Motion: Stolar/Kruszewski. Vote 6-0 (Appel absent). Board asked questions and made some
comments, but ran out of time. Schedule a special Planning Board workshop with the community in
February.

Items for Continuance/Withdrawal
File No. 1912. Entertainment in Sidewalk Café Permit Areas. An Ordinance of the
Mayor and City Commission of the City of Miami Beach, Florida Amending the Code of
the City of Miami Beach, by Amending Chapter 82, Public Property, Article IV, “Uses In
Public Rights-Of-Way,” Division 5, Sidewalk Cafes, Subdivision II, “Permit,” Section 82-
385, by providing Minimum Standards, Criteria, and Conditions for Entertainment in
Sidewalk Café Permit Areas on Ocean Drive between 8th And 13th Streets, and by
amending Chapter 142, “Zoning Districts And Regulations,” Article V, “Specialized Use
Regulations,” Division 6, “Entertainment Establishments,” Section 142-1361,
“Definitions,” to amend the definition of Outdoor Entertainment to include such Sidewalk
Café Areas on Ocean Drive, Providing for Repealer, Severability, Codification and an
Effective Date.
Motion: Stolar/Veitia. Vote: 6-0 (Appel absent). Continue to the March meeting.
Progress Report
File No. 1840 - 2301 Collins Avenue (a/k/a 2377 Collins Avenue), Gansevoort Hotel.
Motion: Kuperman/Weisburd. Vote: 6-1 (Stolar against). Come back with a Progress Report
strictly for noise in 60 days. Staff to inform the board where complaints are coming from.

File No. 1724 – 1437-39 Washington Avenue - The applicant, South Beach Restaurant
Authority, LLC, is requesting a Modification to a Conditional Use Permit as the new operator
of a restaurant on the first level of the property.

Motion: Fryd/Stolar. Vote 7-0. Approve as per staff recommendations with amendments.
File No. 1904 – 4358 North Bay Road - The applicant, Wilson Rodriguez, is requesting a lot
split/subdivision of land of one buildable parcel consisting of two platted lots, to be divided
into two buildable parcels.
Motion: Weisburd/Fryd. Vote 7-0. Approve as per staff recommendations with amendments.
File No. 1903 - 1826 Collins Avenue - The applicant, IC, LLC, is requesting a Conditional
Use approval for a main use robotic parking system garage operating 24 hours a day, seven
days a week, inclusive of a 240-seat accessory use restaurant located within the structure
and partly on the rooftop.
Motion: Stolar/Veitia. Vote 7-0. Approve as per staff recommendations with amendments.
File No. 1914. Absences and Recusals. An Ordinance of the Mayor and City Commission
of the City of Miami Beach, Florida, amending the Land Development Regulations of the City
Code to harmonize the permitted number of Absences and Recusals for Land Use Board
members, by amending Chapter 118, Administrative and Review Procedures, Article II,
Boards, Division 2, Planning Board, Section 118-52, Meetings and Procedures; Division 3,
Design Review Board, Section 118-74, Removal; Division 4, Historic Preservation Board,
Section 118-105, Removal; Division 5, Board Of Adjustment, Section 118-133, Removal,
Providing For Repealer; Codification; Severability And An Effective Date.
Motion: Fryd/Kuperman. Vote 7-0. Approve as per staff recommendations.
New Applications
File No. 1908. 7902 Carlyle Avenue - The applicant, Tree of Knowledge Learning
Academy, is requesting a Conditional Use Permit to operate a charter school for homebound
and special educational needs students in grades K-6 as a lessee in an existing educational
facility.
Motion: Fryd/Kuperman. Vote 7-0. Approve as per staff recommendations.
File No. 1907. 1145 North Biscayne Point Road - The applicant, Samuel Bejar, is
requesting a Conditional Use Permit for the installation of a boat dock and boat lift extending
a total of 48 linear feet from the bulkhead.
Motion: Fryd/Kuperman. Vote 7-0. Approve as per staff recommendations.
File No. 1819. 997 – 1021 Biarritz Drive - The applicant, Le Petit Papillon Montessori
School is requesting a modification to a Conditional Use Permit to increase the capacity from
180 students to 220 – 250 students.
Motion: Fryd/Kuperman. Vote 7-0. Approve as per staff recommendations with amendments.
File No. 1909. Temporary parking lots – exception to the 10 year limit. An Ordinance of
the Mayor and City Commission of the City of Miami Beach, Florida, amending the Land
Development Regulations of the Code of the City Of Miami Beach, by amending Chapter
130, "Off Street Parking", Article III, "Design Standards", by amending Section 130-70(7), to
allow for additional extensions of time for Temporary Parking Lots on Alton Road between
5th Street and Lincoln Road; Providing for Repealer, Severability, Codification and an
Effective Date.

Motion: Stolar/Fryd. Vote 7-0. Recommend approval to City Commission.
Motion: Kruszewski/Kuperman. Vote 7-0. Staff to come back with a citywide ordinance.
File No. 1910. Accessory Bars and Restaurants in RPS Districts. An Ordinance of the
Mayor and City Commission of the City of Miami Beach, Florida, amending the Code of the
City of Miami Beach, by amending Chapter 142, “Zoning Districts and Regulations,” Article II,
“District Regulations”, Division 18, “PS Performance Standard District,” Section 142-693
“Permitted Uses”, by restricting the size of bars and restaurants as accessory use to a main
permitted use in the R-PS1, R-PS2, R-PS3 and R-PS4 Zoning Districts; Providing for
Repealer, Severability, Codification and an Effective Date.
Motion: Appel/Kuperman. Vote 7-0. Recommend approval to City Commission with amendments.
File No. 1911. Application requirement for appointment to a Land Use Board. An
Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida Amending
Chapter 118 of the City Code of the City of Miami Beach, entitled “Administration and
Review Procedures,” Article II, “Boards,” Division 1 “Generally,” by creating a new Section
118-32, “Application Requirement for Land Use Boards,” to require the filing of an
application for membership on any of the four land use boards not less than ten days before
appointment; Providing for Waiver by the City Commission; and Providing for Repealer,
Severability, Codification and an Effective Date.
Motion: Veitia/Weisburd. Vote 7-0. Approve.
