HomeMy WebLinkAboutPB 200309301 of 4 CITY OF MIAMI BEACH Planning Department PLANNING BOARD AFTER ACTION REPORT FOR MEETING HELD SEPTEMBER 30, 2003 Note: The Board requested that future meetings start one half hour earlier – at 2:30 p.m. – to allow Board members to discuss relevant planning issues. The Board also requested that Planning staff bring up during this discussion period, macro issues, problems or concerns that may come up. Issues for future discussion: · Temporary parking lot provisions in the Code. · Restaurants and clubs (scheduled for discussion at the October meeting) · Utilization of city streets in a bi-directional manner should it be necessary at peak hours. I. Items for Withdrawal/continuance 1. File No. 1630 – Golf Course Fence Ordinance. An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Miami Beach City Code, Chapter 142, “Zoning Districts and Regulations,” Article II, “District Regulations,” Division 8, “GC Golf Course District, ” Section 142 -395, “Development Regulations,” to revise the fence and landscaping restrictions applicable to private golf courses, and Chapter 142, Article IV, “Supplementary District Regulations,” Division 4, “Supplementary Yard Regulations,” Section 142-1132, “Allowable Encroachments,” Subsections (h), “Fences, Walls, And Gates,” And (i), “Hedges,” to revise the fence and landscaping restrictions applicable to public and private golf courses, and abutting properties, Providing For Codification, Repealer, Severability, And An Effective Date. Continued to 10/28/03 · Discussion - File No. 1614 - Alcohol & Nudity – An Ordinance Amending Chapter 6, “Alcoholic Beverages,” Of The Code Of The City Of Miami Beach, Florida, By Amending Sections 6-40 And 6-41 “Total Nudity And Sexual Conduct Prohi bited,” And “Provisions Pertaining To Establishments Permitting Partial Or Total Nudity,” To Allow Establishments Licensed As Alcoholic Beverage Establishments To Offer Partial And Total Nude Adult Entertainment; Providing For Codification, Repealer, Sever ability, And An Effective Date. Continued to 10/28/03 2 of 4 III. Old Business · Planning Board by-laws – adoption of proposed amendments Continued to 10/28/03 · Discussion - File No. 1626. An Ordinance of the Mayor and City Commission of the City of Miami Beach amending Division 7. CCC Civic and Convention Center District of the Land Development Regulations of the City Code in order to allow waivers of development regulations by a five-sevenths vote of the city commission for developments pertaining to governmental owned or leased buildings, uses and sites which are wholly used by, open and accessible to the general public, or used by not -for-profit, educational, or cultural organizations, or for convention center hotels, or convention center hotel accessory garages, or city utilized parking lots, provided they are continually used for such purposes; and to amend the public notice requirements for such waivers. Providing for Codification, Repealer, Severability and Effective Date. Motion: Recommend the ame ndment to Section 142-368 to grant to the City Commission the power by a 5/7ths vote solely to waive solely for the New World Symphony parking requirements that otherwise would be applicable in the Land Development Regulations, only so long as the City Commission simultaneously commits to provide the spaces that would otherwise be required, in a new parking facility within 1200 feet. The Board also stated that they feel very strongly that no other aspect of the land development regulations should be modified until there is a fully designed project presented. II. New Business · Free Trade Area of the Americas (FTAA) will be having their conference here November 17 – 21, 2003. The Administration and the Police Department will be making a presentation on the FTAA to every board and committee in the City. The presentation will be made at the October 28, 2003 meeting. · Discussion – Planning Board meetings for the remainder of 2003. Discussed – no foreseeable conflicts for the two remaining meetings. · Restaurants and clubs. To be discussed at the October 28, 2003 meeting. IV. Public Hearings A. Progress Reports 1. File No. 1556 - Loving Care Residence – 6891 Bay Drive The owner had called staff that he was unable to travel from Argentina at this time. Message conveyed to the Board, which requested that he must be present at the October meeting. 3 of 4 2. File No. 1481 – Mynt Lounge -Neighborhood Impact Establishment – 1921 Collins Avenue A v erbal report was given to the Board regarding the concern that the operator is not c ontrolling crowds and the crowds are impeding pedestrian traffic on the sidewalk. The operator submitted a proposed plan to control crowds on the sidewalks. The Board instructed them to work it out with staff. B. Previously Continued Items 2. File No. 1620. The applicant, 4360 Collins, LLC is requesting an amendment to the Land Development Regulations of the City Code in order to allow apartment buildings in an RM-2 zoning district that faces an RM-3 zoning district to have commercial, retail or restaurant uses located in ground floor spaces with direct access to the street. Continued to the October meeting. 3. File No. 1611 - Fences. An Ordinance of The Mayor and City Commission of The City of Miami Beach, Florida Amending the Land Development Regulations of the Code of the City of Miami Beach, by Amending Chapter 142, "Zoning Districts And Regulations," Division 4, "Allowable Encroachments", by Amending Section 142- 1132 to Establish Revised Standards for the Installation of Fences in Residential Districts ; Providing For Repealer, Codification, Severability and an Effective Date. Recommended for approval by the City Commission. C. New Applications 1. File No. 1610 - Aqua docks – 250 West 63rd Street. The applicant, 63rd Street Associates , Ltd., is requesting Conditional Use approval in order to construct boat docks exceeding a projection of 40 feet from the seawall. Continued to the October meeting for lack of quorum, as one Board member declared a conflict. 3. File No. 1631 - 4144 Chase Avenue - Temple Beth Sholom . The applicant, Temple Beth Sholom, is requesting Conditional Use approval for a religious institution with educational facilities due to a proposed expansion of the existing facilities. Approved. 4. File No. 1632 – Ordinance . An Ordinance of the Mayor and City Commission of the City of Miami Beach Amending the Land Development Regulations of the City Code, by amending Chapter 142, “Zoning Districts and Regulations,”; Division 13, “MXE, Mixed Use Entertainment District,” Section 142-542, “Conditional Uses,” to include Public And Private Cultural Institutions as a Conditional Use in this zoning district; Providing f or Codification, Repealer, Severability and Effective Date. 4 of 4 Recommended approval by the City Commission .
