AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER
2 OF THE CODE OF THE CITY OF MIAMI BEACH, ENTITLED
"ADMINISTRATION," ARTICLE III, ENTITLED "AGENCIES,
BOARDS, AND COMMITTEES," DIVISION 22, ENTITLED
"MIAMI BEACH ANIMAL WELFARE COMMITTEE," SECTION 2-
190.59 THEREOF, ENTITLED "COMPOSITION," TO MODIFY
THE COMPOSITION OF THE VOTING MEMBERS OF THE MIAMI
BEACH ANIMAL WELFARE COMMITTEE; AND PROVIDING
FOR REPEALER, CODIFICATION, SEVERABILITY, AND AN
EFFECTIVE DATE.
WHEREAS, protecting the welfare of stray and abandoned animals in the City of Miami
Beach promotes the public health, safety, and welfare; and
WHEREAS, the Mayor and City Commission established the Miami Beach Animal Welfare
Committee (the "Committee") pursuant to Ordinance No. 2018-4212 to study and make
recommendations to the City Commission regarding animal welfare programs and community
solutions to issues affecting the well-being of such animals; and
WHEREAS, the Committee is comprised of nine voting members, two of whom are
recommended by specifically identified animal welfare groups located in the City and ratified by
the City Commission; and
WHEREAS, the City Commission desires additional flexibility to appoint a voting
representative from among a broader range of animal welfare groups.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That Section 2-190.59 of Chapter 2 of the Miami Beach City Code is hereby
amended as follows:
CHAPTER
ADMINISTRATION
Article III. Agencies, Boards, and Committees
Division 22. Miami Beach Animal Welfare Committee
Sec. 2-190.59. Composition.
The Miami Beach Animal Welfare Committee shall be composed of nine voting members as
follows:
(a) Seven direct appointments with the mayor and city commissioners each making one
appointment.
(b) Two members shall be appointed as follows:
(1) An individual who shall be recommended by the Miam Beach Anknal Advaeates, IPG. a
and ratified confirmed by the city commission.
(2) An individual who shall be recommended by Sobe Cats Spay & Neuter, Inca or a
qualified non-profit organization promoting the welfare of stray or abandoned cats in
Miami -Dade County, and ratified confirmed by the city commission.
(3) For the avoidance of doubt both members appointed pursuant to subsection (b) maybe
recommended for appointment by the same qualified non-profit organization.
SECTION 2, REPEALER.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the
Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or
re -lettered to accomplish such intention, and the word "ordinance" may be changed to "section,"
"article," or other appropriate word.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect the Z8 day of rnardl 2026.

BACKGROUNDIHISTORY
The attached Ordinance was prepared at the request of Commissioner Laura Dominguez.
The Miami Beach Animal Welfare Committee (the "Committee") was established by the Mayor
and City Commission pursuant to Ordinance No. 2018.4212 to study and make recommendations
to the City Commission regarding animal welfare programs and policy.
Presently, the Committee is comprised of nine voting members, two of whom are recommended
by specifically identified animal welfare groups located in the City and appointed by the City
Commission (the "Non -Profit Representatives"). One Non -Profit Representative shall be
recommended by the Miami Beach Animal Advocates, Inc., and the other shall be recommended
by Sobe Cats Spay & Neuter, Inc.
ANALYSIS
The attached Ordinance is presented for First Reading by the sponsor, Commissioner Laura
Dominguez, for the consideration of the Mayor and City Commission.
The Ordinance amends Section 2-190.59 of the City Code to allow one of the two Non -Profit
Representatives to be recommended for appointment by a qualified non-profit organization
promoting the welfare of stray or abandoned animals in Miami -Dade County; and the other Non -
Profit Representative to be recommended for appointment by Sobs Cats Spay & Neuter, Inc., or
a qualified non-profit organization promoting the welfare of stray or abandoned cats in Miami -
Dade County.
