S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD); AND AUTHORIZING THE APPROPRIATION OF ALL FEDERAL FUNDS WHEN RECEIVED. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. BACKGROUND The One-Year Action Plan (or lithe Plan") is a federal requirement for all U.S. Department of Housing and Urban Development (HUD) designated entitlement cities. The City of Miami Beach is a HUD-designated entitlement city. As such, the City qualifies for federal funding under three of HUD's federal grant programs. These are the Community Development Block Grant (CDBG) program, the HOME Investment Partnerships (HOME) program, and the Emergency Shelter Grants (ESG) program. Funding to the City is determined through a formula that considers the City's demographics, and the income levels of its residents, based on the decennial census data. In 1990, the last census count, approximately 73% of the population in eight out of the eleven census tract areas of the City consisted of low and moderate income residents. AGENDA ITEM~ DATE 1-7- C)-9. COMMISSION MEMORANDUM JUL Y 7, 1999' PAGE 2 This year, the City anticipates it will receive a total of $4,342,000 in federal grants from HUD, as follows: $2,773,000 in Community Development Block Grant (CDBG) funds, $1,471,000 in HOME Investment Partnerships Program funds, and $98,000 in Emergency Shelter Grants (ESG) funds. The One- Year Action Plan is intended as an application for funds and a planning document, which describes the strategy to address the needs identified in the City's adopted Consolidated Plan. The Plan is an annual document that outlines the housing and community development activities that the City proposes to undertake with funds from HUD and provides a list of funding recommendations. The Plan also describes the City's citizen participation process, resources available to undertake housing and community development activities, and the projects to be funded for fiscal year 1999/2000. On February 3, 1999, a planning phase was initiated. On that date, the Administration made Requests For Proposals (RFPs) available to organizations, city departments, and the public, for funding requests under both the CDBG and ESG programs, with a proposal submission deadline of March 5, 1999. Staff reviewed each proposal received for statutory national objective compliance, regulatory eligibility, and feasibility. The Community Development Advisory Committee (CDAC) dedicated over 35 evening hours in nine publicly advertised meetings to review and analyze both CDBG and ESG proposals, set the priorities for the use of HOME Program funds, and develop their recommendations for funding. The Administration and the CDAC held the first of the two federally- mandated public hearings on March 23, 1999, This meeting was conducted to obtain citizen views on the needs within the community, and how the federal funds should be used to address them. In accordance with HUD regulations, a draft of the Plan was made available to the public for their review and comment for a 3D-day period commencing June 1, 1999 and ending June 30, 1999. Copies of the Plan were available at the City Clerk's Office, the three library branches on Miami Beach, and the City's Community/Economic Development Department. The availability of the draft Plan was advertised in English and Spanish language newspapers, and on the City's cable program. Finally, the Administration and members of the CDAC held the second federally-mandated public hearing on June 22, 1999, to obtain views of citizens about the draft Plan and the proposed funding recommendations. At the close of the Agenda deadline, only one written comment on the draft Plan had been received. (See Exhibit 2 - Action Plan, Citizen Comments). Action to adopt the One-Year Action Plan is requested at this meeting since the Commission recesses in August and does not reconvene until September, which is after the HUD submission deadline of August 16, 1999. ANALYSIS F or the past 25 years, the City has successfully utilized federal funds it receives from HUD to revitalize its neighborhoods. The City has leveraged private sector dollars and created jobs, improved public facilities, rehabilitated and preserved the housing stock, created home ownership opportunities, and provided public services through partnerships with social service providers. COMMISSION MEMORANDUM JULY 7,1999 PAGE J According to HUD guidelines, the City Manager is the designated agent for all the formula grants, and executes the Grant Applications, the Grant Agreements, and other applicable HUD documents. The Community/Economic Development Department coordinates the planning, preparation, submission and monitoring of the One- Year Action Plan. Staff is assigned to monitor the activities of the subrecipients by reviewing monthly financial status and narrative reports, and client profilt~ reports that detail the number, ethnicity and special needs populations being served. Besides the review of monthly reports, staff conducts on-site visits. The Administration worked with the CDAC and the community at large to prepare the One-Year Action Plan. During this process, the Administration received public input regarding areas of need, as they relate to housing and community development priorities for the City. The resulting Plan outlines a funding strategy to address meeting the identified needs in a prioritized manner. The proposed funding recommendations for the One- Year Action Plan for FY 1999/2000 are: CDBG - The majority of the CDBG program funds are recommended for the categories of public facilities and improvements, economic development, and rehabilitation and preservation. This is consistent with the City Commission's desire to improve the physical and economic environment in eligible neighborhoods. Again, as in previous years, the Administration is recommending that the public services category be funded to its maximum 15% of available funding, due to the overwhelming demand for these programs. HOME - HOME Investment Partnerships Program funds both nonprofit and for- profit affordable housing developers including the City's designated Community Housing Development Organization (CHDO), Miami Beach Community Development Corporation. HOME Program funds are utilized to upgrade the housing stock and to provide rental and home ownership opportunities on a citywide basis. E.S.Q - ESG program funds are recommended to provide emergency shelter and other essential supportive services for the homeless population of Miami Beach. The service providers for FY 1999/2000 are: Better Way of Miami, Inc., which provides services to adult homeless men with alcohol and/or substance abuse problems; Douglas Gardens Community Mental Health Center, which provides outreach counseling and transitional housing placement to the homeless; the Citizen Empowerment Center of the City of Miami Beach's Office of Children's Affairs which will help prevent homelessness by providing neighborhood-based emergency assistance, including rent/utility payments; and the Referral and Information Network (R.A.LN.), which works in partnership with the Miami Beach Community Development Corporation and provides emergency housing/rent vouchers for families facing immediate eviction. COMMISSION MEMORANDUM JULY 7, 1999 PAGE 4 The City received 65 proposals for the CDBG program, totaling $13,238,815, and five proposals for the ESG program, totaling $l86,254. As in previous years, the total amounts requested exceeded the dollar amount of funds available. This year, requests amounted to approximately six times the amount of funds available for the CDBG and ESG programs which for this year was $2,87l,000. After the proposal review process ended, the Administration's recommendation was made, and presented to the CDAC. This year, the Administration and CDAC have different funding recommendations. The One- Year Action Plan is submitted to the City Commission for approval with the funding recommendations of the Administration. The differences in the Public Services category arose as a result of the City Commission's directive of April 14, 1999, to fund $50,000 for the Food for Life Network program. These funds are being awarded to South Beach AIDS Project to serve as a pass-through to Food for Life Network for the provision of home-delivered meals to persons with AIDS. The differences in the non-public services categories were due primarily to different interpretations of priority needs for the City between the CDAC and the Administration. The Administration proposes to fund renovations: for ADA improvements, facade renovations and installation of hurricane shutters at Fire Station #2, that currently has limited funding resources to access for the necessary improvements. A detailed breakdown of the differences between CDAC's and the Administration's funding recommendations is presented below. All other Administration and CDAC funding recommendations are identical. One-Year Action Plan 1999-2000 Adopted 7/9/99 Page 14 City of Miami Beach MONITORING Monitoring of the various activities described in the One-Year Action Plan is a continuous and ongoing process. To ensure that planning will continuously reflect the successes or lessons learned from previous activities, the City monitors the effectiveness of its programs and initiatives and prepares reports for submission to the U.S. Department of Housing and Urban Development, as required by the program regulations. The City enters into binding subrecipient contract agreements with organizations receivin!~ federal funds. These agreements provide a basis for enforcing the goals and objectives of the Action Plan, the federal rules and regulations, and the time-frame to achieve the stated accomplishments. The agreements contain remedies in the event of a breach of the provisions by the subrecipient parties. The overriding goal of monitoring is to ensure that services are provided as prescribed in the subrecipient contract, and to identify deficiencies and remedial actions. The emphasis is on prevention, detection and correction of problems. Toward this end, all monthly and quarterly reports submitted by the subrecipients are thoroughly examined to ensure compliance. Furthermore, on-site technical assistance visits and monitoring visits are performed throughout the program year. Communication is the key to a good working relationship with the subrecipient agencies. Monitoring is an ongoing process involving continuous subrecipient communication and evaluation. The staff of the Community /Economic Development Department am experienced in subrecipient monitoring criteria and techniques. WRITTEN COMMENTS The following written comments were received during the 30-day comment period. One-Year Action Plan 1999-2000 Rev, 7/7/99 Appendix 3 I am Count L.F.M.deW. Ch. Rosen;hal e Meyerbeer W. Chudzikiewicz h. Chodkiewicz, '.. 1560 Washington Avenue, Miami Beach, Florida 33139, for myself and for the South Beach Civic Association. The Association since 1994 has been working as a voluntary . neighborhood group to primarily fight drug-related crime and social disorder. I have been involved with the issue of Community Development on Miami Beach on and off since 1972}' and my parents, grandparents, and greatgrandfather at various_times lived_her since World War I. 1'1y godmother and Cousine Nellie Hirsch married George Alexander Moore, Jr., a connection of the Thomas Collins family, and establishing a family connection between my family and' one of the Beach's founding families. I have been coming to the Beach since September, 1945, my late father since 1943, and my maternal ancestors, as noted, since the turn of the century. Because of these connections the Association asked me to give this statement at your Tuesday, June 22, 1999 Public Hearing ~ Firstly, we congradulate the Staff for producing such a professional Plan in light of the short-staffing. Our City officials are working long and hard for all of us. We hope Mr. Carl Hastings, who has left the staff for Public Works, and Mr. Harry Marvogenes, who has taken a position in San Jose~ California are as successful in those positions as they were here. , Secondl~~, in general we endorse the One Year Action Plan but with caveats as follows: 1 ). The $75,000 for the HIV Prevention woi1< for the South Beach AIDS Project seems questionable as we have well passed the point where people can say they don't know what causes AIDS. We endorse the food or meals component, but not the educational/prevention component on page 5. .. 2 ). The Unrdad, Inc. funding for Link of $27, 171 for employment developmennve believe is a nonsense, we saw with the Loews' Convention Hotel that Unidad is incapable :~r running an employment development program. This is throwing good money afterQad.:::.-: If someone can't do a job, you don't give them more money to repeat their failure. r-- This is on page 6. ~ r. .. ."" <S: ~~ .-0 o Page 2. 3). The wording of the Rehabilatid~ and Preservation item for the MBDC in the amount of $ 170,000 on page 6. should be more specific, is the $ 170.000 for thl~ ~our. if part isn't. the wordin2' should break this down. We endorse the item, but believe the exact details of the financial breakdowns should be clearer. 4). We have a continuin2' problem .with the Acquisition and Disposition fundings, such as on page 7, $80,000 (this item may be two), as well believe to be eli~ible YOU should bE~ a Miami Beach primarily resident for a minimum of five Years. Similiar provisions were to go into effect in 1978/1979/1980, and 1982 in HUD funded community development: programs as local oPtions. We firmly believe Miami Beach should do so. 5). As people interested in historic preservation and fair taxation we oppose one dime of any taxpayer money. Federal. State. County. or Municipal going into the ArtCenter South South Florida for many reasons:' (A). They made a "windfall" real estate profit on the Sender Building. (B). They didn't maintain the Sender Building, so it crumbled as it was being renovated by the purchasers, depriving the people of Miami Beach of a valuable historic landmark (C). Newspaper accounts appear to indicate not only are artists at the ArtCenter not local people, but apparently forebmers on or ori~inally on "six month tourist visas" from Ar~entina and other foreign countries. To use US taxpayers money intended to fi2'ht ,Qrovertv to subsidize forei~n middle class artists here on tourist visas. if true. is a dis2'race. Although the Miami Herald reporting on this issue may be incorrect, in light of objectio~s (A) and (B), this funding on page 8 should be withdrawn forthwith. 6). The last item that causes his "disquiet" is the continued funding of something called "Douglas Gardens Community Health Center", which is described depending on the meeting as part of the Jewish A!ted Home of similiar name, or, as an independent, free- standing entity before the City Commission. Frankly. the statements they. and specifically their employee Ol~a Gulik has made over ~ast three years about the homeless population from" 20th Street south to 14th Street. from Jefferson Avenue east to the Ocean we find incorrect. which is the most polite term we can use. , We have no faith in figures from or the programs of this group. We earnestly SU2'2'est the staff should step UP on si2'ht. un-announced monitorin2' of this g-roup's activities and look to see if another provider of their services can be used in future. The community of Miami Beach remains vibrant and vital because of the commitment of concerned residents, among others, who come forth with ideas and participation to make this a better place to live, We are grateful of these efforts, and count on that participation when planning for the community at large, We welcome your comments, and commend your efforts in the development of an informed community. As we approach the end of the planning phase for this year's funding, receiving opinions from within the community about where we should gear our funding decisions is useful. We thank you for your time and look forward to your comments on future developments, Cordially yours, Jorvvvwv A~(j Joanna Revelo Director, Community Development Division cc: Ms, Christina M.
