A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SWEETWATER URGING THE STATE OF FLORIDA TO TAKE SUCH ACTIONS AND PASS SUCH LEGISLATION AS MAY BE NECESSARY TO AUTHORIZE COUNTY AND LOCAL GOVERNMENTS TO USE BUILDING FEES TO OFFSET GENERAL OPERA TING EXPENSES;URGING COUNTIES AND OTHER MUNICIPALITIES TO PASS SIMILAR RESOLUTIONS;DIRECTING THE CITY CLERK TO DISSEMINATE THIS RESOLUTION TO CERTAIN PERSONS AND ENTITIES;AND PROVIDING FOR EFFECTIVE DATE. WHEREAS,Florida local governm ents,including counties and municipalities rely on annual levies of ad va!orem taxes on the value of real property ("Property Taxes"); WHEREAS,the Florida House of Representatives has passed HJR 203,which would amend Art .VIII,§7 of the Florida Constitution to phase out all non-school property taxes on homesteaded properties over ten (I 0)years,effective January I,2027; WHEREAS,HJR 203 would also establish a floor on law enforcement and first responder spending below which funding would not be perm itted to fall; WHEREAS,the Fl orida House of Representatives has also considered other proposals, including the complete elimination of Property Taxes,the effect of which would be to eliminate the main source of funding for county and local governm ents; WHEREAS,the effect on county and local govern m ents w ould be detrim ental; WHEREAS,county and local govern m ents also charge and collect building and zoning fees ("B uilding Fees"),w hich fe es are intended to offset actu al costs of pro viding building and zoning serv ices to the public; WHEREAS,county and local govern m ents are pro hibited fr om using B uilding Fees to offset genera l opera ting expenses; WHEREAS,authori zing the use of B uilding Fees m ight,fo r som e counties and m unicipali ties,offer a m ethod by w hich they could offset the reduction in ad valorem revenue occasioned by the restru ctu ri ng or elim ination of som e or all Pro perty T axes; NOW THEREFORE,be it resolved by the C ity C omm ission of the C ity of Sw eetw ater: Resolution Urging the State of Florida to Penn it Use of Building Fees to Offset Local Government Operating Costs Page I of3 drafted by city attorney Resolution Urging the State of Florida to Permit Use of Building Fees to Offset Local Government Operating Costs Page 2 of3 drafted by city attorney 1.The foregoing preamble is incorporated herein by reference as if set forth in full. 2.The City of Sweetwater hereby formally requests and urges the Governor and the Legislature to take such actions and pass such legislation as may be necessary to authorize county and municipal governments to use Building Fees to supplement general revenues and to offset general operating expenses. 3.The City of Sweetwater hereby formally requests and urges all other counties and municipalities to pass their own resolutions urging the Governor and the Legislature to take such actions and pass such legislation as may be necessary to authorize county and municipal governments to use Building Fees to supplement general revenues and to offset general operating expenses and to ensure such resolutions are distributed to the persons and entities listed below. 4.The City Clerk is hereby authorized and directed to disseminate copies of this resolution to: •The Honorable Ron DeSantis,Governor of the State of Florida; •The Honorable Ben Albritton,President of the Florida Senate; •The Honorable Daniel Perez,Speaker of the Florida House of Representatives; •The Honorable Daniela Levine-Cava,Mayor of Miami-Dade County; •Mayors of all municipalities located in Miami-Dade County; •All state senators and representatives from districts located in Miami-Dade County; •Clerk of the Florida Senate; •Clerk of the Florida House of Representatives; •Clerk of Courts of Miami-Dade County; •Clerks of all municipalities located in Miami-Dade County; •All city clerks in the State of Florida with request that they notify their elected officials; •The Florida League of Cities; •The Miami-Dade Leagues of Cities; •All such other persons or entities as deemed proper by the Mayor. 5.This resolution shall become effective upon its adoption by the City Commission [CONTINUED ON NEXT PAGE] Resolution Urging the State ofFlorida to Permit Use of Building Fees to Offset Local Government Operating Costs Page 3 of 3 drafted by city attorney and approval by the Mayor or if vetoed,upon its reenactment by the City Commission as provided by the Charter of the City of Sweetwater.
