AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING SUBPART A OF THE CITY CODE,
ENTITLED "CHARTER," BY AMENDING CHAPTER 2, ENTITLED
"ADMINISTRATION," BY AMENDING ARTICLE III, ENTITLED "AGENCIES,
BOARDS, AND COMMITTEES," BY AMENDING DIVISION 4, ENTITLED
"BUDGET ADVISORY COMMITTEE," BY AMENDING SECTION 2-41 THEREOF,
ENTITLED "ESTABLISHED; PURPOSE; POWERS AND DUTIES;
COMPOSITION," BY AMENDING THE NAME, PURPOSE, AND POWERS AND
DUTIES OF THE COMMITTEE; AND PROVIDING FOR REPEALER,
SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE.
WHEREAS, the City of Miami Beach ("City') has established a Budget Advisory Committee
("Committee") to assist the Mayor and City Commission in reviewing and evaluating the City's fiscal
policies, procedures, and annual budget; and
WHEREAS, the Mayor and City Commission recognize the importance of continuously
improving the efficiency and effectiveness of City governmental operations to ensure that taxpayer
resources are managed prudently and responsibly; and
WHEREAS, the Mayor and City Commission desire to expand the purpose of the
Committee to include the review of government spending for efficiency throughout all departments,
divisions, and programs within the City; and
WHEREAS, the Mayor and City Commission further find it in the public interest to broaden
the Committee's powers and duties so that, in addition to examining, studying, reviewing,
considering, and advising the City Commission as to the City's proposed annual budgets, the
Committee shall also do likewise for all City programs, grants, and initiatives forfiscal responsibility
and operational efficiency; and
WHEREAS, the Mayor and City Commission also wish to require the Committee to prepare
and submit an annual report to the City Commission summarizing its findings and
recommendations, including any proposals for right -sizing operations and increasing the efficiency
of government spending; and
WHEREAS, the Mayor and City Commission further find it necessary and appropriate to
amend the name of the Budget Advisory Committee to the Budget Advisory and Government
Spending Efficiency Committee ("BAGSEC") in order to better reflect its expanded role in promoting
transparency, accountability, and fiscal efficiency in City government; and
WHEREAS, the Mayor and City Commission determine that these amendments will
enhance the City's long-term financial health and ensure that public funds are used in the most
effective manner to serve the residents of the City of Miami Beach.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That Section 2-41 of Division 4 of Article III of Chapter 2 of Subpart A of the Miami
Beach City Code is hereby amended as follows:

ARTICLE III. AGENCIES, BOARDS, AND COMMITTEES
DIVISION 4. BUDGET ADVISORY AND GOVERNMENT
SPENDING EFFICIENCY COMMITTEE ("BAGSEC")
Sec. 2-41. - Established; purpose; powers and duties; composition.
(a) Established. There is hereby established the budget advisory committee, whose
purposes, power and duties, composition, membership qualification and general
governing regulations are as set forth in this section.
(b) Purpose. The purpose of the committee is to consider and make recommendations on all
issues affecting the fiscal policies, aad procedures, and efficient government spending
throughout all of the units and departments within the city.
(c) Powers and duties. It shall be the duty of the budget advisory committee to advise the city
commission and to examine, study, review and consider proposed budgets, programs.
grants or initiatives and any amendments thereto. For that purpose, the budget advisory
committee shall examine any and all proposed expenditures therein; the amounts
appropriated therefor; the probable amount of estimated revenue and receipts; and all
other facts necessary or convenient to enable the committee to make recommendations
to the city commission. Additionally, the BAGSEC will provide the city commission with an
annual report recommending any right -sizing to increase government spending efficiency.
(d) Composition. The committee shall be composed of nine members:
(1) Seven direct appointments, with mayor and each commissioner making one
appointment.
(2) Two at -large appointments, one for a certified public accountant and one for a financial
advisor.
(a) Knowledge and experience. See subsection (d) of this section.
(f) Supporting department. The supporting office of the committee is the office of
management and budget.

SECTION 2. REPEALER
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the Code
of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or re -
lettered to accomplish such intention, and the word "ordinance" may be changed to "section,'
"article," or other appropriate word.
SECTION S. EFFECTIVE DATE
This Ordinance shall take effect the Ip day of M N 202(o.

BACKGROUND/HISTORY
ANALYSIS
The proposed Ordinance, sponsored by Vice -Mayor Joseph Magazine, has been submitted for
consideration by the Mayor and City Commission.
The City of Miami Beach ("City") has established a Budget Advisory Committee ("Committee") to
assist the Mayor and City Commission in reviewing and evaluating the City's fiscal policies,
procedures, and annual budget. The Committee is an important component in continuously
improving the efficiency and effectiveness of City governmental operations to ensure that
taxpayer resources are managed prudently and responsibly.
The proposed Ordinance would expand the purpose of the Committee to include the review of
government spending for efficiency throughout all departments, divisions, and programs within
the City. Additionally, the proposed Ordinance would enhance the Committee's powers and
duties so that, in addition to examining, studying, reviewing, considering, and advising the City
Commission as to the City's proposed annual budgets, the Committee will also do likewise for all

Lastly, the proposed Ordinance will amend the name of the Budget Advisory Committee to the

reflect its expanded role in promoting transparency, accountability, and fiscal efficiency in City
government.
