AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 10 OF THE CODE OF
THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED "ANIMALS," BY
AMENDING SECTION 10 11 THEREOF, ENTITLED "RUNNING AT LARGE
PROHIBITED; EXCEPTIONS," BY PROVIDING A GRACE ZONE
EXTENDING FROM THE PERIMETER OF THE AREA DESIGNATED BY
THE CITY MANAGER FOR THE BENEFIT OF AN OWNER OF AN
UNLEASHED ANIMAL WHO INADVERTENTLY ALLOWS HIS OR HER
ANIMAL TO STRAY OUTSIDE THE APPROVED PERIMETER; AND
PROVIDING FOR REPEALER , SEVERABILITY, CODIFICATION, AND AN
EFFECTIVE DATE.

1. A summary of the proposed Ordinance and its purpose is more fully set forth in the Commission
Memorandum accompanying the Ordinance, as well as in the recitals to the Ordinance itself. The
Commission Memorandum and Ordinance are attached hereto.
2 . The City of Miami Beach estimates that the proposed Ordinance will have no direct economic
impact on private, for-profit businesses in the City of Miami Beach; that the proposed Ordinance
will have no direct compliance costs that businesses may reasonably incur; that the proposed
Ordinance will not impose any new charge o r fee for which businesses will be financially
responsible ; and that the proposed Ordinance will not impact the City of Miami Beach 's regulatory
costs and will not generate any revenue from new cha rges or fees .
3. Good faith estimate of the number of businesses likely to be impacted by the proposed
Ordinance: The City of Miami Beach estimates that no businesses are likely to be impacted by
the proposed Ordinance.

BACKGROUND/HISTORY
ANALYSIS
Chapter 10 of the Code of the City of Miami Beach ("City Code") reg ulates animals within the City
in order to protect the publ ic health , safety, and welfare .
Section 10-11 of the City Code currently proh ibi ts animals from runn ing at large within the City,
subject to lim ited exceptions, including an unfenced area at South Poi nte Park.
The sponsor of thi s ordinan ce, Commissioner David Suarez , desires to provide a one hundred
(100) foot grace zone extending from the perimeter of t he area at South Pointe Park designated
by the City Manager for the benefit of an owne r of an unleashed animal who inadvertentl y allows
his or her animal to stray outside the approved perimeter for no more than five (5 ) minutes .

WHEREAS, Chapter 10 of the Code of the City of Miam i Beach ("City Code ") regulates

WHEREAS , Section 10-11 of the City Code currently prohibits animals from running at large
within the City, subject to limited exceptions ; and
WHEREAS, the Mayor and City Commission desir e to provide a one hundred (100) foot
grace zone extending from the perimeter of the area designated by the City Manager for the benefit
of an owner of an unleashed animal who inadvertently allows his or her animal to stray outside the
approved perimeter for no more than five (5) minutes .
NOW, THEREFORE , BE IT DULY ORDAINED BY THE MAYOR AND CI T Y COMM ISSION
OF THE CITY OF MIAMI BEACH , FLORIDA, AS FOLLOWS :
SECTION 1. That Section 10-2 of Chapter 10 of the Miam i Beach C ity Code is hereby amended
as follows :
CHAPTER 10
ANIMALS
Sec . 10-11. -Runn i ng at large prohibited ; exceptions.
It shall be prohib ited for the owner or person in control of any animal to perm it the a ni mal to run
at large . All animals, when not on the premises of their owner or of the person in control, must
be on a leash or contained in a carrier device and under the control of a competent person ,
except that a dog may be unres t ra ined and shall not be deemed to be at large if it is supervised
by a competent pe rson and is in :
(a ) South Pointe Park, in the designated area south and west of the Wash ington Ave n ue entry
plaza , from sunrise to 10:00 a.m. daily , or from 6 :00 p.m . to 9 :00 p.m. on Monday through
Fr iday, or during such other days and hours , or in such other park or beach areas therein,
as may be specifically designated by t he city manager, plus a one hundred (100 } foot grace
zone extending from the perimeter of the area designated by the city manag er for the benefit
of an owner of an un leashed animal who inadvertently a ll ows h is or her animal to stray
outside the approved pe ri meter for no more than five (5) minu tes: or

(b) North Shore Open Space Park, in the designated beach area between 80th and 82nd
Streets , from 3 :00 p .m . to 7:00 p.m . on Friday, Saturday, and Sunday, or during such other
days and hours, or in such other park areas, or beaches therein , as may be specifically
designated by the city manager; or
(c) An area of a public park, or beach area therein, specifically des ignated by the city manager,
and duri ng such days and hou rs as may be specifically designated by the city manager.
SECTION 3. REPEALER .
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed .
SECTION 4 . SEVERABI LITY.
If any section , sentence , clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisd iction , then said hold ing shall in no way affect the
validity of the remaining portions of this ordinance .
SECTION 5. CODIFI CATION .
It is the intention of the Mayor and City Commission of the City of Miam i Beach, and it is
hereby ordai ned that the provisions of th is ordinance sha ll become and be made a part of the Code
of the City of Miam i Beach, Florida . The sections of this ordinance may be renumbered or re-
lettered to accomplish such intention , and the word "ordinance" may be changed to "section ,"
"article," or other appropriate word .
SECTION 6 . EF FECTIVE DATE .
This Ord inance shall take effect the __ day of ________ , 2026.
