HomeMy WebLinkAboutResolution 2026-34157RESOLUTION NO. 2026-34157 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO STATION NOT LESS THAN ONE (1) POLICE VEHICLE AT SPECIFIED LOCATIONS ON 5TH STREET, 41ST STREET, AND 71ST STREET, BETWEEN THE HOURS OF 10:00 P.M. AND 5:00 A.M. DAILY, TO PROACTIVELY ISSUE CITATIONS FOR ILLEGAL AND EXCESSIVE VEHICULAR MUFFLER, EXHAUST, AND OTHER NOISE; AND FURTHER, DIRECTING THE ADMINISTRATION TO PROVIDE MONTHLY REPORTS ON THE RESULTS OF THESE EFFORTS BY LETTER TO COMMISSION (LTC), COMMENCING APRIL 1, 2026. WHEREAS, unreasonable and excessive vehicular muffler and exhaust noise emanating from vehicles and motorcycles continue to plague the City of Miami Beach, creating a nuisance and adversely affecting the quality of life for residents, as evidenced by the number of complaints we continue to receive regarding this issue; and WHEREAS, such noise disturbances, particularly during overnight hours, deprive residents of the peaceful enjoyment of their homes, disrupt their ability to rest, and negatively impact the tranquility of the City; and WHEREAS, on May 21, 2025, the City Commission adopted Resolution No. 2025- 33669, which directed enhanced enforcement of illegal and excessive vehicular muffler/exhaust noise citywide, with a focus on 5th Street, 41 st Street, 71 st Street, and Collins Avenue, and recognized that without effective remedial action, ongoing noise disturbances would erode public trust and create dangerous conditions; and WHEREAS, despite prior efforts, vehicular noise disturbances persist nearly unabated, particularly in heavily traveled corridors during late -night hours when traffic subsides, allowing for speeding, racing, and other activities that exacerbate illegal and excessive exhaust noise; and WHEREAS, the Mayor and City Commission find it necessary to implement additional targeted enforcement measures to address this continuing problem and protect the health, safety, and welfare of residents and visitors; and WHEREAS, the Mayor and City Commission desire to direct the Administration to station not less than one (1) police vehicle at each of the following locations between the hours of 10:00 p.m. and 5:00 a.m. daily, for the purpose of proactively issuing citations for illegal and excessive vehicular muffler, exhaust, and other noise: 5th Street at the MacArthur Causeway; 41st Street at Indian Creek Drive; and 71 st Street at Collins Avenue. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Administration to station not less than one (1) police vehicle at specified locations on 5th street, 41 st street, and 71 st street, between the hours of 10-00 p.m. and 5.00 a.m. daily, to proactively issue citations for illegal and excessive vehicular muffler, exhaust, and other noise; and further, direct the Administration to provide monthly reports on the results of these efforts by Letter to Commission (LTC), commencing April 1, 2026. RECOMMENDATION BACKGROUND/HISTORY Vehicular noise disturbances, particularly from muffler and exhaust systems and engine revving, continue nearly unabated in heavily traveled corridors, negatively impacting residents' quality of life, tranquility, and health. These disturbances deprive residents of peaceful enjoyment of their homes, disrupt sleep, and erode public trust in the City's ability to manage its roadways effectively. Previously, Commissioner Laura Dominguez and I jointly sponsored Resolution No. 2025-33669 (with Commissioner Joseph Magazine as a co-sponsor), adopted on May 21, 2025, which directed enhanced enforcement of illegal and excessive vehicular muffler and exhaust noise citywide, with a focus on 5th Street, 41 st Street, 71 st Street, and Collins Avenue, and required the Administration to develop targeted plans and provide monthly updates. Attached for consideration is a proposed resolution that builds upon these efforts by directing the City Administration to station not less than one (1) police vehicle at specified locations on 5th Street, 41st Street, and 71st Street, between the hours of 10:00 p.m. and 5:00 a.m. daily, to proactively issue citations for illegal and excessive vehicular muffler, exhaust, and other noise. The resolution further requires the Administration to provide monthly reports on the results of these enforcement efforts via Letter to Commission (LTC), commencing April 1, 2026. I would like to discuss with my colleagues the adoption of the attached resolution to strengthen enforcement and address ongoing noise issues that continue to generate complaints and plague the City.
