RESOLUTION NO. 98-22673
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE ADMINISTRATION TO PROCEED WITH THE
ISSUANCE OF A REQUEST FOR PROPOSALS SEEKING
THE SERVICES OF A PSYCHOLOGICAL SERVICES FIRM
TO PROVIDE PSYCHOLOGICAL SERVICES FOR
EMPLOYMENT APPLICANTS IN THE POLICE OFFICER,
FIREFIGHTER, AND RELATED CLASSIFICATIONS AND
FOR CITY EMPLOYEES.
WHEREAS, in 1992, the City solicited proposals, pursuant to Request for Proposals
No. 73 - 91/92 (RFP), for a service provider to supply psychological services for
employment applicants and City employees; and
WHEREAS, a contract was awarded to the top-ranked proposer pursuant to its
response to the RFP; and
WHEREAS, the City exercised the options to renew the contract; and
WHEREAS, said contract with the current provider expires in May 1998; and
WHEREAS, the City desires to continue to protect the psychological health of public
safety employees and to provide for the physical safety and well being of citizens, visitors,
and employees; and
WHEREAS, the City desires to continue to have a professional and experienced
firm perform psychological evaluations on new employees in the Police Officer, Firefighter,
and related classifications; and
WHEREAS, the City desires to continue to provide specialized psychological
services from a professional and experienced firm for employees in the Police Officer,
Firefighter, and related classifications; and
WHEREAS, the primary users of this contract, the City's Human Resources
Department, Police Department, and Fire Department, have recommended that the
services be continued; and
WHEREAS, funding for the new contract has been requested in the Fiscal Year
1998/99 budget of the Police and Fire Departments.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the Administration to proceed with the issuance of a
Request for Proposals seeking the services of a psychological services firm to provide
psychological services for employment applicants in the Police Officer, Firefighter, and
related classifications and for City employees.

Sealed proposals for Professional Services of a Psychological provider, to provide psychological services
for employment applicants and employees as per specifications and outline of scope of services, will be
received by the Procurement Director of Miami Beach at the Procurement Division Office, 1700 Convention

SECTION I - OVERVIEW AND PROPOSAL PROCEDURES
A. INTRODUCTION/BACKGROUND
The City of Miami Beach, Florida ("the City") has need to contract \"ith a psychological services
provider to conduct comprehensive pre-employment evaluations and employee counseling. The
proposer will identify qualified professional(s) with experience in providing these services in a valid.
reliable manner consistent with sound, currently accepted professional and legal methodologies. The
experience of the finn and of the individuals providing services under this contract shall include having
provided these services for law enforcement and firefighting applicants and employees for similar
government agencies.
The City of Miami has a diverse applicant pool and workforce. The City projects hiring 30-60 Police
Officers and ) 5-30 Firefighters in the next year. The numbers of applicants, hires, and employees
shown in this RFP to whom services may be provided, are for the proposer's guidance only; no
guarantee is given or implied as to the actual number of individuals to whom services may be provided.
The awarded contract will be for an initial two (2) year term with and option for a third, fourth. and fifth
year at the City's discretion.

C. PROPOSAL SUBMISSION
An original and eight (8) copies of complete proposal must be received by April 7, 1998 at 2:00 P.M.
and will be opened on that day at that time. The original and all copies must be submitted to the
Procurement Division in a sealed envelope or container stating on the outside the proposer's name,
address, telephone number. RFP number and title. and proposal due date.
The responsibility for submitting a response to this RFP to the Procurement Division on or before the
stated time and date will be solely and strictly that of the proposer. The City will in no way be
responsible for delays caused by the U.S. Post Office or caused by any other entity or by any
occurrence. Proposals received after the proposal due date and time will not be accepted and will not
be considered.
D. PRE-PROPOSAL CONFERENCE
A Pre-Proposal Conference will be held at 10:00 on March 24. 1998. in the Human Resources Training
Room. and will provide proposers the opportunity to ask questions about the RFP and the City's
requirements.
E. CONTACT PERSON/ADDITIONAL INFORMATION/ADDENDA
The contact person for this RFP is the Procurement Director at (305) 673- 7490. Proposers are advised
that from the date of release of this RFP until award of the contract, no contact with City personnel
related to this RFP is permitted, except as authorized by the contact person. Any such unauthorized
contact may result in the disqualification of the proposer's submittal.

The City will issue replies to inquiries and any other corrections or amendments it deems necessary in
written addenda issued prior to the deadline for responding to the RFP. Proposers should not rely on
representations, statements, or explanations other than those made in this RFP or in any addendum to
this RFP. Proposers are required to acknowledge the number of addenda received as part of their
proposals. The proposer should verify with the Procurement Division prior to submitting a
proposal that all addenda have been received.

G. MODIFICA TION/WITHDRA W ALS OF PROPOSALS
A proposer Illay submit a Illodified proposal to replace all or any portion of a previously submitted
proposal up until the proposal due date and time. Modifications received after the proposal due date
and time will not be considered.
Proposals shall be irrevocable until contract award unless withdrawn in writing prior to the proposal
due date or after expiration of 120 calendar days from the opening of proposals without a contract
award. Letters of withdrawal received after the proposal due date and before said expiration date and
letters of withdrawal received after contract award will not be considered.
H. RFP POSTPONEMENT/CANCELLATION/REJECTION
The City may, at its sole and absolute discretion, reject any and all, or parts of any and all, proposals;
re-advertise this RFP; postpone or cancel, at any time, this RFP process; or waive any irregularities in
this RFP or in any proposals received as a result of this RFP.
I. COST INClJRRED BY PROPOSERS
All expenses involved with the preparation and submission of proposals to the City, or any work
performed in connection therewith, shall be the sole responsibility of the proposer(s) and not be
reimbursed by the City.
J. VENDOR APPLICATION
Prospective proposers should register with the City of Miami Beach Procurement Division; this will
facilitate their receipt of future notices of solicitations when they are issued. All proposer(s) must
register prior to award: failure to register will result in the rejection of the proposal. Potential proposers

K. EXCEPTIONS TO RFP
Proposers must clearly indicate any exceptions they wish to take to any of the terms in this RFP, and
outline what alternative is being offered. The City, after completing evaluations, may accept or reject
the exceptions. In cases in which exceptions are rejected. the City may require the proposer to furnish
the services or goods originally described, or negotiate an alternative acceptable to the City.
L. SUNSHINE LAW
Proposers are hereby notified that all information submitted as part of a response to this RFP will be
available for public inspection after opening of proposals, in compliance with Chapter 286, Florida
Statutes, known as the "Government in the Sunshine Law".
M. NEGOTIATIONS
The City may award a contract on the basis of initial offers received, without discussion, or may require
proposers to give oral presentations based on their proposals. The City reserves the right to enter into
negotiations with the selected proposer, and if the City and the selected proposer cannot negotiate a
mutually acceptable contract, the City may terminate the negotiations and begin negotiations with the
next selected proposer. This process may continue until a contract has been executed or all proposals
have been rejected. No proposer shall have any rights in the subject project or property or against the
City arising from such negotiations.
N. PROTEST PROCEDURE
Proposers that are not selected may protest any recommendations for contract award by sending a
formal protest letter to the Procurement Director. which letter must be received no later than 5 calendar
days alter award by the City Commission. The Procurement Director will notify the protester of the

O. RULES; REGULATIONS; LICENSING REQUIREMENTS
Proposers are expected to be familiar with and comply with all Federal, State and local laws,
ordinances, codes, and regulations that may in any way affect the services offered, including the
Americans with Disabilities Act, Title Vll of the Civil Rights Act, the EEOC Uniform Guidelines, and
all EEO regulations and guidelines. Ignorance on the part of the proposer will in no way relieve it from
responsibility for compliance.
P. DEFAULT
Failure or refusal ofa proposer to execute a contract upon award by the City Commission, or untimely
withdrawal of a proposal before such award is made and approved, may result in forfeiture of that
portion of any proposal surety required as liquidated damages to the City~ where surety is not required,
such failure may result in a claim for damages by the City and may be grounds for removing the
proposer from the City's vendor list.

Q. CONFLICT OF INTEREST
All proposers must disclose with their proposal the name(s) of any of Ticer, director, agent, or
immediate family member (spouse, parent, sibling, child) who is also an employee of the City of Miami
Beach. Further, all proposers must disclose the name of any City employee who owns, either directly
or indirectly, an interest of ten (10%) percent or more in the proposcr or any of its affiliates.
R. PROPOSER'S RESPONSIBILITY
Before submitting proposal, each proposer shall make all investigations and examinations necessary
to ascertain all conditions and requirements affecting the full performance of the contract. Ignorance
of such conditions and requirements resulting from failure to make such investigations and
examinations will not relieve the successful proposer from any obligation to comply with every detail
and with all provisions and requirements ofthe contract documents, or will be accepted as a basis for
any claim whatsoever for any monetary consideration on the part of the proposer.
S. RELA TION OF CITY
It is the intent of the parties hereto that the successful proposer be legally considcred to be an
independent contractor and that neither the proposer nor thc proposcr"s cmployees and agents shall,
under any circumstances, be considered employees or agents of the City.

SECTION II - SCOPE OF SERVICES
The City of Miami Beach, Florida ("the City") has need to contract with a psychological services provider
to conduct comprehensive pre-employment evaluations and employee counseling. The proposer will identify
qualified professional(s) with experience in providing these services in a valid, reliable manner consistent
with sound, currently accepted professional and legal methodologies. The experience of the firm and of the
individuals providing services under this contract shall include having provided these services for law
enforcement and firefighting applicants and employees for similar government agencies.
A. PRE-EMPLOYMENT EVALUATION: Service provider will evaluate approximately 100-150
individuals per year primarily in the Police and Fire Departments, and in other departments as needed.
The majority of those individuals will be candidates for the classifications of Police Officer, Dispatcher,
and Communications Operator and for other classifications in the Police Department, as well as for
Firefighters in the Fire Department. The firm will identify those candidates psychologically suited and
not suited for each classification. This will be accomplished as follows:
I. Administer and interpret one or more tests which will identify and screen for individuals who
possess the mental conditions, psychological characteristics, or tendencies which would make them
suited or unsuited for a given classification, including, but not limited to the following areas:
a. Psychosis
b. Poor impulse control (anger/hostility patterns or tendencies), impatience
c. Character disorders (especially anti-social personality disorders)
d. Tendency to be too passive or aggressive, especially in critical situations
e. Racial. religious, age, nationality, disability, sexual orientation, or other prejudices
f. High degree of immaturity
g. Poor judgement
h. Poor socialization skills/inability to interact with individuals from a wide variety of cultural
and socio-cconomic backgrounds

3. The psychological services firm will research their records to determine if the firm has had any prior
contact with applicant and will research other psychological or other relevant records and will take

4. Conduct a clinical interview with each applicant for at least minutes for the purpose of confirming
written test findings, resolving inconclusive or conflicting information, and identifying evidence of
the following:

often involving death(s), such as police involved shootings, fires, traffic accidents, suicide, or other
unusual incidents, Requires availability on a 24-hour basis - Estimate 1 incident per year, but may

2. Conduct mandatory or voluntary Fitness for Duty evaluations - Estimate 3 per year
3. Assist in the design and implementation of specialized training programs for public safety and other
employees, including, but not limited to:
a. Stress management, relaxation
b. Sensitivity towards minorities and other special groups
c. Excessive force awareness
d. Identification of early warning signs of emotional, stress related, or other problems before
performance is severely affected and to facilitate maximum mental health and productivity
e. Crisis intervention
4. Refer employees to and provide consultation with specialists, rehabilitative services, the City's
psychiatric service and Employee Assistance Program (EAP) providers
5. Provide consultation to the City to develop, implemenc maintain, evaluate. and modify internal
policies, procedures, and programs related to the proposed services
6. Remain available on an as-needed basis to answer any questions or clarify or interpret results of
reports
7. Provide supplemental written and oral materials and training to City personnel to facilitate
psychological results and reports
8. Retest and re-evaluate individuals as requested by the City

in conjunction with any challenges, appeals, or suits which might arise from providing the proposed
servIces.

SECTION III - PROPOSAL FORMAT
Proposals must contain the following documents, each fully completed and signed as required. Proposals
which do not include all required documentation or are not submitted in the required format, or which do
not have the appropriate signatures on each document, may be deemed to be non-responsive. Non-
responsive proposals will receive no further consideration.
A. CONTENTS OF PROPOSAL
I. TABLE OF CONTENTS
Outline in sequential order the major areas of the proposal, including enclosures. All pages must
be consecutively numbered and correspond to the table of contents.
2. PROPOSAL POINTS TO ADDRESS
Proposer must respond to all minimum requirements listed below, and provide documentation which
demonstrates ability to satisfy all of the minimum qualification requirements. Proposals which do
not contain such documentation may be deemed non-responsive.
3. PRICE PROPOSAL
Proposer must include price which will be charged to the City.

SECTION V - GENERAL PROVISIONS
A. ASSIGNMENT
The successful proposer shall not cnter into any sub-contract, retain consultants, or assign, transfer,
convey, sublet, or otherwise disposc of this contract or of any or all of its right, title, or interest
therein, or its power to execute such contract to any person, firm, or corporation without prior
written consent of the City. Any unauthorized assignment shall constitute a default by the successful
proposer.
B. INDEMNIFICATION
The successful proposer shall be required to agree to indemnifY and hold harmless the City of Miami
Beach and its officers, employees, and agents, from and against any and all actions, claims,
liabilities, losses and expenses, including but not limited to attorneys' fees, for personal, economic
or bodily injury, wrongful death, loss of or damage to property, in law or in equity, which may arise
or be alleged to have arisen from the negligent acts or omissions or other wrongful conduct of the
successful proposer, its employees, or agents in connection with the perfonnance of service pursuant
to the resultant Contract; the successful proposer shall pay all such claims and losses and shall pay
all such costs and judgments which may issue from any lawsuit arising from such claims and losses,
and shall pay all costs expended by the City in the defense of such claims and losses, including
appeals.
C. TERMINATION FOR DEFAULT
If through any cause within the reasonable control of the successful proposer, it shall fail to fulfill
in a timely manner, or otherwise violate any of the covenants, agreements, or stipulations material
to the Agreement, the City shall thereupon have the right to terminate the services then remaining

D. TERMINATION FOR CONVENIENCE OF CITY
The City may, for its convenience, terminate the services then remaining to be performed at any time
without cause by giving written notice to successful proposer of such termination, which shall
become effective thirty (30) days following receipt by proposer of such notice. In that event. all
finished or unfinished documents and other materials shall be properly delivered to the City. If the
Agreement is terminated by the City as provided in this section, the City shall compensate the
successful proposer in accordance with the Agreement for all services actually performed by the
successful proposer and reasonable direct costs of successful proposer for assembling and delivering
to City all documents. No compensation shall be due to the successful proposer for any profits that
the successful proposer expected to earn on the balanced of the Agreement. Such payments shall
be the total extent of the City's liability to the successful proposer upon a termination as provided
for in this section.

ACCEPTANCE OR REJECTION OF PROPOSALS
The City of Miami Beach reserves the right to reject the proposal from any person or firm who has
previously fai led in the proper performance of an award or to deliver on time contracts of a sim ilar nature
or who is not in a position to perform properly under this award.
AMERICAN'S WITH DISABILITIES ACT
The proposer agrees to adhere to and be governed by all applicable requirements of the laws listed below
including, but not limited to, those provisions pertaining to employment, provision of programs and services,
transportation, communications, access to facilities, renovations, and new construction.

may be provided. It should be clearly understood that these estimates in no way constitute a guarantee of
the level of effort that will be requested of the successful proposer.
INSURANCE REQUIREMENTS
The successful bidder/contractor will be required to maintain in full force and effect for the duration of the
contract a policy of professional liability covering the services and activities required in this contract.
The Consultant shall not commence any work pursuant to this Agreement until all insurance required has
been obtained and such insurance has been approved by the City's Risk Manager. The Consultant shall
maintain and carry in full force during the tenn of the Agreement and throughout the duration of this project
the following insurance:
I. Consultant Professional Liability in the amount of $1 ,000,000.00 per occurrence with a deductible not
to exceed $25,000 per occurrence. For a claims made policy, the Consultant agrees to carry four (4)
years tail coverage after work is completed, or maintain a comparable policy for four (4) years, provided
that such comparable policy shall include coverage for prior acts effective from the date of execution
of the Agreement. A certified copy of the Consultant's (and any subconsultants') Insurance Policy must
be filed and approved by the Risk Manager prior to commencement.
2. Workers Compensation & Employers Liability as required per Florida statutes.
3. Thirty (30) days written notice of cancellation or substantial moditication in the insurance coverage
must be given to the City by the Consultant and his insurance company.
4. The insurance must be furnished by insurance companies authorized to do business in the State of
Florida and approved by the City's Risk Manager.
5. Original certificates of insurance for the above coverage must be submitted to the City's Risk Manager
for approval prior to any work commencing. These cel1ificates wi II be kept on file in the office of the
Risk Manager. Upon each anniversary or expiration of the policy, a new certification and policy must
be presented to the Risk Manager.
6. The Consultant is responsible for obtaining and submitting. all insurance certificates for their
Consultants.

ascertain compliance with required coverage.
All of Consultant's certificates, above, shall contain endorsements providing that written notice shall be given
to the City at least thirty (30) days prior to termination, cancellation or reduction in coverage in the policy.
Unless directed by the City otherwise, the Consultant shall not commence any services pursuant to this
Agreement until the City has received and approved, in writing, cel1ificates of insurance showing that these
requirements (in their entirety) have been met and provided for.
Alternate coverage or any changes to these requirements which may be necessary will be determined by and
are subject to prior approval of the City Manager and/or his/her designee. Insurance requirements are subject
to change.

PROJECT MANAGEMENT
The Consultant shall appoint a qualified individual acceptable to the City to serve as Project Manager for
the services who shall be fully responsible for the day-to-day activities under this Agreement, and who shall
serve as the primary contact for the City's Project Coordinator.
PROPOSAL CERTIFICA nON
Submission of a signed proposal is proposer's certification that the proposer will accept any awards made
as a result of said subm ission at the prices and terms contained therein. The prices quoted in the proposal
shall remain in effect for at least 120 days.
SANCTIONS FOR NONCOMPLIANCE WITH NONDISCRIMINATION PROVISIONS
In the event ofthe Consultant's noncompliance with the nondiscrimination provisions of the Agreement, the
City shall impose such Agreement Sanctions as the City or the State of Florida may determine to be
appropriate, including but not limited to withholding of payments to the Consultant under the Agreement
until the Consultant complies and/or cancellation, termination or suspension of the Services, in whole or in
part. In the event the City cancels or term inates the services pursuant to this Section the rights and
obligations of the parties shall be the same as provided under Termination for Convenience ofeity.
SOLE PROPERTY
The successful proposer will be prohibited from publishing or releasing any information related to the
requested services without the prior written permission of the City. All tests, evaluations, reports, and other
materials and documents resulting from this contract will remain the sole property of the City; shall not be
disposed of without specific written authorization from the City; and shall be used by the City in any manner
without any additional charge. Such materials shall include, but not be limited to, electronically produced
and/or stored data, prepared by the Consultant pursuant to the contract, and will be given to the City in a
format suitable for reuse by the City.

ADMINISTRATION RECOMMENDATION:

BACKGROUND:
In 1992, the City solicited proposals, pursuant to Request for Proposals No. 73 - 91/92 (RFP), for
a service provider to supply psychological services for employment applicants and City employees.
A contract for two years with three option years was awarded to the top proposer. The contract
and its extensions with the current provider will expire in May 1998.
The primary users of this Contract, the CIty's Human Resources Department, Police Department.
and Fire Department, have recommended that the services be continued. These services allow
the City to protect the psychological health of publiC safety employees and to provide for the
physical safety and well being of citizens, visitors. and employees. Through this contract a
professional and experienced firm performs psychological evaluations on new employees in the
Police Officer, Firefighter, and related classifications to determine their suitability for those types
of work. The successful proposer will also continue the current service of providing specialized
psychological services for Police Officer, Firefighter, and related classifications after they are
involved in critical or traumatic incidents which may involve shootings, fire accident fatalities, etc.
CONCLUSION:
It is recommended that the Mayor and the Commission authorize the Administration to proceed
with the issuance of the Request for Proposals seeking the services of a psychological services
firm to provide psychological services for employment applicants in the Police Officer, Firefighter,
and related classifications and for City employees
