1. A summary of the proposed Ordinance and its purpose is more fully set forth in the Commission
Memorandum accompanying the Ordinance, as well as in the recitals to the Ordinance itself. The
Commission Memorandum and Ordinance are attached hereto .
2 . The City of Miami Beach estimates that the proposed Ordinance will have no direct economic
impact on private, for-profit businesses in the City of Miami Beach; that the proposed Ordinance
will have no direct compliance costs that businesses may reasonably incur; that the proposed
Ordinance will not impose any new charge or fee for which bus inesses will be financially
responsible ; and that the proposed Ordinance will not impact the City of Miami Beach 's regulatory
costs and will not generate any revenue from new charges or fees .
3. Good faith estimate of the number of businesses likely to be impacted by the proposed

BACKGROUND/HISTORY
At the request of Commissioner Monica Matteo-Salinas, this Ordinance has been placed on the
City Commission meeting agenda fo r First Reading .
Article II of Chapter 2 of the City Code, entitled "City Commission," establishes rules of procedure
and agenda requ irements fo r meetings of the City Commission. City Code Section 2-14 , entitled
"Meeting procedures and agendas," establishes limits on the number of Commissioner initiated
discussion items , resolutions, and ordinances for each City Commission meeting agenda .
ANALYSIS
This Ordinance amends City Code Section 2-14 to impose a lim it on the number of referrals to
Commission Committees per regular meeting agenda . Specificall y, no more than four (4) refe rrals
to a Commission Committee may be placed on a regular meeting agenda by the Mayor or a
member of the City Commission.
The Ordinance a lso amends existing limits on the number of discussion items , resolutions , and
ordinances as fo ll ows:
• A combined limit of four (4 ), instead of eight (8), discussion items and resolutions, may be
placed on a regular meeting agenda by the Mayor or a member of the City Commission .
• No more than two (2), instead of four (4), ordinances may be sponsored and initiated by
the Mayor or each member of the City Commission and p la ced on an agenda for First
Reading. The Ord inance clarifies that this limit appli es to each regular meeting agenda.
The li mits on the number of Commission Committee refe rra ls , discussion items, resolutions , and
ordinances may be waived by a 5/7 ths vote of the City Commission .

WHEREAS , Article II of Cha pter 2 of the City Code , entitled "City Commission ,"
estab lishes rules of procedure and agenda requirements fo r meetings of the Ci t y Commissio n;
and
WHEREAS , in order to promote efficiency at City Comm iss ion meetings , and in view of
the sig nificant time and re sources requi red to staff and prep are for meetings, the Mayor and City
Commiss ion des ire to impose a limit on the number of referra ls to Comm iss ion Co mmittees and
amend existing limits on the number of discussion ite ms, re solutions, and ordinances that may be
place d on a meeting agend a by the Mayor or a member of the City Comm ission.
NOW, THEREFORE , BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH , FLORIDA, AS FOLLOWS:
SECTION 1. Th at Article II of Chapter 2 of the Miam i Beach Ci ty Code is hereby amend ed t o
state as follows :

wherever possible , to refer new bus iness to a commissio n comm ittee prior to
consideration by the full city comm iss ion . Th ero sh all bo no limit on tho num ber of
commissioner sponsored referral items per mooting agenda . No more th an four
re ferrals to a commission committee may be placed on a regula r me e ting agenda
by the ma yor or each member of the ci ty commission: provid ed that thi s
re q uirement may be waived by a five -se v enths vote of the city commi ss ion .

(7) Limit on number of commissioner-initiated discussion items and resolutions per
meeting agenda . No more than ~ four discussion items and resolutions,
combined , may be placed on a regular meeting agenda by the mayor or by each
member of the city commission . The requirement in this paragraph may be waived
by a five-sevenths vote of the city comm iss ion . The mayor and members of the
city commission are encouraged to first request a referra l to comm ittee, prior to
introducing new bus iness by sponsoring a discussion item or resolution , in order
to promote efficiency, obtain a fiscal impact ana lysis from the city administration,
seek pub lic input, and thoroughly develop new policy proposals .
(8) Limit on number of new ordinances per meeting agenda. No more than fGl::lf two
ord inances may be sponsored and initiated by the mayor or by each member of
the city commission and placed on the same regular meeting agenda for first
reading (excluding items that were transm itted to the city comm ission by a city
commission committee or land use board ). The requ irement in this paragraph shall
not apply to ordinances initiated by the city admin istration , and may be wa ived by
a five-sevenths vote of the city commission .

SEC TI ON 3. SEVERABILITY. If any section, sentence, clause or phrase of th is
ord inance is held to be invalid or unconstitutional by any court of competen t jurisdiction, then
said holding shall in no way affect the validity of the remaining portions of this ord inance .
SECTION 4. COD I FICAT ION . It is the intention of the Mayor and City Commission of
the City of Miam i Beach, and it is hereby orda ined that the provisions of this ordinance shall
become and be made a part of the Code of the City of Miami Beach , Florida . The sections of this
ordinance may be renumbered or re-lettered to accomplish such intention , and the word
"ordinance" may be changed to "section ," "article," or other appropriate word .
SECTI ON 5. EFFE CTI VE DATE. Th is Ordinance shall take effect on
PASSED and ADOPTED this __ day of ________ ., 2026 .
