A variance to waive 1’-0” of the minimum required front setback of 10’-0” for a pool, in order to construct the pool retaining walls at 9’-0” from the front property line facing North Michigan Avenue. 3. A variance to waive 1’-3” of the minimum required interior side setback of 7’-6” for a pool deck, in order to construct the pool deck at 6’-3” from the side property line. 4. A variance to exceed by 1’-0” the maximum height of 5’-0” for a fence facing the right-of way in order to construct a wooden fence along the front facing North Michigan Avenue and side property lines up to a height of 6’-0” as measured from grade. A variance to waive 28.49 feet of the minimum required 300 foot separation between a business that sells alcoholic beverages for both on premises and off premises consumption and a place of worship, Saint Francis de Sales Catholic Church, in order to sell beer, wine and liquor for off-site and on-site consumption at a distance of 271.51 feet from the church. Approved –Goldberg/Baron 7-0. 3. File No. 3780 AML Investment IX, LLC. 825 East Dilido Drive The applicant is requesting the following variance in order to construct a pool and deck in the rear yard of the new single family home: 1. A variance to exceed by 1.28’ the maximum permitted elevation height of 7.72’ NGVD within required yards in order to construct portions of the pool retaining walls and pool deck up to 9.00’ NGVD. Approved –Goldberg/Baron 7-0. 4. File No. 3781 AML Investment IX, LLC. 835 East Dilido Drive The applicant is requesting the following variance in order to construct a pool and deck in the rear yard of the new single family home: 1. A variance to exceed by 1.77’ the maximum permitted elevation height of 7.23’ NGVD within required yards in order to construct portions of the pool retaining walls and pool deck up to 9.00’ NGVD. Any of the above items may be continued to another meeting date and, under such circumstances, further advertised legal notice may not be provided.
