HomeMy WebLinkAboutResolution 2026-34203RESOLUTION NO. 2026-34203 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO COLLABORATE WITH THE OFFICE OF THE CITY ATTORNEY, THE OFFICE OF THE INSPECTOR GENERAL, AND THE SPONSOR OF THIS RESOLUTION TO PREPARE AND MAIL A LETTER TO EVERY CONDOMINIUM UNIT OWNER IN THE CITY OF MIAMI BEACH TO RAISE AWARENESS REGARDING THE CITY'S BULK BUYOUT ORDINANCE (SECTION 58-600 ET SEQ. OF THE MIAMI BEACH CODE OF ORDINANCES) AND THE GOOD STANDING ORDINANCE (SECTION 2.4.1 OF THE MIAMI BEACH RESILIENCY CODE); AND FURTHER, DIRECTING THE CITY ADMINISTRATION TO PROVIDE A REPORT ON IMPLEMENTATION BY LETTER TO COMMISSION WITHIN 60 DAYS. WHEREAS, the City of Miami Beach has adopted a "bulk buyout' ordinance codified in Section 58-600 et seq. of the Miami Beach Code of Ordinances, which is intended to protect residential condominium unit owners from certain predatory solicitation practices often associated with bulk acquisitions; and WHEREAS, the bulk buyout ordinance generally prohibits specified predatory or misleading solicitations to condominium unit owners, and requires any prospective bulk purchaser acquiring a significant ownership interest to provide written notice of their acquisition to the affected condominium association, the property manager, and each individual unit owner; and WHEREAS, the City has also adopted a "good standing" ordinance, codified at Section 2.4.1 of the Miami Beach Resiliency Code, which requires that any property owner seeking an amendment to the City's Comprehensive Plan or Land Development Regulations first certify that the property has no open zoning or life -safety violations, and that there are no outstanding fines, fees, liens, or other unpaid obligations owed to the City; and WHEREAS, both ordinances serve important public -interest purposes by promoting transparency, protecting homeowners, and ensuring that applicants for land -use changes remain in compliance with City code requirements; and WHEREAS, the Mayor and City Commission find that it is in the best interest of the City and its residents to proactively inform all condominium unit owners of the rights, protections, and obligations established by these ordinances; and WHEREAS, the dissemination of this information will assist in enhancing public awareness, reducing consumer vulnerability, and promoting compliance with the City's regulatory framework. NOW, THEREFORE, BE IT DULY RESOLBED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Administration to collaborate with the Office of the City Attorney, the Office of the Inspector General, and the sponsor of this Resolution to prepare and mail a letter to every condominium unit owner in the City of Miami Beach to raise awareness regarding the city's bulk buyout ordinance (Section 58-600 at seq. of the Miami Beach Code of Ordinances) and the good standing ordinance (Section 2.4.1 of the Miami Beach Resiliency Code); and further, directing the City Administration to provide a report on implementation by Letter to Commission within 60 days.
