RESOLUTION NO. 99-23083
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, SETTING A FIRST READING
PUBLIC HEARING TO CONSIDER THREE PROPOSED AMENDMENTS
TO THE LAND DEVELOPMENT REGULATIONS CONSISTING OF THE
FOLLOWING:
1. An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida,
Amending the Official Zoning District Map, Referenced in Section 142-72 of the <:OlIle
of the City of Miami Beach, Florida, by Changing the Zoning District Classificalimls
for Those Areas Identified in the Chart and Map Below; Amending the Afffctlld
Portions of the City's Official Zoning District Map to Correspond with These Chang~s
as Adopted by the City Commission; Providing for Repealer, Severability and ~n
Effective Date.
2. An Ordinance of the Mayor and City Commission of the City of Miami Beach, Flodd:l,
Amending the Future Land Use Map for Those Areas Identified in the Chart and JVh p
Below; Providing for Exclusion of Certain Properties Subject to a Development If
Regional Impact or Development Agreement as More Particularly Provided Herehl;
Clarifying the Impact of this Ordinance on That Certain Property Commonly Kno,", n
as the South Pointe Ocean Parcel; Directing Transmittals of this Ordinance and AlII
Applicable Documents to Affected Agencies; Providing for Repealer, Severabiilit,,r,
Inclusion in the Comprehensive Plan and an Effective Date.

Establishing a Temporary Moratorium for One Hundred and Eighty (180) Days on the
Approval And/Or Issuance of Building Permits, Certificates of Use, Occupati<llD.ll
Licenses, Design Review Approvals, Variance Approvals, and Other Development
Approvals Which Would Be Inconsistent with the Main Permitted Uses in tie
Residential/Office (RO) District; Said Moratorium Shall Be Effective in the Followiriig
Limited Areas in the Commercial, Low Intensity (CD-I) and Commercial, MedimD
Intensity (CD-2) Districts:
A) The West 75 Feet of Lots 7 and 8, Block 35 of Ocean Beach Addition ~3
(Currently Zoned CD-2);
B) Those Properties Fronting on the East Side of Pennsylvania Avenue,
from Eleventh Street on the North, to the South Lot Line of Lot 4, Block
35 of Ocean Beach Addition #3 on the South (Currently Zoned CD-2);
C) Those Properties Fronting on the West Side of Drexel Avenue, from
Fourteenth Street on the North, to Twelfth Street on the South
(Currently Zoned CD-l); and
D) Those Properties Fronting on the East Side of Alton Road, from
Fourteenth Street on the North, to Twelfth Street on the South
(Currently Zoned CD-I)
(The "Subject Areas"), and Shall Automatically Dissolve upon the Earlier of tbe
Expiration ofthe One Hundred and Eighty (180) Day Period or upon the Denial b} tbe
City Commission of a) Amendments To the City's Zoning Map to Rezone the Subj(~ct
Areas to RO, or B) Amendments to the Future Land Use Map of the Cif) 's
Comprehensive Plan to Redesignate the Subject Areas to RO; Providing for Celia in
Exemptions from the Moratorium; Providing for Review Procedures; Providinl~ ~'lr
Repealer; Providing for Severability; and Providing for an Effective Date.
WHEREAS, the above amending ordinances were referred to the Miami Beach Plan nil 19
Board by the City Commission; and
WHEREAS, the Planning Board will consider the ordinances at its February 23, 19119
meeting, at which time the Board expects to take action on the amendments; and
WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Flo rid a,
in cases in which the actual list of permitted, conditional or prohibited uses within a zoning categm y,
or a change to the actual zoning map designation for a parcel or parcels of land is proposed, the Ci:y
Commission shall provide for public notice and hearings by holding two advertised public hearin:~s
on the proposed ordinance, at least one hearing held after 5:00 p.m. on a weekday; and
WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Floridl,
these amendments require a 30 day mailed notice of public hearing, and to enable the Ci y
Commission to hear the proposed amendments in a timely manner on first reading at its March I 7,
1999 meeting, the Administration is requesting that the public hearings be set at this tim~, n
anticipation of the Planning Board's expected action on February 23, 1999;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CrTY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a first reading pubIc
hearing to consider amendments to the Land Development Regulations of the City Code: 1) Zonil.g
Map Changes, 2) Future Land Use Changes, and 3) a Temporary Development Moratorium :61r
Certain Limited Areas Proposed to Be Rezoned, is hereby scheduled on Wednesday, March 17, ,9~ 9
at 5:01 p.m. in the City Commission Chambers at 1700 Convention Center Drive, Miami Bt:ac 1,
Florida, and the City Clerk is hereby authorized and directed to publish and distribute the appropria:e
public notice of said public hearing at which time all interested parties will be heard.

Notwithstanding anything to the contrary contained herein, the DRI Properties, as descr bd

SECTION 3. IMPACT ON SOUTH POINTE OCEAN PARCEL
The South Pointe Ocean Parcel, as described in Exhibit B attached hereto and made a part
hereof, is subject to a temporary injunction dated June 22, 1998 entered by the Circuit Court in Cas.~
No. 98-1 0798CA30 (Miami-Dade County), which provides in part that the City and its agencies 'ar~
hereby temporarily enjoined from applying any changes to the existing zoning to the Oceant'of t
Parcel", Notwithstanding anything to the contrary contained herein, this Ordinance shall not appl'
to the South Pointe Ocean Parcel during the time period that the referenced temporary injunc:io 1
remains in full force and effect.
SECTION 4. REPEALER.
That all Ordinances or parts of Ordinances in conflict here"With be and the same are hereb:"
repealed,
SECTION 5. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remaind :r
shall not be affected by such invalidity.
SECTION 6. INCLUSION IN COMPREHENSIVE PLAN.
It is the intention of the City Commission, and it is hereby ordained that Section 1 is mac e
part of the Future Land Use Map of the City of Miami Beach Comprehensive Plan, as amended; th It
the sections of this Ordinance may be renumbered or relettered to accomplish such intention; ar d
that the word "ordinance" may be changed to "section" or other appropriate word.
SECTION 6. EFFECTIVE DATE.

AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A TEMPORARY
MORATORIUM FOR ONE HUNDRED AND EIGHTY (180) DAYS ON THE
APPROVAL AND/OR ISSUANCE OF BUILDING PER.\HTS,
CERTIFICATES OF USE, OCCUPATIONAL LICENSES, DESIGN REVIEW
APPROVALS, VARIANCE APPROVALS, AND OTHER DEVELOPMENT
APPROVALS WHICH WOULD BE INCONSISTENT WITH THE MAIN
PERMITTED USES IN THE RESIDENTIAL/OFFICE ("RO") DISTRICT;
SAID MORATORIUM SHALL BE EFFECTIVE IN THE FOLLOWING
LIMITED AREAS IN THE COMMERCIAL LOW INTENSITY (CD-i) AND
COMMERCIAL MEDIUM INTENSITY (CD-2) DISTRICTS:
A) THE WEST 75 FEET OF LOTS 7 AND 8, BLOCK 35 OF
OCEAN BEACH ADDITION #3 (CURRENTLY ZONED
CD-2);
B) THOSE PROPERTIES FRONTING ON THE EAST
SIDE OF PENNSYL VANIA A VENUE, FROM
ELEVENTH STREET ON THE NORTH, TO THE
SOUTH LOT LINE OF LOT 4. BLOCK 35 OF OCEAN
BEACH ADDITION #3 ON THE SOUTH
(CURRENTL Y ZONED CD-2);
C) THOSE PROPERTIES FRONTING ON THE WEST

WHEREAS. the City of Miami Bcach is in the process of considering the re-zoning ani r :-
designation of certain limited areas in the Commercial Low Intensity (CD-I) and Commerci II
Medium Intensity (CD-2) Districts to RcsldentiallOtlice (RO) and is considering City Zoning \.1, p
Code and Comprehensive Plan Future Land Use Map (FLUM) changes to effectuate these change;;
and
WHEREAS, a temporary moratorium for a period of one hundred and eighty (180) da:rs s
necessary to facilitate the rational and appropriate level of development in certain limited CD-l an j
CD-2 Districts pending the consideration by the City Commission of City Code and Comprehensiv ~
Plan amendments relative to the proposed re-zoning and re-designation; and
WHEREAS, the Mayor and City Commission desire to provide for a temporary 180 dar
moratori urn to ensure that during the pendency of the necessary review activities by the Planr jn:~
Board and City Commission, which are presently underway, for the formulation and implementa:io: l
of the above referenced City Zoning Map and Comprehensive Plan (FLUM) amendments,ha:
building permits, certificates of use. occupational licenses, design review approvals, variancl:
approvals. and other development approvals which would be inconsistent with the main permilte(
uses in the RO District, not be issued or granted in certain limited CD-I and CD-2 Districts so lha

approvals which would be inconsistent with the main permitted uses in the Residential/Office (R())
District. The moratorium shall be effective in the following limited Commercial Low Intensity (Cl )-
1) and Commercial Medium Intensity (CD-2) Districts:
A) The West 75 Feet of Lots 7 and 8. Block 35
Of Ocean Beach Addition #3 (Currently Zoned CO-
2);
B) Those Properties Fronting on the East Side of Pennsylvania
A venue. from Eleventh Street on the North, to the South Lot
Line of Lot 4. Block 35 of Ocean Beach Addition #3 on the
South (Currently Zoned CD-2);
C) Those Properties Fronting on the West Side of Drexel
Avenue, from Fourteenth Street on the North, to Twelfth
Street on the South (Currently Zoned CD-I); and
D) Those Properties Fronting on the East Side of Alton Road,
from Fourteenth Street on the North. to Twelfth Street on the
South (Currently Zoned CD-I).
The moratorium shall automatically dissolve upon the earlier of the one hundred and eighty ( .8( )
day period or upon the denial by the City Commission of amendments to re-zone the subject are,s
from CD-lor CD-2 to RO in the City's Zoning Map or to redesignate the subject areas from CD-l
or CD-2 to RO in the Future Land Use Map (FLUM) of the City's Comprehensive Plan.
B. Exemptions from the Moratorium
This Ordinance shall not be construed or applied to abrogate the application of equitabl.~
estoppel to a property owner to obtain approval and/or the issuance of building permits, certific3.te)
of use, occupational licenses, design review approvals, variance approvals, or any other developmer t
approvals as follows:
(1) In the event the property owner:
a. Obtains (i) a design review approval, (ii) a variance approval where no de~;igl
review approval is required, or (iii) a full building permit as defined i; 1

b. Satisfies subsection a., above, prior to a favorable recommendation by th.:

C. Review Procedures
In the event the property owner does not qualify under subsections B( I) or (2) abovt
for an exemption to avoid enforcement of the application of this Ordinance. then the property OW1el
may seek a determination from a court of competent jurisdiction as to whether equitable estopJeJ
otherwise exists. If. however. a property owner fails to seek a determination from the court, or ifb.e
court has made a determination unfavorable to the property owner, and such determination is not
reversed on appeal, then the city shall fully enforce this Ordinance against the property ownn's
project.
SECTION 2.
REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are here JY
repealed.
SECTION 3.
SEVERABILITY
If any section. subsection. clause or provision of this Ordinance is held invalid, t1 e
remainder shall not be affected by such Invalidity.
SECTION 4.
EFFECTIVE DATE.
This Ordinance shall be effective ten (10) days after its adoption.

RECOMMENDATION
The Administration recommends that the City Commission set the required first reading pub lic
hearings for 5:01 p.m. on March 17, 1999 for these proposed separate amendments to the La:1d
Development Regulations regarding Zoning Map Changes, Future Land Use Map Changes and a
Temporary Development Moratorium for Certain Areas Being Rezoned. (Note: These amendments
require a 30 day mailed notice of public hearing, and either the first or second reading must be hdd
after 5:00 p.m.).
BACKGROUND
These amendments to the Zoning Ordinance are currently being considered by the Planning Board.
On February 23, 1999 the Planning Board is scheduled to hold public hearings to consider these
proposed amendments, at which time the Board expects to take action on the amendments.
These amendments require a 30 day mailed notice of public hearing. Therefore, to enable the City
Commission to hear the proposed amendments in a timely manner on first reading at its March 17,
1999 meeting, the Administration is requesting that the public hearings be set at this time, in
anticipation of the Planning Board's expected action on February 23, 1999.
CONCLUSION
Based on the foregoing, the Administration recommends that the City Commission set the first
reading public hearings regarding the two proposed amendments to Land Development
Regulations, referenced above and more particularly set forth in the attached ordinances, for Marl:h
17,1999.
