Centorino, Inspector General Page 1 of 15 TO: Honorable Mayor and Members of the City Commission FROM: Joseph Centorino, Inspector General DATE: July 20, 2026 PROJECT: Investigation of Unauthorized Outside Employment and Misuse of City Resources by City Employee OIG No.: 26-14 EXECUTIVE SUMMARY The Miami Beach Office of the Inspector General (OIG) has concluded its investigation into City employee Karla Cruz’s compliance with the City’s Outside Employment (OE) requirements, Miami‑Dade County Ethics Code, and the City’s IT use policies. The investigation substantiated that Cruz, a full-time Permit Clerk I in the Building Department, engaged in outside employment, including acting as the licensed qualifying agent for her family business, Mitch Builders, LLC, performing paid work for HB Construction Group LLC, and working as an active real estate professional, all without properly obtaining the necessary City approvals or submitting the required annual Miami‑Dade County Outside Employment Statements for the 2024 and 2025 filing periods. During an interview with the OIG, Cruz stated that she did not believe she was required to submit any OE documentation because of a June 17, 2024, email from the City Clerk’s Office. That email informed her that Permit Clerks were not required to file a Source of Income Statement, which Cruz incorrectly interpreted as a waiver of all OE obligations. However, the Clerk’s email applied solely to the County’s financial disclosure requirement for the 2023 reporting year and did not exempt her from the City’s OE requirements, including the OE Request Form or the annual county OE statement. Cruz also indicated that she was unaware that her real estate activity qualified as outside employment. Only after being informed by the Building Department leadership and the OIG did she submit the required OE forms in April 2026. After being informed by the OIG on May 19, 2026, Karla Cruz submitted an after-the-fact Outside Employment Statement to the City Clerk. The investigation also substantiated that Cruz used her City email account for personal business communications, including construction, property issues, insurance matters, and real estate transactions. Although Cruz initially denied these activities, she later acknowledged using her City email after the OIG presented evidence from emails documenting such communications from 2024 through 2026. This is the ninth OIG report highlighting violations of the City’s Outside Employment requirements and provisions of the Miami-Dade County Ethics Code regarding Outside Employment. Repeated violations involving separate employees across nine investigations reveal persistent systemic issues involving employee understanding of OE requirements, departmental communication regarding them, and enforcement of OE rules. Previous OIG recommendations, few of which have been implemented, have included adoption by the City of a comprehensive policy that clearly Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 2 of 15 defines what outside employment is and the process required for authorization to engage in such employment. The OIG has also recommended standardized outside employment (OE) training, consistent routing controls within HR and other City departments, improved verification processes, and clearer interdepartmental communication. Despite these efforts, this report shows that significant problems persist, including inconsistent communication of OE obligations, a lack of proactive compliance checks, and ongoing employee confusion about both City and County requirements. The nine Outside Employment-related reports issued by the OIG highlight the City’s ongoing vulnerabilities in this area and stress the need for stronger systems, clearer guidance, and consistent enforcement to ensure full compliance. This report reaffirms previous OIG recommendations and suggests additional corrective measures. These recommendations aim to fill process gaps and reduce the risk of further violations by City personnel related to Outside Employment. The OIG appreciates that, following the issuance of the draft of this report, HR Director Marla Alpizar proactively distributed multiple citywide emails outlining Outside Employment requirements before the upcoming July 1, 2026, deadline. This effort should significantly increase employee awareness and help improve compliance with filing responsibilities. Karla Cruz provided a voluntary sworn statement during this investigation. The OIG appreciates the cooperation of the City Clerk's Office, Information Technology, Human Resources, and the Building Department throughout this process. The OIG's investigation resulted in submitting a formal ethics complaint to the Miami-Dade Commission on Ethics and Public Trust (COE), pursuant to Miami Beach Code Section 2-256(d)(8)(b), due to a possible violation of the Miami-Dade County Conflict of Interest and Code of Ethics Ordinance Section 2-11.1(g), entitled “Exploitation of Official Position.” Further action on that complaint is pending at the COE as of the date of this report. OIG AUTHORITY Section 2-256 of the Code of Miami Beach provides that the City of Miami Beach Office of Inspector General is created as an independent body to perform investigations, audits, reviews, and oversight of municipal matters, including city contracts, programs, projects, and expenditures, in order to identify efficiencies and to detect and prevent fraud, waste, mismanagement, misconduct, and abuse of power. That Code section provides that the organization and administration of the office shall be sufficiently independent to assure that no interference or external influence adversely affects the independence and objectivity of the Inspector General. The Code also provides that the OIG has the power to require reports from the City Manager, City departments, City agencies, boards, and committees, and City officers and employees, regarding any matter within the jurisdiction of the Inspector General, as well as the power to subpoena witnesses, administer oaths, and require the production of records regarding any matter within the jurisdiction of the office. INVESTIGATION Background The OIG’s investigation began with a complaint referred to it by the Miami-Dade County OIG, alleging that Mitch Builders LLC failed to pay its subcontractors while Karla Cruz, a full-time Permit Clerk I in the Building Department, served as the company's Certified Contractor and Qualifier. Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 3 of 15 The Miami Beach OIG’s investigation examined Cruz’s adherence to the City’s Outside Employment requirements. The investigation substantiated that Karla Cruz failed to comply with HR.15.01, Outside Employment Requirement, and Citywide Procedure IT.21.01, Use of City’s E-Mail, Internet, Computer Systems and Software Access, while conducting unapproved outside employment and using City time and resources for personal business. These actions appear to have violated provisions of the Miami-Dade Conflict of Interest and Code of Ethics. The OIG’s investigation involved reviewing extensive documentation, including, but not limited to, City Administrative Orders, procedures, personnel records, emails, document downloads, and scanned files. Additionally, OIG Investigator Dylan Hughes examined open-source data related to Karla Cruz and obtained records from the Florida Department of State, Division of Corporations, the Florida Department of Revenue, the Florida Department of Business and Professional Regulation, Miami-Dade County, the City of Coral Gables, and the City of Hollywood. Karla Cruz provided a voluntary sworn statement during the investigation. Karla Cruz has worked for the City of Miami Beach Building Department as a Permit I Clerk since February 26, 2024. She was initially assigned to the Permit Intake unit, where her duties included reviewing permit application packages, verifying ownership and contractor information, ensuring affidavits and supporting documents were complete, and beginning the routing of plans for departmental review. Around May 2025, Cruz was transferred to the Building Department Call Center, where she now manages permit-related inquiries, reviews application statuses, identifies intake errors, and forwards issues to supervisors for correction. She explained that her work remains closely related to permitting and involves communicating with applicants about deficiencies or clarification needs. During her interview, Cruz identified her current supervisors as Nancy Gonzalez, Joana Tormo, and Leonor Hernandez, and stated that her previous supervisors in Permit Intake were Christina Pierre and RaShonda Blatch. Cruz’s Business, Professional Licenses, and County Business Tax Receipts A review of online records shows that Mitch Builders LLC was established on January 23, 2018, when it filed its Electronic Articles of Organization with the Florida Department of State, Division of Corporations. Karla Cruz is listed as both the Manager and Registered Agent of the Corporation. Corporate records confirm that the company has remained active since its founding, as indicated by its 2025 annual report filed on April 29, 2025. Records from the Florida Department of Business and Professional Regulation (DBPR) verify that Cruz is the qualifying agent for Mitch Builders LLC and show she holds three active Florida contractor licenses: Certified General Contractor, Certified Residential Contractor, and Certified Roofing Contractor. She is also the qualifying agent for HB Construction Group LLC and possesses an active Certified General Contractor license. In addition, DBPR records reveal that Cruz also holds an active Florida Real Estate Broker Sales Associate license. A review of Miami-Dade County's Local Business Tax Receipts confirmed that Mitch Builders LLC also holds valid County tax receipts for the following contractor categories: General Building Contractor, Specialty Building Contractor, and Sub-Building Contractor. These tax receipts appear in consecutive annual filings from at least 2023 through 2026, demonstrating that the company has maintained County business tax receipts, qualifying it to do business in the County for at least the past four years. All receipts list Karla Cruz as the qualifier for Mitch Builders LLC. Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 4 of 15 Outside Employment The City of Miami Beach Administrative Order HR.15.01, Outside Employment Requirement, issued in May 2021, mandates that all City employees in departments reporting to the City Manager submit the Request for Approval of Outside Employment and the Outside Employment Statement forms before starting any outside work. (Exhibit 1) The approval request must be submitted prior to engaging in outside employment, and approval must be renewed annually by July 1. City employees are required to submit the fully approved Request for Approval to the Human Resources Department. The Outside Employment Statement must be filed with the City Clerk by July 1 each year. The Administrative Order provides links to both required forms. The Building Department Standard Operating Procedures (SOP) on Outside Employment, updated on December 18, 2024, states that all outside employment must comply with the Citywide Administrative Procedure. The SOP essentially mirrors HR 15.01 and includes provisions allowing employees to work as licensed contractors but not within the City of Miami Beach, and to hold up to two outside jobs in addition to their City position (Exhibit 2). According to former Building Director Vince Seijas, staff have access to the Building Department’s SOPs. However, they are not provided with them. They are under revision due to changes in processes and regulations. He further stated that Inspectors and Plans Examiners are informed of the Outside Employment procedure during their interviews and again during the hiring process, given the licensure requirements for those positions. Both the City and the Building Department require an approved City Request for Outside Employment Form prior to engaging in any outside employment. An OIG inquiry to the Human Resources Department (HR) and the Clerk’s Office revealed that Karla Cruz did not submit any Requests for Outside Employment or Outside Employment Statements for 2024 or 2025. During her sworn statement with the OIG, when asked whether she had engaged in outside employment since joining the City, Karla Cruz admitted that she had, saying, “Yes.” She also stated that she had not submitted the required Outside Employment Request forms or Outside Employment Statements. She understood that she was responsible for reviewing and complying with all City policies and confirmed that she signed the New Hire Acknowledgment of Policies, Procedures, and Benefits on February 26, 2024. Cruz explained that her failure to file was based on an email response to a question she asked the City Clerk’s Office shortly after being hired, which she interpreted as indicating that, as a Permit Clerk I, she was, according to Cruz, “not required to submit it.” Cruz stated that she relied on the email because she was unfamiliar with government employment requirements, saying, “I’m not familiar [with government requirements]; it’s my first job.” The OIG found that on May 30, 2024, the Office of the City Clerk sent an email to Department and Division Directors and Assistant Directors with a memorandum outlining the requirements for Financial Disclosure in the first section and Outside Employment in the second section. The Outside Employment section required full-time City employees with outside work to submit both the Request for Approval of Outside Employment—needed before starting any outside work—and the annual Outside Employment Statement, due July 1 each year. The memorandum included the necessary forms and cited the relevant authorities under Section 2‑11.1 of the Miami‑Dade County Code. On June 14, 2024, then Building Department Assistant Director, Natasha Diaz, emailed all Building Department staff, stating, “These disclosures are required for all City Building Department employees. If you have not completed it yet and sent, please do.” (Exhibit 3) Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 5 of 15 Notwithstanding the information in the Clerk’s memorandum, Cruz contacted Alice Lavado in the Clerk’s Office by email on June 17, 2024, asking, “My employment with the City of Miami Beach began on February 26th, 2024. Do I need to complete the forms for 2023?” Ms. Lavado responded, “No, no, you do not. Permit Clerks do not need to file.” Although this response was later clarified to refer only to the 2023 reporting year, and Ms. Lavado explained that her intent was solely to convey that Cruz did not need to submit a 2023 Source of Income Statement, the wording could reasonably have been interpreted more broadly by Cruz, who claimed that she inferred from it that Permit Clerks were exempt regardless of the filing year. The OIG asked Karla Cruz if she had consulted with Natasha Diaz or any other staff in the Building Department about the outside employment requirements before emailing the Clerk’s Office, and whether she had discussed the Clerk’s Office response with anyone in the Building Department. She stated, I only followed the instructions at the bottom of the email: ‘If you have any questions, please do not hesitate to contact Alice Lavado at 305.673.7000, Ext. 26614 or by email at AliceLavado@miamibeachfl.gov.’ I did not ask Natasha nor anyone else regarding the email. Cruz neither sought guidance from nor informed any Building Department supervisor about her outside employment before March 2026. She acted on her own understanding that she was not required to file outside employment documentation based on her interpretation of the 2024 Clerk’s Office email. On June 14, 2025, Human Resources Director Marla Alpizar sent a Citywide email with the subject, “Reminder: Forms required for Outside Employment – due by July 1 each year.” (Exhibit 4) The email included the statement, **Please post for all employees. This email contains specific form routing instructions and replaces the prior Citywide email / posting. Please also post the two (2) forms described below and the Citywide Procedure on Outside Employment. ** After being shown the email during her sworn statement, Cruz stated, “So, I ignored that email in 2025 because of the email in 2024.” Referring to the Clerk’s Office email that she relied upon for not submitting the required requests and Outside Employment Statements in 2024 and 2025. Karla Cruz said she first realized she needed to file Outside Employment Requests after her March 2026 Building Inspector interview, when Building Department leadership asked her about outside employment. Cruz shared the explanation detailed above. They told her that her interpretation of the June 2024 Clerk’s Office email was incorrect. On March 25, 2026, after she forwarded her email exchange with the City Clerk’s Office to Building Department leadership, she was told by Deputy Director Narinder Singh that the Clerk’s response only applied to the 2023 Source of Income Statement and did not exempt her from filing the Request for Approval of Outside Employment, which all employees considering outside work must submit. Singh told her to submit the required form. Cruz initially submitted a single outside employment request form for Mitch Builders LLC. She provided a copy to the OIG, after which she was questioned about submitting a request for her independent real estate work. Cruz responded, “I believed that being an independent real estate agent is not considered employment, and I have not submitted any request for that Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 6 of 15 position.” She was informed by the OIG that independent real estate activity is expressly included within the County’s definition of outside employment, and, therefore, it required formal approval prior to performing such work. No definition of “Outside Employment” appears in the City’s Outside Employment Administrative Order, Building Department SOP, or the Request for Approval for Outside Employment Form. The County Outside Employment Statement Form instruction page states, Outside Employment means providing personal services, other than to Miami-Dade County, or to the respective municipality, that are compensated or traditionally compensated, including but not limited to, being an employee, an independent contractor, an agent, or by self-employment. On April 8, 2026, Ms. Cruz submitted two outside‑employment request forms: one for Mitch Builders LLC, and another for her independent real estate activities, along with the required Building Department SOP acknowledgments. She received copies of the fully approved requests dated April 27, 2026. The Mitch Builders, LLC approved request included restrictions: “Follow the attached SOP, absolutely no Contracting work in the City of Miami Beach,” and the Independent Contractor Real Estate Agent request included restrictions: “Follow the attached SOP, absolutely no Real Estate Sales work in the City of Miami Beach.” (Exhibit 5) After being informed by the OIG, Ms. Cruz later submitted an after‑the‑fact 2024 Outside Employment Statement, stamped received by the City Clerk on May 18, 2026, reflecting income for the 2024 tax year from HB Construction Group LLC, Florida Realty of Miami, and Mitch Builders, LLC (Exhibit 6). On May 21, 2026, a draft of this report was shared with the affected parties, including Karla Cruz, who had the opportunity to comment by July 7, 2026. According to the City’s Outside Employment Requirements, “Requests for approval of outside employment must be made on a yearly basis (even if for the same outside employment that had been previously approved).” After July 1, 2026, the OIG requested copies of the Requests for Outside Employment forms and the Outside Employment Statement from the Human Resources Department and the City Clerk, which are required to be submitted by July 1, 2026. The Clerk’s Office provided an Outside Employment Statement for the tax year ending in 2025, submitted by Karla Cruz and received by the Clerk’s Office on June 29, 2026. However, no Requests for Outside Employment forms were submitted to the Human Resources Department by Cruz for the period from July 1, 2026, to July 1, 2027. On July 17, 2026, the OIG sent an email to Ms. Cruz informing her of the policy requirement to renew the Request for Approval each year and inquired whether she was still involved in outside employment. Ms. Cruz responded, If that is the case, please find enclosed the Outside Employment Approval request for each Qualifying Agent for Mitch Builders and a Real Estate Sales Agent Florida Realty for the 2026–2027 period; please let me know if there is anything else I need to do. Karla Cruz submitted a Request for Approval for Outside Employment form for Mitch Builders LLC and another for Florida Realty of Miami, both electronically signed by Cruz on July 17, 2026 (Exhibit 7). The forms have not yet been reviewed and approved or denied by the necessary reviewers. Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 7 of 15 It is important to note that, between May 28, 2026, and July 1, 2026, following the issuance of the draft copy of this report, Human Resources Director Marla Alpizar sent seven citywide emails outlining the Outside Employment Requirements. The emails stated, “This approval must be renewed every year and must be filed with the City’s Human Resources Department by July 1, 2026 (Exhibit 8).” Contractor Activity An online Google search for Karla Cruz and Mitch Builders LLC shows ongoing business activity through 2024 and into 2025, indicating that the company remains active and involved in current construction projects. The data reveals that Mitch Builders LLC has frequently appeared as the applicant or contractor on projects approved and issued in late 2024 and throughout 2025. For example, permits for the property at residential properties in Hollywood, Florida, display a consistent pattern of recent work. A landscaping and tree removal permit was applied for on November 4, 2024, and issued on April 28, 2025. Additional construction permits for the same address were issued throughout 2025, including a dumpster enclosure permit issued on August 12, 2025, and a retaining wall permit issued on August 20, 2025. Search results also indicate that over the past several years, the company appears to have completed or is actively involved in new construction, roofing, and renovation projects, with summaries showing 25 permitted projects over the past three years, including at least four in 2024 and four in 2025. Karla Cruz admitted during her sworn statement that she continued contracting activities while working for the City of Miami Beach, stating, “I qualify my own company... I am the license [sic].” Records obtained by the OIG show that she was the billing and contact representative for Mitch Builders LLC, in Coral Gables, and that she processed a fee payment on September 25, 2024, for a residential project. She appeared as the contact on multiple Miami-Dade County applications, signing affidavits and submitting permit documents. Records also include a signed demolition plan with her electronic signature dated July 11, 2024, and contractor notes referencing Mitch Builders LLC in Hollywood, Florida. These records confirm that Cruz engaged in contractor activities, submitting applications, paying fees, and signing documents across multiple jurisdictions while employed full-time by Miami Beach. Cruz also confirmed that she has been with HB Construction Group LLC since 2023 and has received consistent payments from the company during her employment with the City. When asked if she had received payment from HB Construction, she replied, “Yes… they pay me the salary,” and noted that she received $2,000 after taxes each month. A review of Florida Department of Revenue records supports this, showing that she earned $7,050 per quarter from HB Construction Group LLC during 2023–2025, averaging about $2,350 per month. Cruz admitted that she never requested the City's approval to engage in this outside employment. Real Estate Activity The Google search results also show a professional profile for Cruz, identifying her as a real estate expert and broker with approximately 20 years of experience in South Florida. Cruz’s online real estate presence includes at least five major platforms where she maintains profiles or listings: Experience.com, Homelight.com, Homes.com, LinkedIn, and Zillow. Across these platforms, Cruz is consistently represented as a licensed real estate professional affiliated with South Florida Realty, Realty World Real Estate Center, and Florida Realty of Miami Corp. The data available across these sites indicates at least 55 real estate transactions, including representations on the Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 8 of 15 side of both buyers and sellers. It also shows that Cruz completed two transactions in 2024 and two in 2025. The extent of her online presence and recorded activity demonstrates sustained participation in real estate sales over multiple years, including during 2024–2025. During her sworn statement, Karla Cruz acknowledged that she holds an active Florida real estate license and engages in paid real estate work but stated she did not consider this activity outside employment. When informed that real estate sales are regarded as outside employment under City and County rules, she was surprised, saying, “Really?” She said she believed that her real estate activities didn’t count because she received income on a 1099 basis. Cruz admitted that she had not sought approval for this outside employment. A review of her City email showed that on July 15, 2024, she forwarded an email from her City email account to reception@floridarealtyofmiami.com, with a private lease agreement she had prepared attached. Karla Cruz was responsible for reviewing and adhering to City policies, including obtaining prior approval for outside employment and submitting annual Outside Employment Statements in accordance with Administrative Order HR.15.01, the Building Department SOP, and Miami-Dade County Code §2-11.1(k). These responsibilities were reinforced through the City’s onboarding process, which she acknowledged in writing, as well as through reminders issued during her employment with the City and her department. The OIG found that Cruz engaged in contractor activities and earned income from real estate work during 2024–2025 without obtaining the necessary approvals or submitting the required filings. Cruz stated that she believed her actions were permissible based on her interpretation of the June 2024 email, which, on its face, appeared to reinforce the notion that Permit Clerks were excused from filing requirements. However, she did not seek clarification from departmental leadership or verify whether the guidance applied beyond the 2023 reporting year. Instead, she continued her outside employment activities based on this assumption. While the Clerk’s response may have seemed to support her interpretation, Cruz remained responsible for confirming her obligations, and her failure to do so resulted in violations of the applicable outside employment provisions. Use of Time, Equipment, or Material Administrative Order HR.15.01, Outside Employment Requirement, does not address the use of City time, equipment, or materials; however, the Request for Approval of Outside Employment form states, City of Miami Beach employees may accept outside employment as long as the employment is not contrary, detrimental, or adverse to the interests of the City, and as long as no City time, equipment, or material is used. The Building Department SOP states, Employees may not engage in any outside employment-related duties and/or activities on City time, including phone calls, virtual meetings, emails, etc. Employees may not engage in any outside employment where City equipment, supplies, staff, facilities, or material is to be used. Citywide Procedure IT.21.01, Use of the City’s E-mail, Internet, Computer Systems, and Software, updated September 2018, outlines acceptable use of computer equipment, including but not Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 9 of 15 limited to computers, laptops, and network accounts that provide email, internet browsing, and remote access, all of which are owned by the City: • Section I states, “These resources are to be used for business purposes in serving the interests of the City...”; • Section VI (A)(2) of the procedure covers unacceptable internet usage, such as conducting personal business with City resources or computers; profit-making activities, including but not limited to operating a business; • Section VI (B)(4) addresses improper use of e-mail, which includes sending any material that violates City policies; • Section VI (C) discusses incidental and occasional personal use of the City’s computer system, which is prohibited for several reasons, including violating any provision of this procedure or any other City/departmental regulation, guideline, or policy; • Section XVII Non-Compliance/Penalties states, in part, “Violation of this procedure will result in disciplinary action… including, but not limited to, reprimand, suspension, and/or termination; and or Civil or criminal prosecution under applicable law(s).” The last page includes a user acknowledgment. As part of the City’s hiring process, each employee is provided with a copy of IT.21.01 to review. On February 26, 2024, Karla Cruz signed the user acknowledgment, which states, I have read and received a copy of the City of Miami Beach’s Use of City’s E- mail, Internet, Computer Systems and Software Access Policy. I agree to abide by it as consideration for continued employment by the City of Miami Beach. I understand that if I have questions regarding this policy, I will consult with my immediate supervisor or the IT Division Director. Cruz acknowledged during her statement that she signed the City’s user acknowledgment for the IT procedure, confirming she had read and received the policy at the time of hire. When questioned during her statement about the use of City equipment, Cruz initially claimed that she had never used City systems for any outside employment, asserting, “I’m not using the computer for my outside [business]… no, not at all.” However, when shown multiple emails related to her outside employment, she acknowledged that they were sent from her City email account and stated that they were “my mistake.” Between July 2024 and December 2025, Cruz sent emails related to her outside employment activities, which included the following, • July 15, 2024, Cruz forwarded an email from her City of Miami Beach email account to Florida Reception (reception@floridarealtyofmiami.com). The message she forwarded was from her personal Gmail account and concerned a completed residential lease transaction. In the body of the forwarded message, Cruz wrote: “Good morning: Please find enclosed Lease agreement executed, keys were released on Friday. I’ll send you our commission check with my husband today. The email included an attachment of a Disclosure of Interest form signed by Karla Cruz disclosing that she has 100% of the stock in the LLC listed above for the residential property. • April 1, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included images of a Miami-Dade County Notice of Acceptance (NOA) related to a Mitch Builders LLC project. • October 8, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included images of a Miami-Dade County Notice of Acceptance (NOA) related to a Mitch Builders LLC project. • October 15, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included attachments of 21 pages of Miami-Dade County Notice of Acceptance (NOA) documents related to a Mitch Builders LLC project. • October 21, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included an attachment titled “9.2023 Prescriptive Basesheet Attachment Table.pdf” related to a Mitch Builders LLC project. • November 12, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included an attachment titled “Violation.pdf" and another attachment titled “building-permit.pdf.” The permit application listed Mitch Builders as the contractor and Karla Cruz as the qualifier. The application was for the residential property owned by Cruz’s LLC. • December 9, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included two attachments of Miami-Dade County NOA documents related to a Mitch Builders LLC project. • On December 11, 2025, Cruz sent an email from her City of Miami Beach account to her personal Gmail. The email included an attachment of the Contact Information for a Permit Application form for Miami-Dade County. The form listed Karla Cruz as the contact for a Mitch Builders LLC project at her residential property, which is owned by her LLC. Docusign Envelope ID: 2C9E6284-49E9-8839-83D4-2A6D48809CD6 Page 11 of 15 The OIG’s review of email records, along with her sworn statement, confirmed that on twelve occasions between July 2024 and December 2025, Cruz used City time and City-issued technological resources in violation of City policies to conduct activities related to her outside employment and personal business interests. Although Cruz initially claimed she never used City systems for non-City purposes, she later admitted that these emails were sent from her City of Miami Beach email account. Cruz stated she neither informed her supervisor nor obtained permission to use her City email for personal business. CITY OUTSIDE EMPLOYMENT PROCESS This marks the OIG’s ninth report on outside employment and related issues with the City’s Outside Employment processes, which still lack clarity, consistency, and proper oversight. As seen in earlier reports, the City’s policy HR.15.01 does not define “Outside Employment,” causing ongoing confusion among employees and supervisors about which activities qualify and need approval. Cruz’s belief that her real estate work did not count as outside employment highlights this persistent problem. As noted earlier, the County’s Outside Employment Statement is the only document that specifies what is considered Outside Employment. The investigation revealed that the City’s OE policy and required outside employment forms are scattered across multiple locations within the Employee Portal. A review of the Portal found that the homepage under Administrative Orders, HR.15.01 indicates that the policy was updated in May 2025; however, the link opens to the May 2021 policy. The policy contains links to the Request for Approval of Outside Employment Form and the County Outside Employment Statement. The link to the request form opens to what appears to be the latest version, updated on April 2, 2024. At the top of the form, it states, City of Miami Beach employees may accept outside employment as long as the employment is not contrary, detrimental or adverse to the interests of the City, and as long as no City time, equipment, or material is used. (See Administrative Order HR.15.02) The referenced Administrative Order HR.15.02 is not listed on the portal's Administrative Order page. The form also does not define “Outside Employment.” The link to the County Outside Employment Statement opens to a form with a maximum disclosure tax year of 2023. However, the 2024 filing was due by July 1, 2025. The OIG previously recommended centralizing the policy and forms for outside employment for easier employee access; however, this has not been implemented. However, the May 2025 update mentioned on the Administrative Orders page and the 2024 Outside Employment Statement are not included in this location either. On June 14, 2025, HR Director Marla Alpizar sent a citywide email regarding Outside Employment Requirements. The email includes a link to Administrative Order HR.15.01, which is currently not working. It also contains a link to the Request form, updated on April 2, 2024, and a link to the Outside Employment Statement, which opens to the disclosure year 2024. Additionally, the email provides instructions for routing the form and the approval process through DocuSign. This process is not included in HR.15.01 or the Request Form. Overall, the City’s Outside Employment framework remains disjointed, inconsistently maintained, and difficult for employees to understand. Outdated links, multiple versions of forms, and the lack of a clear definition of “Outside Employment” continue to create unnecessary confusion and weaken oversight. These long-standing issues, despite previous OIG recommendations, underscore the need for a unified, accurate, and accessible OE process so employees understand their obligations and the City can enforce them effectively. FINDINGS AND RECOMMENDATIONS The following findings and recommendations detail corrective actions suggested to address the identified issues and improve the City’s oversight processes in the future. Finding 1: Failure to Obtain Required Outside Employment Approvals The OIG substantiated that Karla Cruz engaged in outside employment, including work for her own company, Mitch Builders LLC, employment with HB Construction Group LLC, and paid real estate activities, without submitting the required City Outside Employment Request Forms or Miami-Dade County Outside Employment Statements for the 2024–2025 filing years. Although Cruz stated her actions were based on her interpretation of a June 2024 Clerk’s Office email, she did not seek clarification from departmental leadership and continued her outside employment based on that assumption. She did not submit the required forms for July 1, 2025, to July 1, 2026, until April 2026, violating Administrative Order HR.15.01, the Building Department SOP, and Miami-Dade County Code §2‑11.1(k). Subsequent to the draft report issued by the OIG to the affected parties, the OIG found that Karla Cruz had not submitted the necessary Request for Approval for Outside Employment forms due by July 1, 2026, for the period from July 1, 2026, to July 1, 2027. Cruz completed these forms on July 17, 2026, after receiving an email from the OIG. Recommendations: Strengthen and Centralize the Outside Employment Policy Process: Consolidate all Outside Employment (OE) policies, procedures, guidance, and forms into a single, up‑to‑date location on the Employee Portal to reduce confusion and ensure employees can easily find accurate information. Update HR.15.01, Outside Employment Forms, and departmental SOPs to clearly define "Outside Employment" consistently, aligning with Miami-Dade County standards. Enhance Routing, Approval, and Verification Controls: Implement a standardized, enforceable routing system (e.g., DocuSign) for OE requests to ensure consistent departmental review and reliable tracking. Filer should DocuSign the fully approved requests and acknowledge restrictions. Integrate OE Policy Compliance into onboarding: Require new employees to acknowledge OE compliance during onboarding, similar to the process for the Information Technology policy. Finding 2: Use of City Time, Email, Equipment, or Materials Between July 2024 and December 2025, Cruz used City email and computer systems at least twelve times to conduct activities related to outside employment, including forwarding real‑estate documents, construction materials, zoning applications, and business correspondence. These actions violated Citywide Procedure IT.21.01, which prohibits the personal use of City resources. Recommendations: Strengthen enforcement against misuse of City resources: Clarify that using City time, email, or systems for outside employment is prohibited and may result in disciplinary action. Ensure guidance on prohibited uses is easily accessible and incorporated into OE policies, forms, and training. Standardize OE Related Training and Communication: Embed examples of prohibited resource usage into annual OE training and department level briefings to reinforce expectations and reduce policy violations. Finding 3: Systemic Weaknesses in the City’s Oversight Process This report documents the ninth time the OIG has identified deficiencies in the City's OE processes. Issues include outdated and incomplete procedures and forms, inconsistent record- keeping, a lack of formal notifications, and failure to acknowledge finalized approvals and restrictions. Despite repeated OIG recommendations, OE materials remain fragmented and inconsistently enforced. Recommendations: Centralize and Modernize OE Materials (Integrated with Finding 1 Recommendation): Create a unified OE repository with current policies, correct links, and clearly labeled filing requirements. Implement Mandatory OE Training (Integrated with Finding 1 Recommendation): Standardized annual OE training should directly address systemic confusion and ensure consistent understanding across departments. Enhance Routing and Verification Controls (Integrated with Finding 1 Recommendation): A uniformly applied DocuSign based system will reduce departmental inconsistencies. RESPONSES TO THE DRAFT REPORT Section 2-256(h) of the Code also provides that persons or entities who are the subject of a finding or recommendation of an OIG report be provided a copy of the report and shall have 30 working days to submit a written explanation or rebuttal of the findings or recommendations before the report is finalized. Timely submitted written responses shall be attached to the finalized report. On May 21, 2026, the OIG’s draft report on this matter was provided to the City Manager, Assistant City Manager, City Attorney, affected City entities, and individuals. The responses were due to the OIG by July 7, 2026. The OIG did not receive any responses to the draft report. CONCLUSION The OIG’s investigation substantiated that City employee Karla Cruz engaged in unauthorized outside employment, failed to obtain the required approvals, and used City resources for her private business activities. Cruz performed paid work for Mitch Builders LLC, HB Construction Group LLC, and her independent real estate ventures without submitting Requests for Outside Employment or the necessary Miami-Dade County Outside Employment Statements for filing years 2024 and 2025. Additionally, Cruz used City email and computer systems to send documents, conduct business communications, and manage matters related to her outside employment. These actions violated Administrative Order HR.15.01, Building Department SOPs, Citywide Procedure IT.21.01, and Miami-Dade County Code §2‑11.1(k). Although the OIG believes that Karla Cruz’s failure to file required forms may not have been intentional due to confusion created by the Clerk’s Office email, her exposure to City policies should have prevented that omission and should have avoided the filing violations detailed in this report. The OIG found that she neither sought clarification from department leadership nor followed up on the City's reminders, directives, or onboarding acknowledgments. Her noncompliance occurred during the first two years of her employment and might have continued if not for the complaint received by the OIG and the Building Department’s inquiry into outside employment during her March 2026 internal interview for a Building Inspector position. It is especially concerning that, after the OIG’s investigation into this matter and the subsequent seven citywide emails notifying all employees of the outside employment requirements before July 1, 2026, Karla Cruz failed to submit the required request forms for 2026-2027. Beyond the individual findings, this report highlights ongoing systemic weaknesses in the City’s Outside Employment processes that continue to cause confusion among employees and impede effective oversight. The recurring nature of these issues, now documented in nine OIG reports, demonstrates that corrective actions should extend beyond individual discipline and focus on structural reform. Centralized, current, and consistently enforced policies, along with mandatory training and standardized approval workflows, remain crucial to ensuring compliance. The findings in this report reaffirm the urgent need for comprehensive reform to ensure employees understand their obligations and that the City can enforce compliance effectively. Strengthening controls, modernizing procedures, and implementing consistent training are critical steps to protect City resources and uphold the public trust.
