At the May 21, 2025 City Commission meeting, the Mayor and City Commission approved Resolution No. 2025-33669, directing the Administration to develop a 90 day targeted, comprehensive, and unified plan to mitigate illegal muffler/exhaust noise on these roadways, beginning with 5th street, including adjacent portions of the MacArthur Causeway in proximity to residential buildings and high priority locations in the South of Fifth neighborhood. This L TC is provided pursuant to Resolution No. 2026-34157 approved by the Mayor and City Commission at the February 25, 2026 City Commission meeting. The Administration and the Miami Beach Police Department (MBPD) were directed to deploy not less than one (1) police vehicle at specified locations along 5th Street, 41 st Street, and 71 st Street between the hours of 10:00 P.M. and 5:00 A.M. daily, for the purpose of proactively enforcing violations related to unlawful and excessive vehicular muffler, exhaust, and related noise. The Resolution further directed the Administration to provide monthly updates to the Mayor and City Commission summarizing the results of these enforcement efforts via Letter to Commission ("L TC") commencing on April 1, 2026. The City of Miami Beach Noise Ordinance (Article IV, Sections 46-151 to 46-162) and the Miami­ Dade County Noise Ordinance (Section 21-28) both apply to excessive vehicular noise. Florida Statutes further regulate enforcement regarding exhaust systems (Sec. 316.272), motor vehicle noise (Sec. 316.293), horns and warning devices (Sec. 316.271 ), and operation of sound-making devices in vehicles (Sec. 316.3045). This LTC reports on all citations issued in relation to these excessive noise violations related to exhaust systems and prevention of noise, comparing figures to the same month of the previous two years, as well as providing data from January 2026 to Year-to-Date. Current efforts are carried out by the MBPD Traffic Units (Motors and Accident Investigations Unit) and selected Operations Division personnel with a strong traffic enforcement record. Effective June 27, 2025, the Patrol Division deployed a 90-day nightly detail focused on loud/excessive vehicular noise, using on-duty midnight shift officers from 9:30 P.M. to 2:00 A.M.
