This agreement, between the Permittee and Contractor named herein and Miami-Dade
County DERM, is made for the purpose of accomplishing the work described herein as
further described by approved drawings.
1. Prooosed work. construction. or use:
Removal of the existing thirty (30) foot wide by (65) foot long, three-span
Cleveland Road Bridge and associated support structures.
Construction of a new forty-four (44) foot wide by sixty-five (65) foot long, single
span Cleveland Road Bridge.
All work shall be performed in accordance with the plans entitled "State of Florida
Department of Transportation Plans of Proposed Bridge Replacement"; prepared
by R.S. Waldeck, P.E.; signed and sealed on January 11, 1999; approved by this
Department, and in accordance with the conditions on sheets 2A through 2D.

SPECIFIC CONDITIONS
1. The pennittee is hereby advised that under Florida law, no person shall commence any
excavation, filling, construction, or other activity involving the use of sovereign or other
lands of the state, title to which is vested in the Board of Trustees of the Internal
Improvement Trust Fund or the Florida Department of Environmental Protection (FDEP),
until such person has received the required authorization for the proposed use from the
Board of Trustees or FDEP. If such work is done without consent, or if a person otherwise
damages state land or products of state land, the Board of Trustees may levy administrative
fmes of up to $10,000 per offense pursuant to the Florida Administrative Code.
2. The contractor and/or the pennittee shall notify DERM a minimum of forty-eight (48) hours
prior to the commencement of construction (305) 372-6575.
3. In order to minimize water quality impacts associated with the construction of the bridge, the
following measures shall be implemented and followed during all construction phases of this
project:
a. Turbidity controls (such as, but not limited to, hay bales, turbidity curtains, etc.) shall be
implemented during all phases of the construction to ensure compliance with Miami-Dade
County water quality standards as stipulated in Chapter 24-11 (3), of the Code of Miami-
Dade County. Said turbidity curtain shall completely enclose / surround all work areas.
Turbidity controls shall be employed and maintained in the most effective manner possible
to prevent turbidity from extending beyond the control mechanism in place. Failure to
deploy and maintain the turbidity curtain or other turbidity mechanism in the most effective
manner possible may result in the issuance of a Unifonn Civil Violation Notice (UCVN)
which carries a mandatory fme, and/or revocation of all or a portion of the perfonnance
bond, in addition to a requirement to correct the violation.
b. Turbidity may not exceed twenty-nine (29) Nephelometric Turbidity Units (NTU's) above
background beyond fifty (50) feet fonn the point of discharge. Turbidity levels shall be
monitored continuously when turbidity plumes are visible beyond a fifty (50) foot radius of .
the point of discharge. If the turbidity levels exceed twenty-nine (29) NTU's above
background beyond fifty (50) feet from the point of discharge, all construction shall be
halted and additional turbidity controls implemented. This project shall not be resumed
until the contractor has implemented additional turbidity control methods and has received
authorization from DERM to commence work. At DERM's discretion, additional turbidity
samples may be required and shall be collected in accordance with Section 24-1 1 (5)(c) or as
specified by DERM and the results sent directly to the DERM Project Manager on a weekly
basis.
c. In order to prevent water quality impacts associated with the project, appropriate erosion
controls shall be implemented during all phases of the work
4. The contractor shall take all necessary precautions to prevent construction debris from
falling into the water or adjacent wetlands. Any debris which does fall into the water and/or
wetlands shall be removed immediately.

5. All construction and demolition material / debris shall be disposed of properly and in
accordance with all federal, state and local regulations at an upland disposal facility.
6. A DERM Class II Permit is required for the construction, installation, and/or alteration of any
outfall or overflow system in, on, under or upon any water body of Miami-Dade County. The
contractor shall contact the Water Control Section of DERM at 372-6742 in order to obtain a
Class II Permit prior to the construction of any outfall or overflow system.
7. A DERM Class V Pennit is required for any dewatering of groundwater, surface waters or
water which has entered into an excavation. The contractor shall contact the Water Control
Section of DERM at 372-6742 in order to obtain a Class V Pennit prior to any dewatering
activity.
8. Since the Florida manatee occurs in the waters adjacent to the property, the permittee and
contractor shall take measures to protect manatees during and after the construction. Failure
to comply with any of the below listed measures may result in revocation of all or a portion of
the perfonnance bond. These measures shall include the following:
a. All construction personnel shall be notified in writing of the possible presence of manatees in
the area and the precautions that should be taken during the construction period. Copies of
these written notifications shall be sent to DERM.
b. All construction personnel shall be advised that there are civil and criminal penalties for
hanning, harassing or killing manatees, which are protected under the Marine Mammal
Protection Act of 1972, the Endangered Species Act of 1973, and the Florida Manatee
Sanctuary Act of 1978. The pennittee and contractor shall jointly be held responsible for
any manatee hanned, harassed or killed as a result of construction activities.
c. Turbidity curtains shall be made of a material in which manatees cannot become entangled.
Said curtains shall be properly secured, and shall be regularly monitored to avoid manatee
entrapment. Curtains shall not block manatee entry to or exit from essential habitat.
d. All turbidity curtains shall be removed by the contractor from tidal waters upon completion
of the construction.
e. All vessels associated with the project shall operate at "No Wake/ldle" speeds at all times
while in water adjacent to the project where the draft of the vessel provides less than a four
foot clearance from the bottom. All vessels will follow routes of deep water whenever
possible.
f. All in-water construction activities shall cease upon the siting of a manatee(s) within one,hundred (100) feet of the project area. Construction activities will not resume until the
manatee(s) has departed from the project area.
g. Any Collisions with and/or injury to a manatee shall be reported immediately to the
"Manatee Hotline" (1-8oo-DIAL-FMP) and to the U.S. Fish and Wildlife Service, Vero
Beach Office (407-562-3909), and to DERM (305-372-6863).

h. The contractor shall maintain a log detailing sightings, collisions, or injuries to manatees
should they occur during the contract period.
i. Following project completion, a report summarizing the above incidents and sightings shall
be submitted to the Florida Department of Environmental Protection (FDEP), Marine
Research Institute Office of Protected Species Research, 100 Eighth Avenue, Southeast, St.
Petersburg, Florida 33701-5095, to the U.S. Fish & Wildlife Service, 3100 University
Blvd. Jacksonville, Florida 32216, and to DERM within sixty (60) days of the project
completion.
j. Prior to commencement of construction each vessel involved in the construction shall display
in a prominent location, visible to the operator an 8 1/2" X 11" temporary placard reading,
"Manatee Habitat/ldle Speed in Construction Area". In the absence of a vessel, the placard
will be located prominently adjacent to the issued construction permit. A second temporary
81/2" X 11" placard reading, "Warning Manatee Area" will be posted in a location
prominently visible to water related construction crews. Temporary construction notices
will be removed by the permittee upon completion of construction.
9. In order to mitigate for the cumulative shading impacts of 649 square feet of seagrasses from
the construction of the new Cleveland and Daytonia Road bridges, the permittee shall make a
contribution in the amount of $11,168 to Biscayne National Park as described in the approved
mitigation plan (attachment A). This money shall be deposited in to the Biscayne
National Park general fund, earmarked specifically for the purchase and installation of
lighted buoys at Featherbed Shoals in Biscayne Bay. These buoys will demarcate the
sensitive seagrass beds at Featherbed Shoals day and night. A portion of this money
shall be used for a similar project to mitigate seagrass impacts caused by the
replacement of the Daytonia Road Bridge, the sister bridge of Cleveland Road Bridge.
10. Pursuant to Section 24-58.10 of the Miami-Dade County Code, the bridge structure authorized
by this permit shall be maintained by the permittee, his successors and assigns. If DERM
determines that the bridge is not maintained in such a manner that it becomes a hazard to the
public [or] creates an obstruction of flow, or prevent access for drainage purposes, or may
damage adjacent property, then the owner shall be required to perform any necessary remedial
work.
11. The permittee is advised that pursuant to section 24-27.1, Miami-Dade County Code, species
listed under Policy 81 of the Conservation Element of the Comprehensive Development Master
Plan may not be sold, propagated or planted. Additionally, if exotic, invasive vegetation is
present at the site, it shall be removed prior to development and/or construction and may not be
relocated, sold or transported off-site pursuant to the aforementioned Ordinance. Attached is a
list of landscape plants and controlled landscape plants (attachment B), the latter of which may
not be planted within 500 feet of a natural area. DERM encourages the permittee to review
Exhibit A for guidance regarding any proposed landscaping at, near or adjacent to the bridge.
12. Any deviation from the approved plans for this project shall be submitted in writing to, and
approved by DERM prior to the commencement of this project.
13. A copy of this permit must be kept on-site during all phases of this project.

14. The time allotted to complete the work for which this permit has been issued shall be limited to
the period stipulated on the permit unless the permittee requests an extension of time from the
Department in writing at least thirty (30) days prior to the date of permit expiration.
Applications for extensions of time which are not timely filed pursuant to Section 24-
58.9(B)(2), Code of Miami-Dade County will be returned to the applicant.

Purpose: To focus attention on:
1. The impacts exotic pest plants have on native bio-diversity in Florida ecosystems.
2. The impact of exotic pest plants on the integrity of native plant community functions.
3. Habitat losses due to exotic plant infestations.
4. The impacts of exotic plants on endangered species via habitat loss and alteration (e.g., Cape
Sable seaside sparrow).
5. The need to prevent such losses by comprehensive management for exotic pest plants.
6. The socioeconomic irnpacts of exotic pest plants (e.g.. increased wildfIres irMelaleuca).
7. Changes in the seriousness of different exotic pest plants over time.
8. The need to provide information that will help managers set priorities for management.
Definitions: Exotic-a non-indigenous species, or one introduced to this state, either purposefully or
accidentally. Anaturalized exotiQ. such as those listed here, has escaped into the wild where it
reproduces on its own either sexually or asexually Native-a species already occurring in Florida at the
tiJT1e of European contact (1500). lnvasive- a variable condition defIned by the category to which the
species is assigned.
