RESOLUTION NO. 99-23019
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE HOLD HARMLESS AGREEMENT
REQUIRED IN CONJUNCTION WITH THE CITY OF MIAMI
BEACH'S AFFIDAVIT OF OWNERSHIP TO OBTAIN A
CLASS I COASTAL CONSTRUCTION PERMIT FROM
MIAMI-DADE COUNTY FOR THE FLORIDA
DEPARTMENT OF TRANSPORTATION'S PROJECT TO
REPLACE THE MERIDIAN AVENUE BRIDGE OVER
COLLINS CANAL.
WHEREAS, the Meridian Avenue bridge over the Collins Canal is in the process of being
replaced by the Florida Department of Transportation (FDOT) as part of their bridge replacement
program; and
WHEREAS, the bridge replacement work requires a Class I Coastal Construction Permit
from Miami-Dade County and, as a prerequisite to obtaining said permit, an Affidavit of Ownership
and Hold Harmless Agreement are required to be executed by the City of Miami Beach as a holder
of an interest in the area where the work is to be performed.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk
are hereby authorized to execute the Hold Harmless Agreement required in conjunction with the City
of Miami Beach's Affidavit of Ownership to obtain a Class I Coastal Construction Permit from
Miami-Dade County for FDOT's replacement of the Meridian Avenue bridge over Collins Canal.

AFFIDAVIT OF OWNERSHIP
AND HOLD HARMLESS AGREEMENT

the City of Miami Beach, the undersigned authority, and hereby affirms as follows:
1, That the City of Miami Beach holds an interest in those areas designated and more fully
described as follows:
Meridian Avenue Bridge:
Commence at the intersection of the center lines of Meridian A venue and 19th Street, as shown in
AMENDED PLAT OF GOLF COURSE SUBDIVISION OF THE ALTON BEACH REALTY
COMPANY recorded in Plat Book 6, at Page 26, Public Records of Miami-Dade County, Florida;
thence run northerly, along the center line of Meridian Avenue for a distance of 249.16 feet to the
POINT OF BEGINNING of the tract ofland herein described; thence deflects to the left 119025'
46" for a distance of 40,19 feet to a point located on the west Right-of-Way of Meridian Avenue;
thence northerly, along the west Right-of-Way of Meridian Avenue for a distance of 10.50 feet to
a point located on the south Right-of-Way of Collins Canal; thence westerly, along the south Right-
of-Way of Collins Canal for a distance of 44.00 feet; thence deflects 900 to the right for a distance
of 43.19 feet to a point; thence run easterly, parallel to the center line of Collins Canal for a distance
of203.32 feet; thence deflects 900 to the right for a distance of 43.19 feet to a point located on the
south Right-of-Way of Collins Canal; thence westerly, along the south Right-of-Way of Collins
Canal for a distance of75.50 feet to a point located on the east Right-of-Way of Meridian Avenue,
as shown in Florida Department of Transportation project No 87099-3504; thence southerly, along
said east Right-of-Way of Meridian Avenue for a distance of 10,50 feet; thence deflects to the right

and being in Section 34, Township 53 South, Range 42 East, City of Miami Beach, Florida,
containing 10,881 square feet more or less, or 0.250 acres more or less. This description was
generated from examination ofthe abutting Record Plats and Florida Department of Transportation
Project No, 87099-3504,
2. That the above-referenced areas are the subject matter of the Application to be submitted by
the Florida Department of Transportation for a Class I Coastal Construction Permit under and
pursuant to Section 24-58 of the Code of Metropolitan Dade County to construct or engage in the
following activity:
Meridian A venue bridge replacement over the Collins Canal.
3, That your affiant hereby affirms the City of Miami Beach's interest in the above-noted areas
necessary for the work noted in Paragraph 2 above and, subject to the limitation set forth in Section
768.28, Florida Statutes, the City of Miami Beach hereby agrees to defend same and hold Miami-
Dade County harmless for any and all liability , claims and damages of any nature occurring, incurred
or arising as a result of the City of Miami Beach not having the above-stated interest in the
afore stated areas.

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
The Florida Department of Transportation (FDOT) will be replacing the Meridian Avenue bridge
as part oftheir bridge replacement program, All construction over water within the Bay area requires
a Class I Coastal Construction Permit issued by Miami-Dade County. As part of the permitting
process, Miami-Dade County requires a Hold Harmless Agreement from the City of Miami Beach,
as the holder of an interest in the area where the work is to be performed,
CONCLUSION:
The Mayor and City Commission should approve the Resolution authorizing the Mayor and City
Clerk, to execute the attached Affidavit of Ownership and Hold Harmless Agreement, required to
obtain a Class I Coastal Construction permit from Miami-Dade County for the construction of the
Meridian Avenue bridge over Collins Canal by the FDOT,
