Attached for your information is Resolution No.2026-R-18,adopted by the Mayor and City Council
of City of North Miami on February 24,2026.
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
NORTH MIAMI,FLORIDA,EXPRESSING STRONG OPPOSITION TO
SENATE BILL 1134 AND HOUSE BILL 1001 WHICH SEEK TO ELIMINATE
THE ABILITY OF CITIES AND COUNTIES TO FUND OR TAKE ANY
OFFICIAL ACTION AS IT RELATES TO "DIVERSITY,EQUITY,AND
INCLUSION";DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED
COPY OF THIS RESOLUTION TO THE FLORIDA LEAGUE OF CITIES
AND ANY OTHER INTERESTED PARTIES;PROVIDING FOR
TRANSMITTAL AND AN EFFECTIVE DATE.
The City of North Miami Clerk has requested that a copy of this Resolution be provided to the
Miami Beach Mayor and Commissioners.

W H E RE A S ,the Mayor and City Council oppose the Florida Legislature's adoption of
Senate Bill 1134 and House Bill 1001 as these bills would severely restrict the City's ability to
respond to constituent needs,fun d community programming,and to buy goods and services from
the lowest and best bidders,thereby undermining the public procurement process;and
W H E RE A S ,the Mayor and City Council find that the bill is overly broad and ill-defined
stating that a city or county "may not fund or promote,directly or indirectly,or take any official
action"as it relates to "diversity,equity,and inclusion.";and
W HE RE A S ,the phrase "diversity,equity,and inclusion"is defined to include "any effort
to ...[p ]romote or adopt training,programming,or activities designed or implemented with
reference to race,color,sex,ethnicity,gender identity,or sexual orientation.";and
W H E RE A S,the overbreadth of the language in the proposed legislation leaves more
questions than provides equitable solutions for Floridians;and
W H E RE A S ,as currently drafted,it is questionable as to a city's ability to participate in
routine celebrations and observances of National recogn ized holidays such as Black History Month
and Women's History Month;and
W HE RE A S ,Senate Bill 1134 and House Bill 100l create a private cause of action that
will expose cities and counties to frivolous and costly litigation;and

WHERE AS,section 3 of the bill would require a municipality to reject the lowest and best
bid for a city contract if the bidder refuses to certify that it will not use municipal funds for DEl
instruction to its employees,contractors,volunteers,vendors,or agents,potentially resulting in
higher expenditures by the municipality and its taxpayers;and
WHERE AS,the Mayor and City Council of the City of North Miami believes that it is in
the best interest of the City to express its strong opposition to Senate Bill 1134 and Hose Bill I 00 I.
NOW,THERE FORE,BE IT DULY RE SOLVE D BY THE MAYOR AND CIT Y
COUNCIL OF THE CIT Y OF NORTH MIAMI,FLORID A:
Section 1.Recitals.The above recitals are confirmed,adopted,and incorporated
herein and made a part hereof by reference.
Section 2.Urging State Legislature.That the Mayor and City Council of the City of
North Miami,Miami-Dade County,Florida,urge all members of the Florida Legislature to oppose
Senate Bill l 134 and House Bill 1001 which seek to eliminate the ability of Cities and Counties to
fund or take any official action as it relates to "diversity,equity,and inclusion."
Section 3.Transmittal.The City Clerk is hereby directed to transmit a certified copy
of this Resolution to the Florida League Cities and any other interested parties.
Section 4.Effective Date.This Resolution shall become effective immediately
upon adoption.
