A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE OF AN
EMERGENCY AND ALLOWING THE POLICE ATHLETIC LEAGUE (pAL) TO UTILIZE
THE VACANT LOT LOCATED AT DADE BOULEVARD, BETWEEN PRAIRIE AVENUE
AND MERIDIAN AVENUE, FOR A FUND-RAISING EVENT TO PROVIDE
ADDITIONAL PARKING FOR THE 1999 MIAMI BEACH INTERNATIONAL BOAT
SHOW, FOR THE DATES OF FEBRUARY 12TH, 13TH, AND 14TH, 1999; FURTHER
PROVIDING THAT THE LOT BE UTILIZED EXCLUSIVELY BY PAL SUBJECT TO
THE FOLLOWING CONDITIONS: (1) THAT INGRESS AND EGRESS TO THE LOT BE
PROVIDED EXCLUSIVELY FROM DADE BOULEVARD; (2)THAT 100% OF THE
PROFITS GENERATED FROM THIS FUNDRAISER BE RETURNED TO PAL FOR ITS
EXCLUSIVE USE; (3) THAT PAL AND THE CITY JOINTLY MONITOR THE USE OF
THE LOT SO THE SURROUNDING RESIDENTIAL NEIGHBORHOOD IS NOT
DISTURBED; (4) THAT THE SUBJECT PERMISSION IS GRANTED ON A ONE TIME
ONLY EMERGENCY BASIS, IN VIEW OF THE CURRENT PARKING SHORT AGE IN
THE CITY OF MIAMI BEACH; AND (5) IN ORDER TO ACCOMMODATE THE UNIQUE
EMERGENCY CREATED BY THE INCREASED PARKING DEMANDS OF PATRONS
ATTENDING THE BOAT SHOW, THE SUBJECT PERMISSION IS GRANTED
WITHOUT ESTABLISHING PRECEDENT SO AS TO SATISFY THIS UNIQUE
EMERGENCY SITUATION.
WHEREAS, the Administration received a request from the Miami Beach Police Athletic
League (PAL) for permission to utilize the private vacant lot located at Dade Boulevard and
Meridian Avenue (the Lot) for a fund raising event to provide additional parking for the 1999 Miami
Beach International Boat Show, scheduled in the City for February 9 -19,1999; and
WHEREAS, the PAL requests to use this property for three days only, February 12th, 13th,
and 14th, 1999; and
WHEREAS, the Administration recommends that the Mayor and City Commission approve
the PAL's request subject to the following conditions:
(I) That ingress and egress to the Lot be maintained exclusively on Dade Boulevard;
(2) That all profits generated by this fund raising event go exclusively to PAL;
(3) That the Administration and PAL workjointly in preserving the residential character
of the surrounding neighborhood, and that disturbance to these residential areas be
maintained at a minimum;
(4) That this request is specifically granted on a one time only basis, the Mayor and City
Commission having found that an emergency exists due to the increasing parking
crisis within the City of Miami Beach, and the aggravation of this situation,
particularly during special events such as the Boat Show; and
(5) In order to accommodate the unique emergency created by the increased parking
demands of patrons attending Boat Show events, the subject permission is granted
without establishing precedent so as to satisfy this unique emergency situation; and
WHEREAS, the Administration would herein recommend that the Mayor and City
Commission find that an emergency exists with regard to the scarcity of parking during special
events such as the Boat Show, and the need for increased parking during the duration of these events,
and herein approve, the PAL's request, subject to the afore stated conditions, on a one time only
emergency basis.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, herein find and declare the
existence of an emergency and allow the Police Athletic League (PAL) to utilize the lot located at
Dade Boulevard, between Prairie A venue and Meridian A venue, for a fund-raising event to provide
additional parking for the 1999 Miami Beach International Boat Show, for the dates of February
12th, 13th, and 14th, 1999; further providing that the Lot be utilized exclusively by PAL subject to
the following conditions: (1) that ingress and egress to the Lot be provided exclusively from Dade
Boulevard; (2)that 100% of the profits generated from this fund raiser be returned to PAL for its
exclusive use; (3) that PAL and the City jointly monitor the use of the Lot so the surrounding
residential neighborhood is not disturbed; (4) that the subject permission is granted on a one time
only emergency basis, in view of the current parking shortage in the City of Miami Beach; and (5)
in order to accommodate the unique emergency created by the increased parking demands of
patrons attending the Boat Show, the subject permission is granted without establishing precedent
so as to satisfy this unique emergency situation.

Officer Winer advised us that you requested him to secure our approval for
certain boat show activities. We appreciate your sensitivity to the burdens and
disruptions - traffic, noise and debris - caused by the Boat Show to our
neighborhood.
For purposes of the Boat Show only, our Association has no objection to the use
of the school's property and the lot on Dade Boulevard between Prairie and
Meridian Avenues for parking and PAL snack/soda vending.
Our tolerance of this very disruptive two weeks is based in part on our
understanding that the beneficiaries of the Show-the Convention Center, PAL and
PTA-as coordinated by your office and by Officer Winer, will take the following
steps to mitigate disruption to our neighborhood:
. Pick up the debris daily along Prairie and Meridian Avenues;
. Prohibit staging on Prairie and Meridian Avenues;
. Enforce existing ordinances against sleeping in trucks at the convention
center during move in/out; and
. Prohibit move in/out after 10 p.m. (11 p.m. Fri. and Sat.) and before 7 a.m.
Also, we would appreciate your providing a number that we can call for prompt
enforcement of the above listed items. Thank you very much for your sensitivity to
our concerns. Also, please thank Officer Winer for taking his time to present to our
group information concerning boat show parking and other matters.

Association, for the purposes of the Boat Show only, has no objection to the use of Miami Beach
Senior High School's property and the lot on Dade Boulevard between Prairie andMeridian Avenues
for parking and PAL snack/soda vending. Per your request, the telephone number to call regarding

The City Administration appreciates the Mid-Golf Neighborhood Associations cooperation and
understands the hardships it brings to the neighborhood. As such, we will monitor to assure

BACKGROUND
The Miami Beach Police Athletic League (PAL) has requested permission to use the private vacant

lot, located on Dade Boulevard, between Prairie Avenue and Meridian Avenue, for parking of
vehicles of persons who will be attending the 1999 Miami Beach International Boat Show.
ANALYSIS
The Miami Beach International Boat Show, like other Special Events, increases the parking
problems that occur in the City. The use of this vacant lot for parking for this event would ease the
parking and create less of an inconvenience for those citizens who live in the area. The Mayor and
City Commission has granted approval to PAL to use this property for this purpose under Resolution
No. 98-22635.
In addition, the Police Athletic League will:
I. Hire an off-duty police officer to direct traffic for the ingress and egress on Dade
Boulevard.
2. Obtain a letter from the Mid-Golf Homeowners Association stating that they are in
agreement with the use of this property on this date and these times.
3. Submit a plan showing the use of the property to the Planning Department for approval.
4. Supply a letter from PAL to the owner of the property stating that the property will be
returned in the same condition as it was before the use.
5. Obtain a General Liability Certificate ofInsurance naming the City as an additional named
insured.
CONCLUSION
By permitting PAL to use this vacant lot, parking would be eased and PAL will be able to raise
much needed funds for its operations.
