93-2863 Ordinance ORDINANCE NO. 93-2863 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 25, ENTITLED "OFFENSES - MISCELLANEOUS", AMENDING SECTION 25-59.3, BY PROHIBITING BICYCLING, ROLLER SKATING AND SKATE-BOARDING AT THE ENTRANCES AND EXITS TO PARKING LOTS AND PARKING GARAGES AND WITHIN MULTI-LEVEL PARKING GARAGES, OTHER THAN WHILE ENTERING OR EXITING, AND ON PUBLIC PROPERTY WHERE SPECIFICALLY PROHIBITED; PROVIDING FOR REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Mayor and city Commission believe that bicycling, roller skating and skate-boarding on public property in inappropriate places such as entrances and exits to parking lots and parking garages (other than while entering or existing) are potentially injurious to persons engaging in these activities and to other members of the public; and WHEREAS, the city commission wishes to promote public safety while at the same time allowing bicycling, roller skating and skateboarding to occur in areas of the city where these activities can be safely enjoyed. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF SECTION 25-59.3. That section 25-59.3 of Miami Beach city code chapter 25, entitled "Offenses-Miscellaneous" is hereby amended as follows: Sec. 25-59.3. Bicycling, skate-boarding and roller skating etc., are prohibited on Lincoln Road Mall and on the sidewalk on the west side of ocean Drive, and at entrances and exits to parking lots and qarages, within multi-level parkinq garaqes and on other public property where specificallY prohibited. (a) It shall be unlawful for any person to engage in bicycling, roller skating, or Skate-boarding in, on or upon any portion of Lincoln Road Mall lying west of the westerly line of Washington Avenue to the easterly line of Alton Road. (b) It shall be unlawful for any person to engage in bicycling, roller skating, or skate-boarding in, on or upon any portion of the sidewalk on the west side of ocean Drive between Biscayne street and 15th street between the hours of 6:00 P.M. and 6:00 A.M. iQl It shall be unlawful for any person to enqaqe in bicyclinq, roller skatinq, or skate-boardinq in, on or upon public property owned or controlled by the city or other governmental entities where specificallY prohibited by siqns posted by the city or by the appropriate qovernmental entity. Bicyclinq, roller skatinq and skate-boardinq shall also be prohibited at the entrances or exits to parkinq lots and parkinq qaraqes and within multi-level parkinq qaraqes other than while enterinq or exitinq these areas. ~+e+ police department bicycle patrol units shall be exempt from the restrictions of this section. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect on the 7th day of August , 1993. PASSED and ADOPTED this 28th day of July , 1993. During the second reading of a proposed ordinance prohibiting bicycling, roller skating and skate boarding held on June 16, 1993, three members of the public spoke in opposition to the broad nature of the ordinance. At the direction of the city commission, the second reading was continued until July 28, 1993 and the Administration was directed to meet with the three people and other interest~d parties to attempt to reach a solution. A meeting was convened on June 30 attended by Bruce singer, Kelley S. Roark, Kalinda Aaron, Kevin Smith, Sandra Schneider, first assistant city attorney and David Reddick. The participants in the meeting agreed to changes in the ordinance which would prohibit bicycling, roller skating and skateboarding only at the entrances and exits to parking lots and garages (except when skaters or bicyclists are entering or exiting) and within multi-level parking garages and on public property and other inappropriate locales where specifically posted. The attached ordinance reflects the regulations acceptable to the representatives of the in-line skaters group, which was passed on first reading July 14, 1993, with no objections from the audience, which also included representatives of the in-line skaters group.
