R5C, R5D Sponsored by Private Applicant – 9:20 AM First Reading Public Hearing ALTON CITY CENTER OVERLAY -- COMPREHENSIVE PLAN AND LDR AMENDMENT ORDINANCE AMENDMENT TO CREATE FAR AND DENSITY INCENTIVES TO ENCOURAGE REDEVELOPMENT OF DORMANT COMMERCIAL PARCELS INTO MIXED-USE PROJECTS ON PROPERTIES THAT MEET CERTAIN REQUIREMENTS AND ARE LOCATED BETWEEN THE WEST SIDE OF ALTON ROAD AND THE EAST SIDE OF WEST AVENUE BETWEEN LINCOLN ROAD AND 17TH STREET Miami Beach United is not taking a position at this time. We recognize the need for redevelopment of this important site, but have concerns about the overall height, ability to fulfill promise for additional public parking, and insufficient setback on Alton Road beginning at 75 feet which is too high to benefit pedestrians. R5G Sponsored by Dominguez – 9:35 AM Second Reading Public Hearing ORDINANCE AMENDMENT TO MODIFY THE MINIMUM DISTANCE SEPARATION REQUIREMENTS FOR TOBACCO AND VAPE DEALERS IN NORTH BEACH. THIS AMENDMENT WILL APPARENTLY ONLY BENEFIT A SINGLE PROPRIETOR AND WAS UNANIMOUSLY OPPOSED BY THE PLANNING BOARD. Miami Beach United OPPOSES the proposed ordinance, which would weaken existing safeguards intended to restrain access to tobacco and vaping products, particularly for children and adolescents. The ordinance also undermines ongoing efforts by the Commission to address the over-concentration of these businesses, which are already prevalent throughout the city. There is a strong potential for a precedent that could encourage future requests for additional exceptions and other special favors. We appreciate that our concern about reduced parking requirements has been somewhat addressed. R5O Sponsored by Fernandez – 9:55 AM Second Reading Public Hearing ORDINANCE AMENDING “STOP THE PAUSE POLICY” TO MODIFY MINIMUM VOTING THRESHOLDS FOR THE CITY COMMISSION RELATING TO SPECIFIED PROJECTS AT ADVANCED STAGES OF COMPLETION HAVING AN ESTIMATED CONSTRUCTION COST ABOVE $1,000,000. MBU SUPPORTS this ordinance as revised. After review, discussion and input from the Neighborhood Resiliency Projects Advisory Committee, this ordinance now includes additional language and stipulations that ensure opportunities for resident input and feedback, and timely communication at all phases of the project. The addition of an initial public meeting to fully communicate plans and gather stakeholder input before any project moves forward is especially significant. R5X Sponsored by Fernandez – 10:15 AM Second Reading Public Hearing ORDINANCE AMENDMENT TO PROCUREMENT PROCEDURES RELATED TO “REJECTION OF BIDS; NEGOTIATION; SOLE SOURCE PURCHASES; WAIVER OF COMPETITIVE BIDDING,” AND THE INCLUSION INCLUDE ADDITIONAL FACTORS TO BE CONSIDERED WHEN DETERMINING THE LOWEST AND BEST BIDDER. THIS IS IN RESPONSE TO RECOMMENDATIONS FROM THE INSPECTOR GENERAL. Miami Beach United SUPPORTS this resolution to increase transparency and accountability in the procurement process and awarding of contracts. R5Y Sponsored by Bhatt – 10:20 AM Second Reading Public Hearing ORDINANCE AMENDMENT CREATING DEFINITION FOR “MICROMOBILITY DEVICE” AND DECRIBING RESPONSIBILITES FOR THEIR OPERATION, REQUIRED SAFETY EQUIPMENT AND ENFORCEMENT OF VIOLATIONS. Miami Beach United SUPPORTS this ordinance regarding micromobility devices because it promotes safety for operators, pedestrians and motorists. The ordinance would state a definition for micromobility devices, provide regulations, and set penalties for violations for micromobility devices in the public rights-of-way. R5Z Sponsored by Bhatt -- 10:21 AM First Reading Public Hearing ORDINANCE AMENDMENT WHICH WOULD EXEMPT FLAMINGO PARK, COLLINS PARK AND COLLINS CANAL PARK FROM THE PROHIBITION OF MOTORIZED MEANS OF TRANSPORTATION IN CITY PARKS MBU OPPOSES this amendment. We firmly supported the ordinance prohibiting such vehicles in all City Parks which we believe offers important protection for our residents and visitors, and we believe that protection must stand without exception. R5AA Sponsored by Salinas, Meiner, Bhatt, Magazine, Fernandez -- 10:22 AM Second Reading Public Hearing AMENDMENT STRENGTHENING “HABITUAL MUNICIPAL ORDINANCE VIOLATION OFFENDERS” BY CHANGING DEFINITION OF HABITUAL OFFENDER FROM FOUR (4) TIMES IN 12 MONTHS TO THREE (3) TIMES IN TWO (2) YEARS. Miami Beach United SUPPORTS this amendment which enhances the City’s ability to identify and address repeat habitual violators by lowering the number of violations required and extending the review period. The change promotes accountability, improves enforcement consistency, and supports the protection of public safety, neighborhood integrity, and community welfare through earlier intervention with chronic offenders. R5AF Sponsored by Fernandez -- 10:40 AM First Reading Public Hearing ORDINANCE AMENDMENT TO MODIFY THE NOTICE REQUIREMENT FOR PROSPECTIVE BULK OWNERS OF RESIDENTIAL CONDOMINIUM UNITS, TO INCLUDE A STATEMENT OF RIGHTS UNDER STATE LAW; AND PROVIDING FOR REFERENCES TO FLORIDA STATUTES Miami Beach United SUPPORTS this amendment, as we did the original ordinance. Expanding the required information in this way provides more transparency, protects Residents Right To Know, and helps to mitigate miscommunication or confusion. R5AM Sponsored by Fernandez -- 11:10 AM First Reading Public Hearing MODIFY THE COMPOSITION OF THE PLANNING BOARD MODIFY THE MEMBERSHIP REQUIREMENTS OF THE PLANNING BOARD TO REQUIRE AT LEAST ONE MEMBER OF THE BOARD RESIDE IN EACH OF THREE GEOGRAPHIC AREAS OF THE CITY (SOUTH BEACH, MID BEACH AND NORTH BEACH) Miami Beach United is OPPOSED to this resolution. We agree with the Planning Board that this resolution is unnecessary in that the Commission is free to appoint representatives from each of North, Mid, and South Beach, but we don’t believe this needs to be codified as it is critical to have the best talent available for the Board. R7M Sponsored by Bhatt A RESOLUTION ESTABLISHING A PROCEDURE FOR EACH CITY COMMISSIONER TO IDENTIFY UP TO THREE PRIORITY ITEMS ON EACH REGULAR CITY COMMISSION MEETING AGENDA THAT THE COMMISSIONER WISHES TO PRESENT; PROVIDING THAT EACH COMMISSIONER MAY PROVIDE A RANKED LIST OF PRIORITY ITEMS IN WRITING TO THE OFFICE OF THE MAYOR NO LATER THAN 5:00 P.M. ON THE LAST BUSINESS DAY BEFORE THE CITY COMMISSION MEETING; PROVIDING THAT THE MAYOR SHALL USE REASONABLE EFFORTS TO CALL EACH COMMISSIONER’S PRIORITY ITEMS, SUBJECT TO APPLICABLE TIME LIMITS IN THE CITY CODE; AND PROVIDING FOR THE ORDER IN WHICH PRIORITY ITEMS SHALL BE CALLED. Prior MBU Resolution (May 20th): Miami Beach United OPPOSES this resolution, although we agree with the intent to ensure that every commissioner’s items get a fair chance to be heard. Nonetheless, we do not think this requires codification or a specific number of items from each commissioner. We believe such a study is critical to understanding the impact of currently planned and future developments on our limited infrastructure. Miami Beach United is happy to see this item, which was proposed by MBU, go to the Planning Board and then the Commission. We believe it is important to have transparency when an agenda item is for the benefit of a specific individual or group.
