AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI
BEACH CITY CODE SECTION 10-8 ENTITLED liTO
QUALIFY WITH THE CITY CLERK; TlME" BY
CONFORMING SAID CODE SECTION TO SECTION 40 OF
THE MIAMI BEACH CITY CHARTER SO AS TO PROVIDE
THAT THE COMMISSION ELECTION QUALIFYING PERIOD
SHALL BE CHANGED FROM NOT MORE THAN ONE
HUNDRED AND THIRTEEN (113) DAYS NOR LESS THAN
ONE HUNDRED AND NINE (109) DAYS PRIOR TO SAID
ELECTION TO THE FOUR CONSECUTIVE DAYS
IMMEDIATELY FOLLOWING THE FIRST MONDAY IN
SEPTEMBER IN THOSE YEARS IN WHICH A GENERAL
ELECTION IS HELD; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY MIAMI BEACH,
FLORIDA:
SECTION 1.
That Miami Beach City Code Section 10-8 entitled "To
Qualify with City Clerk; Time" is hereby amended to read as
follows:
Section 10-8
To Qualify with City Clerk; Time
Except for candidates qualifying for elected office during a
supplemental qualifying period, pursuant to Miami Beach city Code
section 10-2.1, candidates for the office of City commi.ssioner or
Mayor shall qualify with the City Clerk not more than one hundred
and thirteen (113) dayo nor leoo than one hundred and nine (109)
dayo prior to the election for the office of City Commiooioner or
l~ayor. within the four consecutive days immediatelY following the
first Monday in September in those years in which a qeneral
election is held.
SECTION 2.
REPEALER
All Ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3.
SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
juriSdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 4.
EFFECTIVE DATE
This ordinance shall take effect ten
on
December 2

On November 3, 1992 the city of Miami Beach I s electorate
approved a ballot question regarding an amendment to Section 40 of
the city Charter changing the qualifying periods for elected office
so as to shorten said period from not more than one hundred and
thirteen (113) days nor less than one l)undred and nine (109) days
prior to said election to the four consecutive days immediately
following the first Monday in September in those years in which a
general election is held. Accordingly, and in view of the fact
that Miami Beach City Code Section 10-8 similarly provides for
qualifying periods to elected office, the attached legislation has
been prepared as a housekeeping matter so as to conform the city
Code to the newly adopted Charter provision governing this matter.
