HomeMy WebLinkAboutLTC 269-2026 Design Review Board Recommendation - Single Family Home Roof DecksMIAMI BEACH OFFICE OF THE CITY MANAGER LTC#269-2026 TO FROM DATE SUBJECT LETTER TO COMMISSION Honorable Mayor Steven Meiner and Members of the City Commission Eric Carpenter, City Manager � � June 22, 2026 Design Review Board Recommendation - Single Family Home Roof Decks On May 14, 2026, the Design Review Board (ORB) discussed applicable regulations related to roof decks in single family (RS) districts. The following is a summary of this discussion, including a recommendation from the ORB. DRB DISCUSSION For the purposes of the discussion, the current regulations regarding roof decks in all single family districts was provided: Roof decks. Roof decks shall not exceed 6 inches above the highest point of the proposed flat roof and shall not exceed a combined deck area of 25 percent (25%) of the enclosed floor area immediately one floor below, regardless of deck height. Roof decks shall be setback a minimum of 10 feet from each side of the exterior outer walls, when located along a front or side elevation, and from the rear elevation for nonwaterfront lots. Built in planters, gardens or similar landscaping areas, not to exceed 3 feet, 6 inches above the finished roof deck height, may be permitted immediately abutting the roof deck area. All landscape material shall be appropriately secured. The ORB or HPB may forego the required rear deck setback, in accordance with the applicable design review or appropriateness criteria. Collectively, the Board members believe that the current regulations are too restraining regarding the size limits of roof decks, given the quality and caliber of new construction within the City. The ORB members also felt that the current limitations prevent homeowners from taking advantage of views and the natural environment. DRB RECOMMENDATION The ORB approved a motion (7-0) to transmit the following recommendations to the City Commission: 1.Explore amending the Land Development Regulations of the City Code (LDRs) to allow for rooftops that are larger than 25% of the enclosed floor area immediately one floor below. 2.Potential LOR amendments could include allowing a larger roof deck either as a waiver approved by the ORB or authorizing City staff to administratively approve larger decks. 3.Restrictions on setbacks and canopies for roof decks should remain as they are.
