(Bhatt) CA uiiris ORDINANCES &RESOLUTIONS C7F Sponsored by Environment and Sustainability A RESOLUTION ACCEPTING THE RECOMMENDATIONS OF THE BEACHFRONT MANAGEMENT PLAN AD-HOC ADVISORY GROUP AT ITS MARCH 10,2026 MEETING,APPROVING THE DRAFT 2026 BEACHFRONT MANAGEMENT PLAN ("PLAN"),AND AUTHORIZING THE ADMINISTRATION TO SUBMIT THE DRAFT PLAN TO THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION, DIVISION OF STATE LANDS,AND THE ACQUISITION AND RESTORATION COUNCIL FOR REVIEW Miami Beach United SUPPORTS submitting the DRAFT 2026 BEACHFRONT MANAGEMENT PLAN to the State to maintain City control over our beachfront.We are concerned,however,with elements of the attachments to the plan.First,we do not believe it is in the public interest to have a large amount of our public beachfront taken up with commercial sheds,chairs,and loungers.Second,there is a disturbing appearance of a monopoly on Maimi Beach concessions.Lastly,we question whether these concessions are consistent with the Miami-Dade County Charter that aims to protect our beaches for the public. C7AH Sponsored by Fernandez,Dominguez,Salinas,Magazine RESOLUTION TO REFORM RESIDENTIAL TOWING PRACTICES;SAID PLAN TO INCLUDE:(1)ENDING RESIDENT TOWS ON PUBLIC PROPERTY,EXCEPT IN INSTANCES INVOLVING VEHICLES PARKED NEXT TO FIRE HYDRANTS,IN'HANDICAP PARKING SPACES,AND IN DESIGNATED FREIGHT LOADING ZONES;AND (2)ENHANCING ENFORCEMENT IN RESIDENTIAL ZONES AND FREIGHT LOADING ZONES TO ENSURE COMPLIANCE AND REDUCE ILLEGAL PARKING. Miami Beach United SUPPORTS this resolution that will eliminate certain residential tows on public property because it is another step in eliminating predatory towing practices.However,to prevent abuse,we suggest the no-tow exceptions be limited to violations that do not extend past 24 hours. R5K Sponsored by Fernandez -10:05 AM Second Reading Public Hearing ORDINANCE AMENDING "STOP THE PAUSE POLICY"TO MODIFY MINIMUM VOTING THRESHOLDS FOR THE CITY COMMISSION RELATING TO SPECIFIED PROJECTS AT ADVANCED STAGES OF COMPLETION HAVING AN ESTIMATED CONSTRUCTION COST ABOVE $1,000,000. This item is being continued,having been referred to the Neighborhood Resiliency Projects Advisory Committee where additional stipulations and language are being discussed to ensure adequate resident and stakeholder feedback and input,in keeping with MBU's initial resolution regarding the ordinance. R5S Sponsored by Meiner,Dominguez,Salinas,Fernandez,Bhatt - 10:20 AM Second Reading Public Hearing AN ORDINANCE AMENDING EXCESSIVE NOISE ORDINANCE TO REDUCE THE DISTANCE TO ESTABLISH PRIMA FACIE EVIDENCE OF THE SPECIFIED NOISE VIOLATION DURING SPECIFIED HOURS TO 25 FT FOR VESSELS,FLOATING STRUCTURES OR VEHICLES Miami Beach United SUPPORTS this ordinance amending existing regulations on excessive noise between the hours of 11 PM and 7 AM by reducing the distance from which a noise can be heard. RSX Sponsored by Fernandez,Salinas,Bhatt --10:35 a.m.Second Reading Public Hearing BUILDING PERMIT FORGIVENESS AND ASSISTANCE ORDINANCE ORDINANCE AMENDMENT TO EXTEND THE DURATION OF THE BUILDING PERMIT REPRIEVE PROGRAM FOR OWNERS OF SINGLE-FAMILY RESIDENTIAL,MULTI-FAMILY RESIDENTIAL, MIXED-USE OR COMMERCIAL PROPERTIES WHO HAVE FAILED TO OBTAIN A BUILDING PERMIT,OR WHO HOLD EXPIRED PERMITS, THROUGH DECEMBER 31,2028.CURRENT PROGRAM WAS ENACTED IN 2017 AND HAS BEEN RENEWED CONTINUOUSLY FOR 1-2 YEARS.THE PURPOSE WAS TO ENCOURAGE PROPERTY OWNERS WHO PERFORMED WORK WITHOUT A PERMIT TO VOLUNTARILY COMPLY WITH PERMIT REQUIREMENTS AND NOT INCUR A PENALTY.THIS AMENDMENT WOULD APPLY ONLY TO PROPERTIES WHERE UNAUTHORIED WORK WAS PERFORMED ON OR BEFORE DECEMBER 31,2022. Miami Beach United SUPPORTS this Ordinance to encourage people who did work without a permit prior to 2023 to bring their properties into conformance without penalty We believe that this should be the last extension of this program as plenty of time will have occurred for people to utilize it. R5AA Sponsored by Fernandez -10:50 AM First Reading Public Hearing ORDINANCE AMENDMENT TO PROCUREMENT PROCEDURES RELATED TO "REJECTION OF BIDS;NEGOTIATION;SOLE SOURCE PURCHASES;WAIVER OF COMPETITIVE BIDDING,"AND THE INCLUSION INCLUDE ADDITIONAL FACTORS TO BE CONSIDERED WHEN DETERMINING THE LOWEST AND BEST BIDDER.THIS IS IN RESPONSE TO RECOMMENDATIONS FROM THE INSPECTOR GENERAL. Miami Beach United SUPPORTS this resolution to increase transparency and accountability in the procurement process and awarding of contracts. R5AC Sponsored by Bhatt-11 :10 AM First Reading Public Hearing ORDINANCE AMENDMENT CREATING DEFINITION FOR "MICROMOBILITY DEVICE"AND DESCRIBING RESPONSIBILITIES FOR THEIR OPERATION,REQUIRED SAFETY EQUIPMENT AND ENFORCEMENT OF VIOLATIONS. Miami Beach United SUPPORTS this ordinance regarding micromobility devices because it promotes safety for operators,pedestrians and I Imotorists.The ordinance would state a definition for micromobility device, provide regulations,and sets penalties for violations for micromobility devices in the public rights-of-way R5AD Sponsored by Bhatt --11:11 AM First Reading Public Hearing ORDINANCE AMENDMENT WHICH WOULD EXEMPT FLAMINGO PARK,COLLINS PARK AND COLLINS CANAL PARK FROM THE PROHIBITION OF MOTORIZED MEANS OF TRANSPORTATION IN CITY PARKS MBU OPPOSES this amendment.We firmly supported the ordinance prohibiting such vehicles in all City Parks which we believe offers important protection for our residents and visitors,and we believe that protection must stand without exception. R5AE Sponsored by Dominguez --11:15 a.m.First Reading Public Hearing ORDINANCE AMENDMENT TO MODIFY THE MINIMUM DISTANCE SEPARATION REQUIREMENTS FOR TOBACCO AND VAPE DEALERS IN NORTH BEACH.THIS AMENDMENT WILL APPARENTLY ONLY BENEFIT A SINGLE PROPRIETOR AND WAS UNANIMOUSLY OPPOSED BY THE PLANNING BOARD. Miami Beach United OPPOSES the proposed ordinance,which would weaken existing safeguards intended to restrain access to tobacco and vaping products,particularly for children and adolescents. The ordinance also undermines ongoing efforts by the Commission to address the over-concentration of these businesses,which are already prevalent throughout the city There is a strong potential for a precedent that could encourage future requests for additional exceptions and other special favors. R7F Sponsored by Bhatt A RESOLUTION ESTABLISHING A PROCEDURE FOR EACH CITY COMMISSIONER TO IDENTIFY UP TO THREE PRIORITY ITEMS ON EACH REGULAR CITY COMMISSION MEETING AGENDA THAT THE COMMISSIONER WISHES TO PRESENT;PROVIDING THAT EACH COMMISSIONER MAY PROVIDE A RANKED LIST OF PRIORITY ITEMS IN WRITING TO THE OFFICE OF THE MAYOR NO LATER THAN 5:00 P.M.ON THE LAST BUSINESS DAY BEFORE THE CITY COMMISSION MEETING;PROVIDING THAT THE MAYOR SHALL USE REASONABLE EFFORTS TO CALL EACH COMMISSIONER'S PRIORITY ITEMS, SUBJECT TO APPLICABLE TIME LIMITS IN THE CITY CODE;AND PROVIDING FOR THE ORDER IN WHICH PRIORITY ITEMS SHALL BE CALLED. PriorMBU Resolution (March 18th):Miami Beach United OPPOSES this resolution,although we agree with the intent of this resolution to ensure that every commissioner's items get a fair chance to be heard. Nonetheless,we do not think this requires codification or a specific number of items from each commissioner.
