A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, CALLING FOR A PUBLIC
HEARING TO CONSIDER A REQUEST FOR A REVOCABLE PERMIT
BY MR. ROBERT SWEDROE TO RETAIN A WROUGHT IRON FENCE
AND GATE, A "PRIVATE DRIVE" SIGN, A CIRCULAR CONCRETE
PAVER DRIVEWAY, IRRIGATED AND LIGHTED LANDSCAPING AND
A CONCRETE WALL ENCLOSED AREA AT THE STREET END OF 78TH
STREET, EAST OF ATLANTIC WAY, ADJACENT TO THE PERMITTEE'S
PROPERTY LOCATED AT 7747 ATLANTIC WAY.
WHEREAS, Mr. Robert Swedroe (Applicant), is the owner's representative for the
property located at 7747 Atlantic Way (Property); and
WHEREAS, the Applicant has requested a Revocable Permit to retain a wrought iron
fence and gate, a "Private Drive" sign, a circular concrete paver driveway, a concrete wall enclosed
area and irrigated and lighted landscaping at the street end of 78th Street, east of Atlantic Way,
adjacent to the above mentioned Property; and
WHEREAS, pursuant to Chapter 82, Article III, Division 2, Section 82-93 of the City of
Miami Beach City Code, the Mayor and City Commission are required to hold a public hearing
to consider the aforestated request.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to
consider a request for a Revocable Permit to retain a wrought iron fence and gate, a "Private Drive"
sign, a circular concrete paver driveway, a concrete wall enclosed area and irrigated and lighted
landscaping at the street end of 78th Street, east of Atlantic Way, is hereby called to be held before
the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700
Convention Center Drive, Miami Beach, Florida on February 3. 1999 beginning at 5 :00 p ,m,
and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the
said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties
will be heard.

ADMINISTRA TION RECOMMENDATION:
To adopt the Resolution setting a date and time for a public hearing.
BACKGROUND:
In 1994, an application for a revocable permit was filed by the property owners located at 7747
Atlantic Way, for the installation of a circular, concrete paver driveway, signage, irrigated and
lighted landscaping and a concrete wall enclosed area, at the streetend of 78th Street, within the
City's right-of-way.
On June 15, 1994, the City Commission passed Resolution 94-21204, scheduling a public hearing
on July 27, 1994. The request was subsequently withdrawn by the applicant and the public hearing
was never held.
The City has determined that a circular, concrete paver driveway has been constructed, and a
wrought iron fence erected across the 78th Street streetend, Subsequently, the City in a letter dated
October 23, 1998, requested the removal or permitting of these structures/improvements in the City's
right-of-way. This revocable permit application has been filed to bring the above stated
structureslimprovements into compliance,

ANAL YSIS:
The applicant has submitted a permit application, but has not completed all of the requirements
described under City Code Chapter 82, The following items still need to be submitted as part of the
permit application:
1, A title binder or attorney's title opinion,
2. A topographic survey showing existing conditions. (The only survey we have is a survey
dated May 3, 1988, submitted with the 1994 application.)
3. A drawing showing the proposed work in City right-of-way.
4, The proper application fee per Ordinance No, 95-2980 ( "After-the-fact"/ triple fee) and
mailing/advertising fees.
The Administration does not wish to delay this application further and the applicant has been asked
to complete these submittals prior to the scheduled public hearing.
The revocable permit application addresses a wrought iron fence and gate at the 78th Street
street end, a "Private Drive" sign, a circular concrete paved driveway, irrigated and lighted
landscaping and a concrete wall enclosed area covering approximately 180 square feet.
The City Commission is to schedule a public hearing, allowing fifteen day notice to the surrounding
property owners within 375 feet of the site.
CONCLUSION:
The City Commission should set a time and date for a public hearing to consider this application
request for a Revocable Permit.
