A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, RETROACTIVELY AUTHORIZING THE CITY
MANAGER TO SUBMIT AN APPLICATION TO THE
MIAMI-DADE COUNTY OFFICE OF AMERICANS WITH
DISABILITIES ACT, TO RECEIVE A GRANT AWARD
FOR FISCAL YEAR 1998-1999, IN THE AMOUNT OF
$110,440.94, TO EXECUTE THE GRANT AGREEMENT, IF
AWARDED; AND TO APPROPRIATE THE FUNDS WHEN
RECEIVED.
WHEREAS, in July 1990, the American with Disabilities Act (ADA) was passed
by Congress, and Title II of the ADA requires that state and local governments provide
accessibility to their programs and that they do not discriminate in the provision of
employment, goods, services and/or programs, on the basis of a person's disabilities; and
WHEREAS, as required under Title II of the ADA, the City has developed a
Transition Plan, which describes the facilities owned and/or controlled by the City and the
architectural barriers found in these facilities; and
WHEREAS, the Miami-Dade County Office of ADA Coordination has grant
funds available to assist municipalities in their compliance with ADA requirements; and
WHEREAS, funds to be received by the City under this grant may be used for
modifications to City facilities to remove architectural barriers, to train City employees
with regard to the requirements of the ADA, to provide public awareness programs
regarding the ADA, to make improvements on parking for the disabled, and to help fund
the operations ofthe City's Office of ADA Coordination.; and
WHEREAS, the expenditures of the funds under this grant will be done in
consultation with the City's Barrier Free Environment Committee; and
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, retroactively
authorizing the City Manager to submit an application to the Miami-Dade County Office
of Americans with Disabilities Act, to receive a grant award for fiscal year 1998-1999, in
the amount of $110,440.94, to execute the grant Agreement, if awarded; and to
appropriate the funds when received.

The City of Miami Beach is pleased to submit our application package for the FY 1998-1999 ADA
Parking Fines Grant. Included in the package is the scope of services for the grant and the report on
the use of the previous year's grant. The proposed scope of services will be presented to the Barrier-
Free Environment Committee for ratification, at its upcoming regularly scheduled meeting on March
22, 1999.

BARRIER FREE ENVIRONMENT MODIFICATIONS PROPOSAL

DESCRIPTION: This project will provide modifications to several City owned facilities
to provide access to residents and visitors with disabilities, in
compliance with the Americans with Disabilities Act (ADA) and with
the policies of the City in regard to non-discrimination to persons with
disabilities.
PROBLEM STATEMENT:
The City of Miami Beach is implementing a program to address the challenges presented by its
diverse population. Of its 92,000 plus residents, as many as 18,000 people are persons wi:h
disabilities. The 1990 census estimated that thirty (30) percent of the City's residents are over the age
of sixty five (65). The City, as one of the premier tourist destinations in the country, advertisl:s
compliance with ADA in several publications such as the Miami Beach Chamber of Commerce
Visitor's Guide. The City recognizes its obligation to assure accessibility to all City-owned facilitil:s
for persons with disabilities and has established policies and procedures to meet this obligation.
In 1995, the City prepared an updated Americans with Disabilities Act (ADA) Transition Plan, a
combination of an assessment of the level of accessibility of City-owned facilities and a schedule
for modifications of these facilities. The plan is the basis for a long term commitment by the City
to make itself and its prograI1!s.more accessible to persons with disabilities.
The City created the Barrier-Free Environment Committee, composed of persons representing :J.
broad range of disabilities and interested residents. Its purpose is to review, fonnulate and coordinat ~
infonnation, suggestions, proposals and plans to address complaints from the general public tn
provide more accessible facilities and programs for persons with disabilities in the City of Miami
Beach. The priorities are established in tenns of the order in which facilities are to be modified and
also the particular improvements at each facility.
During the years in which the Barrier-Free Environment Committee has operated, they have
identified in conjunction \\ith the City's Building Department and the ADA Coordinator the facilitie~
requiring modifications and have developed a priority list. This plan.is now in its second year of
implementation
For fiscal year 1998-1999, the recommended work includes:
I. Continuing work in the provision of curb cuts at intersections that are on the rou'es
used by persons with disabilities to access commercial zones. City programs. City facilities and
public transportation stops.
'") Continuing work in the modification of City facilities to achieve the greatest
accessibility possible.
3. Providing a hearing impaired program of sign language interpreting and op~n
captioning for City Commission meetings and other public hearings and meetings.
4. Continuing the City's public information campaign to inform residents of the City
about ADA and the programs and facilities which are accessible.
5. Continuing education and training of City personnel with regards to ADA.
6. Accessibility ramps for North Shore Park restrooms.
7. Providing publications on Hurricane Awareness for those with visual disabilities,
8. Continuing work on the provision of parking for the disabled throughout the City.
The City respectfully requests from Miami-Dade County's Office of ADA Coordination, fundingn
the maximum available amount, which is currently estimated at $110,440.94, to be provided fron
the County's handicapped parking fines distribution system. Funds from the Parks & Recreaticn
Bond program Fund 370 will also be used for the ramps at North Shore Park as a matching funl
All funds from Miami-Dade County shall be applied to these proposed activities.
OBJECTIVES:
The City seeks to maintain its efforts to provide accessible programs, services and activities to
persons with disabilities. These objectives are defined as follovis:
1. To modify City facilities so that programs are available in a manner that is not
discriminatory to persons with disabilities due to the presence of architectural or communication
barriers.
2. To modify policies and procedures so that the programs are available to persons with
disabilities in as an equal manner as possible as they are to persons without disabilities.
3. To be a source of information to the residents and businesses of the City to help them
be aware of ADA and their rights and responsibilities under it.
4. To maintain a database of state-of-the-art information regarding ADA, accessible
design, and accessible programs to support the objectives as described above.
METHODS:
The City of Miami Beach will use grants and matching funds to implement physical modifications
as set forth in the City's Transition Plan and Curb Cut Implementation Plan. The Office of AI'A
will serve as the single source of information and coordination of ADA-related activities. The Ci~/s
ADA Coordinator will be responsible for the administration of grants and other programs as
necessary to maintain the City's ongoing ADA program.
Upon the availability of funds, the Office of ADA, in consultation with the Barrier-Free
Environment Committee, will prioritize projects and then assist in implementing the work
identified.
EV ALVA nON:
This project will be evaluated in terms of:
1. The increased accessibility to persons with disabilities to City facilities that ha're
public interaction in the normal course of functions.
2. The increase in the number of City programs that are accessible to persons wi th
disabilities.
3. The cost effectiveness of modifications made under the City's ADA Transition Plan
and ADA Implementation Plan.

AGREEMENT: ADA Accessibility Improvements
DESCRIPTION: This project will provide modifications to as many facilities as
possible of the more than forty City-o'Mled facilities and/or streets to
provide access to residents and visitors with disabilities, in
compliance with the Americans with Disabilities Act (ADA) and the
policies of the City in regard to non-discrimination to persons wth
disabilities.
The recommended work includes: providing curb cuts at intersections
that are on the routes used by persons with disabilities to access zones
of commerce, City programs; and other areas of the City and routes
to accessible public transportation stops; modifying City facilities as
indicated in the City's ADA Transition Plan to achieve the great~st
accessibility possible to City programs; compiling references and
other information to be kept as a resource in the City's Office Jf
ADA; continuing a public information campaign to inform resider.ts
of the City about ADA; construction of accessibility ramps at North
Shore Park; and continuing education and training of City personnel
with regards to ADA.
The City will not spend more than $10,000 of grant monies to fund
expenses of the City's Office of ADA, including public informaticn
activities.

Dear Mr. Rodriguez:
In accordance with State law and Section 30-447 of the Code of t\-liami-Dade County.
parking fine money generated fi'om the misuse of specially marked spaces for people
with disabilities is to be used in the following manner:
(1) One-third of the money is to be used to defray administrative expenses of the
Office of the Clerk; and
(2) Two-thirds of the money is to be used to provide funds to improve accessibility
and equal opportunity to qualified physically disabled persons and to provide
funds to conduct public awareness probTfams concerning physically disabled
persons.
The two-thirds shall be distributed in the following manner:
Thirty (30) percent is to be retained by the County for county-wide purposes. in
accordance with State law, and seventy (70) percent is to be allocated to the
governmental entity having jurisdiction over the violation.
To be eligible to receive funds each participating city, including the Unincorporated
Municipal Service Area (UMSA) is required to submit a program plan that would assure
that these funds would be used in accordance with State law. Money not distributed to a
city because of the failure of such city to submit or comply with a program plan shall be
placed in a fund for disbursement to other cities, including Ul\iISA, which are in
compliance with such plans in proportion to the percentage of citations issued by the
complying city.

The Commission on Disability Issues (CODI) and the Miami-Dade League of Cities
developed and approved criteria detailing the proper use of these funds in accordance
with State law.
Expenditures must meet the following criteria:
(1) Each party shall illustrate a maintenance of effort related to providing accessible
programs, services and activities to people with disabilities; disabled parking fine
money shall not substitute for other money allocated for such use;
(2) Each party shall create an advisury councii composed of persons representing a
broad range of disabil ities who shall provide input as to the use of the funds;
(3) Eligible projects or programs if mandated by federal, state, or local law, must be
matched by the parties in at least an equal amount by other funding. Other
eligible projects or programs may be funded up to 100 percent by disabled permit
parking fine money;
(4) If only a portion of the project or program is being promoted to benefit people
with disabilities, then only that portion of the project or program may be funded
with these moneys;
(5) The parties are subject to the uniform minImum standards for County-wide
application. assessment, monitoring and management evaluation and
performance review for organizations providing community services as specified
by Administrative Order 3-15; and
(6) Future funding is contingent upon proper completion and reporting of previous
programs or projects.
You may submit a proposal for a project or program meeting the aforementioned criteria.
Current estimates of funding for which the City of Miami Beach may apply is
$110,440.94.
Awards to municipal ities are based on a percentage of total revenue that is determined by
calculating the total amount paid on tickets in a municipality divided by the total number
of tickets paid county-wide. Funding estimates include a percentage of the spillover
moneys that were not distributed to any municipalities in the previous year.
The deadline for submission of proposals is February 26, 1999. The Office of ADA
Coordination will review the proposals with recommendations from COOL

If your municipality received funding during the 1997-98 fiscal year you must submit 1
year-end report in accordance with the terms of the interlocal agreement including all
supporting documentation. Reports are currently due

ADMINISTRA TION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
In July 1990, the Americans with Disabilities Act (ADA) was passed by the U. S. Congress. Title
II ofthe ADA requires that state and local governments provide accessibility to their programs and
that they do not discriminate in the provision of employment, goods, services and/or programs, )n
the basis of a person's disability. As required under Title II of the ADA, the City has developed a
Transition Plan, which describes the facilities owned and/or controlled by the City and the
architectural barriers found in these facilities. The Barrier Free Environment Committee has tabn
a leadership role in the development of the Transition Plan. The deadline to submit the applicati,)n
was February 26, 1999. Upon submission ofthe grant application, City Staff was unaware that prior
City Commission approval of such submission was required. Therefore, the Commission's
retroactive approval is being sought now.
The funds to be received by the City under this grant may be used for modifications to City facilities
to remove architectural barriers, to train City employees in regards to the requirements of ADA, to
provide public awareness programs regarding ADA, to make improvements on parking for the
disabled, and to help fund the operations of the City's Office of ADA. The expenditure of the funjs
under this grant will be done in consultation with the Barrier Free Environment Committee.
ANAL YSIS:
Under Title II of ADA, programs and facilities of state and local governments must be made
accessible to persons with disabilities. To comply with the law, the City has undertaken a progra:n

of modifying its facilities to remove architectural and communication barriers. and is reviewing its
programs to develop ways of making them more accessible.
The Administration proposes that this grant be applied for and accepted by the City so that
architectural and communication barriers in City facilities, and accessibility to City programs ITay
be remedied sooner than if these grant funds were not available to the City to assist in this effurt.
Matching funds for the grant have been identitied from the Parks and Recreation Bond Fund 370 and
no new allocation of general funds is expected as a result of this grant.
CONCLUSION:
The Administration recommends the approval of the Resolution retroactively authorizing the C ty
Manager, or his designee, to submit on behalf of the City, an application for a grant and to execute
an InterIocal Agreement with the Miami-Dade County Office of ADA, for the purpose of receivi 19
the grant award in the amount of $110,440.94; authorizing the acceptance of the grant; a1d
appropriating the funds in compliance with the terms of the Agreement.
