HomeMy WebLinkAbout2004-25573 Reso RESOLUTION NO. 2004-25573 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FOLLOWING A DULY NOTICED PUBLIC HEARING, APPROVING THE TRANSFER OF FUNDS, IN THE AMOUNT OF $200,000, FROM THE MIAMI-DADE COUNTY SAFE NEIGHBORHOOD PARKS BOND FUND PROGRAM, SERIES 99, NORTH SHORE OPEN SPACE PARK PROJECT, TO THE SERIES 99 BEACHES AND BOARDWALK, NORTH BEACH RECREATIONAL CORRIDOR PROJECT; FURTHER LEVERAGING PREVIOUSLY APPROPRIATED CITY FUNDS, AS NEEDED; AND AUTHORIZING THE EXECUTION OF ALL THE NECESSARY DOCUMENTS WHEREAS, on November 5, 1996, the citizens of Miami-Dade County approved a $200 million Safe Neighborhoods Parks Bond issue to improve neighborhood and regional parks; and WHEREAS, the City applied for and was awarded funding, in the amount of $2.1 million, for the North Shore Open Space Park Project in this bond issue, and the City Commission authorized the application for bond funding on December 16, 1998 (Resolution No. 98-23009); and WHEREAS, the bond was issued in 1999, and the expiration date for use of this funding is November 2004; and WHEREAS, Phases I and 1\ of the North Shore Open Space Park Project have already been completed, and currently the City is completing the permitting process for the demolition of existing facilities and the construction of the new restroom and concession facilities, and the Project duration is estimated at six (6) months construction with a start date of late June 2004; and WHEREAS, expenses for the North Shore Open Space Project include construction costs, a 10% construction contingency and soft costs for management of the bidding and construction portions of the Project; and WHEREAS, it is estimated that funds will be remaining from this Project, in the amount of $200,000, and it is recommended that said remaining funds be transferred to the City's North Beach Recreational Corridor (NBRC) Project; and WHEREAS, the City was also awarded Safe Neighborhood Parks Bond funding for the NBRC, through the Series 99, Beaches and Boardwalk Project; and WHEREAS, the NBRC project is currently under construction and the project will create a multi-purpose public access corridor within a public easement, which traverses along the western edge of the sand dunes and will serve as a connection to the beaches, schools, parks and residential areas; and WHEREAS, funds from the Safe Neighborhood Park Bond will provide funding to construct the NBRC project and the funds will be utilized prior to the November 2004 deadline; and WHEREAS, both projects currently have Safe Neighborhood Parks Bond funding as part of their existing budget; and WHEREAS, pursuant to Miami-Dade County Safe Neighborhoods Parks Bond regulations, in order to transfer the above funding, Series 99, North Shore Open Space Park to Series 99, Beaches and BoardwalklNBRC, the City Commission is required by the Safe Neighborhood Parks Bond regulations to hold a public hearing for a change in scope/budget of the project, and once approved at public hearing, the proposed change will be presented to the County's Safe Neighborhood Parks Bond (SNPB) Oversight Committee for approval, and upon approval by the SNPB Oversight Committee, will be presented to the Miami-Dade County Board of County Commissioners for final approval; and WHEREAS, on April 28, 2004, the Administration presented the proposed changes to the Safe Neighborhood Parks Citizens' Oversight Committee Monitoring, Auditing & Administrative Rules Sub-Committee to obtain preliminary feedback from the Sub-Committee prior to commencing the process; and WHEREAS, the Sub-Committee unanimously approved a motion to recommend approval of the proposed scope/budget change to the full SNPB Oversight Committee at the June 2004 meeting; and WHEREAS, pursuant to Miami-Dade County Safe Neighborhoods Parks Bond regulations, the Mayor and City Commission held a public hearing on Wednesday, May 26, 2004, to consider the transfer of funds, in the amount of $200,000, from the North Shore Open Space Park Project to the Beaches and Boardwalks/NBRC Project. NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission, following a duly noticed public hearing, hereby approve the transfer of funds, in the amount of $200,000, from the Miami-Dade County Safe Neighborhood Parks Bond Fund Program, Series 99, North Shore Open Space Park Project, to the Series 99 Beaches and Boardwalk, North Beach Recreational Corridor Project; further leveraging previously appropriated City funds, as needed, and authorizing the execution of all the necessary documents. U Date: May 26, 2004 To: PUBLIC HEARING Subject: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE TRANSFER OF FUNDS IN THE AMOUNT OF $200,000 FROM THE APPROVED MIAMI-DADE COUNTY SAFE NEIGHBORHOOD PARKS BOND FUND PROGRAM, SERIES 99 NORTH SHORE OPEN SPACE PARK PROJECT TO THE SERIES 99 BEACHES AND BOARDWALK, NORTH BEACH RECREATIONAL CORRIDOR PROJECT; WHILE LEVERAGING PREVIOUSLY APPROPRIATED CITY FUNDS AS NEEDED; FURTHER APPROPRIATING ALL NECESSARY FUNDS AND AUTHORIZING THE EXECUTION OF ALL THE NECESSARY DOCUMENTS ADMINISTRATION RECOMMENDATION Adopt the Resolution, ANALYSIS On November 5, 1996, the Citizens of Miami-Dade County approved a $200 million bond issue to improve neighborhood and regional parks, The primary goal ofthe bond program is to promote neighborhood safety, reduce juvenile crime and improve quality of life, The City of Miami Beach applied for and was awarded funding in the amount of $2.1 million for North Shore Open Space Park Project in this bond issue. The City Commission authorized the application for grant funding on December 16, 1998 (Resolution No. 98-23009), The bond was issued in 1999, and the expiration date for use of this funding is November 2004. In anticipation of the November deadline for use of these funds, the City proposes transferring $200,000 from the North Shore Open Space Park Project to the City's North Beach Recreational Corridor Project. North Shore Open Space Park The estimated budget for this project is $2.4 million and the funding available to this project is $2.625 million, The scope of work for the project is as follows: . Phase I includes selective clearing of exotic vegetation; landscaping; irrigation and guard kiosk; . Phase II includes 15' wide paved pathway, entry wall, pavers, security lighting, vita course replacement /restoration; and park furnishings; . Phase III includes new pavilions/restrooms and concession stand, signage and tot lot; Commission Memorandum May 26, 2004 Page 2 . Phase IV and V were recommended for deletion, Phase IV originally included construction of maintenance facility and Phase V included construction of new nature center, The North Shore Open Space Project is moving forward. Phases I and II of the project have already been completed. The City is currently in Phase III and is completing the permitting process for the demolition of existing facilities and the construction of the new restroom and concession facilities. Project expenses include construction costs, a 10% construction contingency which will be added to the project budget, and soft costs for Program Management and CIP Management of the bidding and construction portions of the project. The project duration is estimated at six (6) months construction, with an anticipated construction start date of late June 2004. The overall budget estimate for Phase III is anticipated to be in excess of $1 million. There is currently $1.6 million remaining in Safe Neighborhood Parks Bond funds for this project. As such, there is an excess of Safe Neighborhood Parks Bond funding in Phase III of this project. Although Phase IV and V ofthe North Shore Open Space Park project are currently unfunded, and were recommended for deletion by the City Commission in 2002, the excess SNPB funds cannot be moved to these phases because the expiration date of the funds is November 2004, and Phase IV and V will not incur any costs prior to the expiration date. In addition, there are no otherfunds available to complete these two phases even if the SNPB funds were moved to Phases IV and V, As such, the $200,000 in excess funding is not needed for this project and there will be no shortfall offunding for Phase III of the North Shore Open Space Park project. It is therefore recommended that a portion of the remaining funding, in the amount of $200,000 be transferred to the North Beach Recreational Corridor Project, since this project has a shortfall in funding and will be able to spend the additional funds prior to the November deadline. North Beach Recreational Corridor The North Beach Recreational Corridor Project (NBRC), is also funded in part with SNPB funds. The North Beach Recreational Corridor Project will create a multi-purpose public access corridor, within a public easement, which traverses along the western edge (upland side) of the sand dunes. The NBRC will be located in the North Beach District of the City of Miami Beach, and will run immediately east of the oceanfront properties between 64th Street and 79th Street in the City, The NBRC will provide a continuous route throughout the entire North Beach District interconnecting and improving public assess to public parks, the beaches and other recreational, cultural, and educational facilities. The estimated cost of the project is $3,2 million, The scope of work for the project is as follows: . Phase 1 includes Allison Park-the design and permitting stage has been completed. It will take approximately 8 months to complete the construction of this phase. . Phase 2 & 3 include Ocean Terrace and Altos Del Mar- these two phases are currently in the design and permitting stages. Final permits should be awarded by June 2004. The bid process will immediately follow. . Phase 4 includes Bandshell Park - design and permitting will begin with the completion of the permitting and design portion of Phases 2 & 3, Commission Memorandum May 26, 2004 Page 3 Phases 3 & 4 are not currently fully funded. Additional funds from the Safe Neighborhoods Park Bond, Series '99 will provide funding to the North Beach Recreational Corridor project to secure a rope and post fence around the dunes and for additional permitting and design requirements for phases 1-3. It is anticipated that, with the transfer of $200,000 in additional funding, the NBRC project will utilize the funding prior to the November 2004 deadline. Both projects - the North Shore Open Space Park Project, and the North Beach Recreational Corridor Project/Series 99 Beaches and Boardwalks, currently have Safe Neighborhoods Parks Bond funding as part of their existing budget. Therefore, the funds would be transferred from one SNPB project to another, which Miami-Dade County has determined is an eligible contract amendment. Matching funds for these two projects have been appropriated previously. Exhibits A and B, attached to this memorandum provide conceptual drawings for these two projects. In order to complete this transfer of funds, the City Commission is required by the Safe Neighborhood Parks Bond regulations to hold a public hearing for a change in scope/budget of the project. Once approved at the public hearing, the proposed changes will be presented to the Safe Neighborhood Parks Bond (SNPB) Oversight Committee for approval, and upon approval by the SNPB Oversight Committee, the proposed changes will then be presented to the Miami-Dade County Board of County Commissioners for final approval. On April 28, 2004, the Administration presented the proposed changes to a Sub-Committee of the Safe Neighborhood Parks Bond Committee (Safe Neighborhood Parks Citizens' Oversight Committee Monitoring, Auditing & Administrative Rules Sub-Committee) to obtain preliminary feedback from the Sub-Committee, prior to commencing the process. The Sub-Committee unanimously approved a motion to recommend approval of the proposed changes to the full SNPB Oversight Committee at the June 2004 meeting. CONCLUSION The Administration is therefore requesting that the Mayor and City Commission approve this Resolution to transfer $200,000 from the Safe Neighborhood Parks Bond Series 99 North Shore Open Space Park Project to the Safe Neighborhood Parks Bond Series 99 Beaches and Boardwalk/North Beach Recreational Corridor Project.
