SUBJECT: Update Regarding the City's Processing of the Certificate of Appropriateness Application Submitted by Fontainebleau
Miami Beach
This Letter to Commission ("L TC") is to provide an update on the City's ongoing
processing of the application for a Certificate of Appropriateness ("GOA") filed in connection with the proposed modification and refurbishment of the rear amenity deck on the Fontainebleau Miami Beach property ("Application").
The Fontainebleau is located at 4441 Collins Avenue, Miami Beach. The
Fontainebleau, which was built in 1954 and designed by Morris Lapidus in the Post
War Modern style, has been individually listed on the National Register of Historic
Places since 2008 and is a contributing building located within the City's Morris
Lapidus/Mid-Twentieth Century Local Historic District. Because the Fontainebleau is located in a local historic district, a GOA is required under the Land Development
Regulations "prior to the issuance of any permit for new construction, demolition,
alteration, rehabilitation, renovation, restoration, signage or other physical
modification of affecting any building, structure, improvement, landscape feature,
public interior or site individually designated" at the Fontainebleau Miami Beach
property, including the improvements proposed in connection with the Application.

During the 2026 regular Legislative Session, the Florida Legislature adopted, and
the Governor signed, House Bill 399 ("HB 399"). In pertinent part, HB 399 creates
section 163.31803, Florida Statutes, entitled "Large destination resorts." Section 163.31803 requires, among other things, local governments to administratively approve certain applications for special exceptions or variances submitted by a
large destination resort, which is defined as "a public lodging establishment ...
