98-22636 RESO RESOLUTION NO. 98-22636 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE OF AN EMERGENCY AND ALLOWING THE MIAMI DESIGN PRESERVATION LEAGUE, INC., (MDPL) A NOT -FOR-PROFIT CORPORATION, TO UTILIZE THE PRIVATE VACANT LOTS GENERALLY LOCATED AT 230 BISCAYNE STREET, 35 COLLINS A VENUE, 6 OCEAN DRIVE, 64 OCEAN DRIVE, AND 67 COLLINS AVENUE, RESPECTIVELY, AS WELL AS THE OCEAN PARCEL, ALL LOCATED WITHIN THE SOUTH POINTE REDEVELOPMENT AREA, TO PROVIDE ADDITIONAL PARKING THROUGHOUT THE DURATION OF THE ART DECO WEEKEND FESTIVAL, CURRENTLY SCHEDULED FROM JANUARY 16 - 19, 1998; PROVIDING THAT THE SUBJECT PERMISSION IS GRANTED ON A ONE-TIME ONLY EMERGENCY BASIS, IN LIEU OF THE CURRENT PARKING CRISIS IN THE CITY OF MIAMI BEACH, P ARTICULARL Y DURING ART DECO WEEKEND, AND IN ORDER TO ACCOMMODATE THE UNIQUE EMERGENCY CREATED BY THE INCREASED PARKING DEMANDS OF PATRONS ATTENDING ART DECO WEEKEND; FURTHER PROVIDED THAT THE SUBJECT PERMISSION IS GRANTED WITHOUT ESTABLISHING PRECEDENT SO AS TO SATISFY THIS UNIQUE EMERGENCY SITUATION. WHEREAS, at its regular meeting on January 12, 1998, the Mayor and City Commission received an emergency request from the Miami Design Preservation League, Inc. (MDPL), a not-for- profit corporation, for permission to utilize the private vacant lots located at 230 Biscayne Street, 35 Collins Avenue, 6 Ocean Drive, 64 Ocean Drive, and 67 Collins Avenue, as well as the Ocean Parcel (collectively, the Lots), to provide critically needed additional parking for the Art Deco Weekend Festival, scheduled in the City of Miami Beach from January 16 - 19, 1998; and WHEREAS, the Mayor and City Commission herein find and declare that the influx of increased visitors and tourists to the City specifically for the Art Deco Weekend Festival creates a unique emergency situation, due to the already increasing parking crisis within the City of Miami Beach, and the aggravation of this situation, particularly during such special events as the Art Deco Weekend Festival; and WHEREAS, the Mayor and City Commission herein grant MDPL's request for use of the aforestated Lots for supplemental parking during the duration of the Art Deco Weekend Festival, said request granted on a one-time only basis in order to accommodate the unique emergency created by the increased demand of patrons attending the Art Deco Weekend Festival; and WHEREAS, the subject permission is further granted without establishing precedent, so as to satisfy this unique emergency situation. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein finds and declares the existence of an emergency and grants permission for the Miami Design Preservation League, Inc., a not-for-profit corporation, to utilize the private vacant lots generally located at 230 Biscayne Street, 35 Collins Avenue, 6 Ocean Drive, 64 Ocean Drive, and 67 Collins Avenue, respectively, as well as the Ocean Parcel, all located within the South Pointe Redevelopment Area, to provide additional parking throughout the duration of the Art Deco Weekend Festival, currently scheduled from January 16 - 19, 1998; provided that the subject permission is granted on a one-time only emergency basis, in lieu of the current parking crisis in the City of Miami Beach, particularly during Art Deco Weekend, and in order to accommodate the unique emergency created by the increased parking demands of patrons attending Art Deco Weekend; further provided that the subject permission is granted without establishing precedent, so as to satisfy this unique emergency situation.
