold County Mayor Daniella Levine Cava's veto of the proposed 93 development outside the UDB;urges the Florida State Legislature to oppose any 94 legislation that would weaken the UDB in the Miami-Dade County Charter;encourages 95 the advancement of attainable and workforce housing within the UDB to address housing 96 affordability without expanding development into environmentally sensitive lands;
