FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 2, ENTITLED "ADMINISTRATION" BY
REPEALING IN ITS ENTIRETY SECTION 2-6,
ENTITLED "ENUMERATION OF ORGANIZATIONAL UNITS,
ADMINISTRATIVE OFFICERS OR AGENCIES AND THEIR
UNITS" AND CREATING A NEW SECTION 2-6,
ENTITLED "ENUMERATION OF ORGANIZATIONAL
UNITS"; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: That section 2-6 of Miami Beach City Code Chapter 2,
entitled "Administration", which reads as follows is hereby
repealed in its entirety:
Sec. 2-6. Enumeration of organizational units, administrative
officers or agencies and their units.
The administrative officers or agencies of the city and
the organizational units which are hereby created and for
which such administrative officers are directly responsible,
shall be as follows:

REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
RECOMMENDATION
The Administration recommends that the City Commission adopt the
attached Ordinance amending Miami Beach city Code Chapter 2,
entitled "Administration" by repealing in its entirety, Section 2-
6, entitled "Enumeration of organizational units, administrative
officers or agencies and their units" and creating a new Section 2-
6, entitled "Enumeration of orq~nizaticnal units".
This ordinance was adopted on first reading on September 2, 1992.
Second and final reading of this ordinance is scheduled for
September 16, 1992. It must be noted that adoption of this
ordinance is vital to the implementation of the FY 1992/93 Budget.
REVISION
Durinq the September 2. 1992 City Commission meetinq. the city
Commission and the Administration recoqnized and acknowledqed the
importance and contribution of "Historic Preservation" to the
development and revitalization to the City of Miami Beach.
As a result. the name of the oriqinal proposed "Development and
Desiqn Services Department" was changed to "Development. Desiqn and
Historic Preservation Department". This chanqe was made prior to
the first readinq of the proposed ordinance and is now included in
the ordinance for second readinq.
After further discussion. it was determined that it is also
necessarv to include in the ordinance for second r~adinq a ~~vlslon
of the "Planninq and Desiqn Services Division" to "Planning. Desiqn
and Historic Preservation Services Division". This chanqe in
divisional name in not substantive and does not affect the proposed
ordinance for second reading.

BACKGROUND
In response to the need to retur~ the City of Miami .B~ach to, fiscal
health by downsizing and reduc1ng c~sts, the ~dm1n1strat1~n has
proposed an organization structure Wh1Ch establ1shed the baS1S for
the FY 1992/93 Proposed Budget.
This organization structure: 1) reduces the number of service areas
from seven (7) to five (5); 2) reduces "the number of existing
departments from seventeen (17) to eleven (11); and, 3) eliminated
twelve executive/ managerial positions. Annualized savings are
estimated at $582,600.
On July 22, 1992, a report regarding the proposed downsized
organization was presented to the city Commission for ratification.
A motion accepting the report was passed by a vote of 7-0.
On August 11, 1992, the Finance Committee reviewed this ordinance
amendment and adopted a motion that it be forwarded to the City
commission.
PROCEDURE
Miami Beach City Code, Chapter 2 section 2-6 provides for the
enumeration of organizational units, administrative officers,
agencies and their units. Al though this section provides for
seventeen (17) departments and was last amended in 1984 (Ordinance
84-2401), there' have been many changes since then that were
implemented by annual budget resolutions.
It is appropriate that Chapter 2 Section 2-6 of the Code be amended
to accurately reflect the downsized organization so that it may be
implemented on October I, 1992 with the FY 92/93 Budget. Amendment
to this Section of the Code is accomplished by Ordinance.
On the advice of the City Attorney's Office, it is less confusing
and easier to repeal in its entirety the existing Section 2-6 and
to create a new Section 2-6. The attached Ordinance contains both
the existing language with authorized departments and divisions (as
of 1984) and the existing and new departments, divisions, and
offices that are being proposed.
Further, with the advice and concurrence of the City Attorney's
Office references to the administrative officers of the 'departments
are being eliminated, since such officers are prescribed and
authorized by Ordinance 1605, as amended, being the "Unclassified
Salary Ordinance".
