HomeMy WebLinkAboutResolution 2026-34172RESOLUTION NO. 2026-34172 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, IN SUBSTANTIAL FORM, AN INTERGOVERNMENTAL AGENCY AGREEMENT ("IAA") BETWEEN THE CITY OF MIAMI BEACH AND MIAMI-DADE COUNTY, PURSUANT TO SECTIONS 2-95 AND 2-96.1 OF THE MIAMI-DADE COUNTY CODE, TO REDUCE POSTED SPEED LIMITS FROM 30 MILES PER HOUR ("MPH") TO 25 MPH ON LOCAL RESIDENTIAL STREETS IN THE CITY; AND TO PERFORM THE INSTALLATION AND MAINTENANCE OF THE 25 MPH SPEED LIMIT SIGNS ON LOCAL RESIDENTIAL STREETS OPERATED, MAINTAINED AND OWNED BY THE CITY; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND FINALIZE THE IAA CONSISTENT WITH THE TERMS SET FORTH HEREIN, AND SUBJECT TO FORM APPROVAL BY THE CITY ATTORNEY; AND FURTHER, AUTHORIZING THE CITY CLERK AND CITY MANAGER TO EXECUTE THE FINAL NEGOTIATED IAA WITH MIAMI-DADE COUNTY. WHEREAS, the City of Miami Beach ("City") has long experienced traffic congestion along its arterials and collector roadways, which has resulted in vehicular speeding and cut -through traffic in the abutting low -density residential neighborhoods; and WHEREAS, this traffic diversion has created safety concerns and negatively impacted the quality of life for the residents in the affected residential neighborhoods; and WHEREAS, in July 2019, the Transportation and Mobility Department engaged Atkins North America, Inc. to conduct a Residential Street Speed Limit Reduction Study (the "Study"), which evaluated eleven residential neighborhoods in the City to determine the feasibility and appropriateness of reducing the posted speed limit on local residential streets from 30 MPH to 25 MPH; and WHEREAS, in September 2019, the City received formal approval via letter from the Miami -Dade County Department of Transportation and Public Works ("DTPW") approving the Study's findings and the reduction of the posted speed limit on local residential roads in the City from 30 MPH to 25 MPH; and WHEREAS, DTPW has advised the City that the installation and maintenance of additional 25 MPH speed limit signs requires an Intergovernmental Agency Agreement ("IAA") between the City and Miami -Dade County (attached to the City Commission Memorandum accompanying this Resolution as Attachment A); and WHEREAS, the City and DTPW have been collaborating on an IAA that will grant authority to the City, pursuant to Sections 2-95 and 2-96.1 of the Miami -Dade County Code, to install and maintain 25 MPH speed limit signage on local residential streets operated, maintained, and owned by the City; and WHEREAS, approval of this IAA will allow the City to continue to move forward with the installation and maintenance of the 25 MPH reduced speed limit signs on local residential streets operated, maintained, and owned by the City; and WHEREAS, funding for the purchase, installation, and maintenance is included in the Transportation and Mobility Department's Fiscal Year 2026 Operating Budget and is anticipated to be included in future Fiscal Years' Operating Budget. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve, in substantial form, an Intergovernmental Agency Agreement ("IAA) between the City of Miami Beach ("City") and Miami -Dade County, pursuant to Sections 2-95 and 2-96.1 of the Miami -Dade County Code, to reduce posted speed limits from 30 miles per hour ("MPH") to 25 MPH on local residential streets in the City; and to perform the installation and maintenance of the 25 MPH speed limit signs on local residential streets operated, maintained, and owned by the City; authorizing the City Manager to negotiate and finalize the IAA consistent with the terms set forth herein, and subject to form approval by the City Attorney; and further, authorizing the City Clerk and City Manager to execute the final negotiated IAA with Miami -Dade County. RECOMMENDATION The City Administration ("Administration") recommends that the Mayor and City Commission ("City Commission") adopt the Resolution. In July 2019. the Transportation and Mobility Department engaged Atkins North America. The DTPW has advised the City that the installation and maintenance of additional 25 MPH speed limit signs require an Intergovernmental Agency Agreement ("IAA") between the City and Miami - Dade County (Attachment A). Accordingly, the City and the DTPW have been collaborating on an IAA that will grant authority to the City, pursuant to Sections 2-95 and 2-96.1 of the Miami -Dade County Code, to install and maintain 25 MPH speed limit signage on local residential streets operated.. maintained, and owned by the City. 506 of 1677 ANALYSIS Approval of this IAA will allow the City to continue to move forward with the installation and maintenance of the 25 MPH reduced speed limit signs on local residential streets operated, maintained, and owned by the City. Should the City Commission adopt a Resolution approving this IAA, in substantial form, the Administration will work with Miami -Dade County to obtain approval from the Miami -Dade County Board of County Commissioners for final execution of the IAA. FISCAL IMPACT STATEMENT The estimated cost to install a 25 MPH speed limit sign is approximately $150 per location. Funding for the purchase, installation, and maintenance of speed limit signs is currently available in the Transportation and Mobility Department's Fiscal Year 2026 Operating Budget and is anticipated to be included in future Fiscal Years' Operating Budget. WHEREAS, pursuant to Sections 2-95 and 2-96.1 of the Miami -Dade County Code, all traffic control and traffic engineering services in Miami -Dade County are under the exclusive jurisdiction of the County; and WHEREAS, the City desires to assume the installation and maintenance responsibilities of the twenty-five (25) miles per hour ("MPH") speed limit signs pertaining to its local municipal street only; and WHEREAS, the City submitted a City -Wide Residential Streets Speed Limit Reduction study performed by Atkins North America, Inc. to the County requesting to lower the speed limit on City residential roads (Exhibit A); and WHEREAS, on September 5, 2019, the County Department of Transportation and Public Works ("DTPW") approved the City to post a lower speed limit of twenty-five (25) MPH on City residential roads, attached hereto as Exhibit B and by reference made a part hereof; and WHEREAS, the City, by Resolution No. 2026-XXXXX, attached hereto as Exhibit C and by reference made a part hereof, has authorized the execution of this Agreement; and WHEREAS, the County and the City agree that nothing contained in this Agreement shall diminish or impact the rights of either entity with respect to jurisdiction, sovereign or permitting powers, or in any other matter related to the installation, use and maintenance of the traffic control devices unless specifically set forth herein, including by not limited to any County powers under the Miami -Dade County Code. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS, COVENANTS, AND CONDITIONS HEREIN, THE CITY AND THE COUNTY AGREE AS FOLLOWS: Section 1, Recitals Adopted, The recitals set forth above are incorporated herein by reference. Section 2. Traffic Control Devices, The City may install and maintain twenty-five (25) MPH speed limit signs ("Speed Limit Signs") only on those local municipal residential streets operated and maintained by the City within its boundaries, and not on County or State roadways, or within school zones. 509 of 1677 Section 3. Installation. Any Speed Limit Signs may be installed on local municipal streets only after signed and sealed design plans, including the location of the new Speed Limit Signs, have been reviewed, permitted, and received written approval by the City of Miami Beach, through its City Manager or his/her designee, and the County's Department of Transportation and Public Works ("DTPW"). Notwithstanding the foregoing or anything in this Agreement to the contrary, if the City utilizes the standard design attached hereto as Exhibit D (the "Standard Design") for the new Speed Limit Signs, no additional review or approval by the County shall be required before installation. For the avoidance of doubt, to the extent that design plans deviate from the Standard Design, such plans shall be submitted to the DTPW for its review and written approval before installation. Section 4. Decals, The City of Miami Beach shall attach a decal to the back of the Speed Limit Sign panels indicating the City's ownership and date of installation. Section 5. Standards. All Speed Limit Signs that may be installed by the City in accordance with this Agreement shall conform to the applicable requirements established by the following publications: a. The latest edition of the Florida Department of Transportation's Standard Specifications for Road and Bridge Construction; b. Manual on Uniform Traffic Control Devices for Streets and Highways, U.S. Department of Transportation Federal Highway Administration (ANSI 136- le- 1989), including latest revisions; c. Standard Highway Signs, U.S. Department of Transportation, Federal Highway Administration; d. Miami -Dade County Public Works Manual (available from the Department of Transportation and Public Works, I I I NW I` Street, Suite 1510, Miami, FL 33128); and e. Florida Highway Guide Sign Program Chapter 14-51. Section 6. Maintenance Resoons� The City assumes sole and complete responsibility for the maintenance of all the Speed Limit Signs that are installed by the City within its boundaries. The City shall be responsible for the aesthetics of all installed Speed Limit Signs (e.g. peeling, graffiti, flyers, stickers, etc.). If the City fails to maintain any Speed Limit Sign, it shall be responsible for any and all costs incurred by the County to replace, maintain, or remove the applicable Speed Limit Sign. Section 7. Liability and indemnification. The City assumes sole and complete liability for any 510 of 1677 and all accidents and/or injuries which may, or are alleged to, occur or arise out of the installation, operation or maintenance of the Speed Limit Signs, and hereby indemnifies, to the extent allowed by Section 768.28, Florida Statutes, and holds the County harmless from any and all claims, including but not limited to negligence, arising out of or relating to the installation, operation, or maintenance of the Speed Limit Signs. Section 8. \o NN air er of SoN creign Inununity. Notwithstanding any other term in this Agreement, nothing herein shall be deemed a waiver of the City's or the County's sovereign immunity, sovereign rights, or limitations of liability as provided by Section 768.28, Florida Statutes, as may be amended from time to time. Section 9. Public Records, The City shall be responsible for keeping records of any and all installations and repairs, and for furnishing pertinent documents as and when said records may be requested. The Parties shall each maintain their own respective records and documents associated with this Agreement in accordance with the requirements for records retention set forth in Chapter 119, Florida Statutes. Section 10, Failure to CompIN .sith .agreement. Upon written notification by the County, and after granting the City at least a seven (7) calendar day cure period, the City shall immediately remove any Speed Limit Signs that are not in compliance with the terms of this Agreement at the City's sole cost and expense. Failure to carry out any of the duties and responsibilities assumed herein by the City following the seven (7) calendar day cure period may result in termination of the Agreement, at the sole discretion of the County, upon five days' notice. Section 11. Headings. The headings or captions of sections or paragraphs used in this Agreement are for convenience of reference only and are not intended to define or limit their contents, nor are they to affect the construction of or to be taken into consideration in interpreting this Agreement. Section 12, Ambiguities, The preparation of this Agreement has been a joint effort of the Parties hereto and both Parties have had the benefit of consultation with legal counsel of their choosing prior to its execution. The resulting document shall not, solely as a matter of judicial construction, be construed more severely against one of the Parties than the other. Section 13, Entirety. This Agreement embodies the entire agreement between the Parties with respect to the matters addressed herein. Previous agreements and understandings of the Parties with respect to such matters are null, void, and of no effect. Notwithstanding any other provision contained herein, no third -party beneficiaries are created with respect to any claims against the County by virtue of this Agreement. Section 14. Amendments, This Agreement may be amended, modified, or altered, and its material provisions may be waived, only by written instrument, and only if properly executed by all parties hereto. 511 of 1677 Section Effective Date, This Agreement shall become effective on the date first written above after such Agreement is fully executed by all parties hereto. Section 16, Termination. Either the City or the County may, in their respective sole and complete discretion, terminate this Agreement, with or without cause and/or for the convenience of the terminating party, upon twenty (20) business days written notice; provided, however, that at the option of the County, the City shall continue to maintain, repair, and be responsible for any Speed Limit Signs installed by the City while this Agreement was in effect. Prior to the termination of this Agreement, however, the City may elect to remove any one or all Speed Limit Signs installed by the City; provided the City shall restore the roadway and area in which the Speed Limit Signs were located to the condition that existed before the City's installation. Section 17, Execution. This Agreement may be executed in one or more hard or electronic counterparts, which, when taken together, shall constitute one fully executed instrument. Section 18, Notice. Any notices to be given hereunder shall be in writing and shall be deemed to have been given if sent by hand delivery, recognized overnight courier (e.g., Federal Express), or by written certified U.S. mail, with return receipt requested, addressed to the Party for whom it is intended, at the place specified. The method of delivery shall be consistent among all of the persons listed herein. For the present, the Parties designate the following as the respective places for notice purposes: a. The study area includes the City of Miami Beach limits, generally bound by south of 88th Street to the north, south of South Pointe Drive to the south, Biscayne Bay to the west, and the Atlantic Ocean to the east. The neighborhoods evaluated as part of this study are listed below. 1. South of Fifth 5. Palmview 9. Lakeview Drive 2. Flamingo 6. North Bay Road 10. Biscayne Point 3. West Avenue 7. Flamingo Drive 11. Normandy Isle 4. Collins Park 8. Orchard Park The City of Miami Beach seeks to reduce the speed limit on its residential streets from the existing 30 mph. The primary intent of the speed limit reduction is to improve vehicular, pedestrian, and bicyclist safety while improving the livability of neighborhoods. The analysis determines if the speed limit reduction is reasonable and in conformance with the criteria promulgated by the Florida Department of Transportation (FDOT). The methodology and analysis is based on the guidelines and procedures described in the Manual for Speed Zoning for Highways, Roads and Streets in Florida (#750-010-002 — July 2017). Methodology Overview The City identified twenty-four locations for collection of vehicular speed data over a seven-day, 24- hour daily period. The data locations were based on field reviews to identify suitable locations and avoiding areas of construction, school zones, special events, influencing traffic controls, and other influencing factors. The data was processed by first tabulating the 85h percentile speed and 10 mph pace for each location. Afterwards, the data was grouped into neighborhood areas and further aggregated into the six zones. The 85th percentile speed and 10 mph pace were calculated for each location. The data was assembled into a spreadsheet, summarizing the results by neighborhood, study zone, and city-wide. After review of the data, speed reduction determinations were made based on conformance with the FDOT publication #750-010-002 — Speed Zoning for Highways, Roads and Streets in Florida, dated July 2017. Methodology is stated in Appendix A. 8511 Percentile Speed The 85th percentile speed defines the speed that 85 percent of drivers drive at or below under free - flowing conditions. Most people don't drive according to the posted speed limit, but account for the visual aspects of the road and a feel for the road. The visual factors that influence speeds can include lane and shoulder configurations and width, presence of vertical and horizontal curves, sight distance and obstructions, and presence of surrounding developments to the roadway. The 85th percentile results are reported by count location and summarized in Table 1. 10 mph Pace The speeds of individual vehicles on a highway vary. Speed dispersion refers to this spread in vehicle speeds. The 10 mph (16 km/h) pace is the ten mile -per -hour range of speeds containing the greatest 1 520 of 1677 +0 ATKINS SNC•LAVALIN Residential Street Speed Limit Reduction Study number of observed speeds and is a measure of speed dispersion. It is described by both the speed value at the lower end of the range and the percentage of all vehicles that are within the range. The 10 mph pace results are reported by count location in Table 1. FDOT Speed Zone Guidance The following is guidance provided by the publication about posted speed related to this study: • With rounding, the posted speed limit should not differ from the 85th percentile speed or upper limit of the 10 mph pace (whichever is less) by more than 3 mph. Speed limits of more than 8 mph below the 85th percentile speed are not authorized. A speed limit of 4 to 8 mph less than the 85th percentile speed shall be authorized if supported by a supplemental investigation, which identifies the following: 1. There are road or roadside features not readily obvious to the normally prudent driver, such as length of section, alignment, roadway width, surface condition, sight distance, traffic volume, crash experience, maximum comfortable speed in curves, side friction (roadside development), signal progression, etc.; 2. Other standard signs and markings have tried but found ineffective; or 3. To support a context classification target speed as defined in section 9.4 of this manual. Data Collection The traffic data (vehicular speed and volume counts) were collected at each location for 24 hours over seven days between October 301h and November 5", 2018. The data was reported by hour and direction for each day. It is noted that the City collected data originally at fifty-three (53) locations. Further review of collected data indicated that only twenty-four (24) locations represented valid data collection locations. Despite good faith efforts to suitably locate all counts, it was determined that field conditions for the balance of locations were unacceptably influenced by various neighborhood site conditions in the field, and so conservatively, these locations were not used in the analysis. The data collection locations and results are depicted with in Table 1. Below is a listing of data collection locations. The citywide average 10 mph pace speed range was 16-25 mph. In accordance with the FDOT publication #750-010-002 — Speed Zoning for Highways, Roads and Streets in Florida, dated July 2017, these results would support a 25 mph posted speed limit in residential neighborhoods. It is recommended that the speed limit for residential areas covered by this study within the City of Miami Beach city limits be posted at 25 mph, as supported by the collected and analyzed data. The primary intent of the speed limit reduction is to improve vehicular, pedestrian and bicyclist safety while improving the livability of neighborhoods. The analysis would determine if the speed limit reduction is reasonable and in conformance with the criteria promulgated by the Florida Department of Transportation (FDOT). The methodology and analysis will be coordinated with Miami -Dade County, and based on the guidelines and procedures outlined in the Manual for Speed Zoning for Highways, Roads and Streets in Florida (#750-010-002 — July 2017). The following was the methodology used for the engineering and traffic investigation. • The City identified twenty-four locations for collection of vehicular speed data over a seven-day, 24-hour daily period. • The data locations were based on field reviews to identify suitable locations and avoiding areas of construction, school zones, special events, and other factors. • The 85th percentile speed and 10 mph pace was calculated for each location. The data was assembled into a spreadsheet, summarizing the results city-wide. • Speed reduction determinations - based on conformance with the FDOT publication #750-010-002 — Speed Zoning for Highways, Roads and Streets in Florida, dated July 2017. With rounding, the posted speed limit should not differ from the 85th percentile speed or upper limit of the 10 mph pace (whichever is less) by more than 3 mph.
