HomeMy WebLinkAbout99-23282 RESO RESOLUTION NO. 99-23282 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLROIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF NINETY FOUR (94) BANNERS FOR THE MOUNT SINAI MEDICAL CENTER 50 YEAR ANNIVERSARY CELEBRATION AND HEALTH FAIR TO BE HELD AT MOUNT SINAI MEDICAL CENTER FROM NOVEMBER 19, 1999, TO DECEMBER 6, 1999, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: 41ST STREET, FROM ALTON ROAD TO PINETREE DRIVE (BOTH SIDES OF STREET); COLLINS AVENUE, FROM 41ST STREET (APPROXIMATELY) TO 62 STREET; ALTON ROAD IN FRONT OF MEDICAL CENTER; AND ALTON ROAD EXIT; FROM 1-95 (NORTH & SOUTH); SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY; MEASURING 3' X 7'; HAVING COPY AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; AND TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL REQUIREMENTS; THE RECOMMENDS THAT THESE EARLIER THAN NOVEMBER DECEMBER 6, 1999. OTHER APPLICABLE CITY ADMINISTRATION FURTHER BANNERS BE INSTALLED NO 19, 1999, AND REMOVED BY WHEREAS, the Mount Sinai Medical Center (Applicant) will be holding a celebgation and Health Fair at Mount Sinai Medical Center from November 19, 1999, through December 6, 1999; and WHEREAS, in order to publicize the event, and draw attention of the media and the public at large, the Applicant has requested light pole banners, measuring 3 feet by 7 feet, to be placed at 41st Street, from Alton Road to Pinetree Drive (both sides of street); Collins Avenue, from 41st Street (approximately) to 62 Street; Alton Road in front of Medical Center and Alton Road exit; from 1-95 (North & South); and WHEREAS, said banners will be installed no earlier than November 19, 1999, and removed by December 6, 1999; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of ninety four (94) banners; and WHEREAS, the Applicant will post a performance bond to ensue the removal of the banners by December 6, 1999, and will ensure that any damage to light poles will be repaired at its expense, and will meet all other applicable City requirements; and WHEREAS, Section 9-3.C.4 of the City's Zoning Ordinance (Ordinance No. 89-2665), as amended, requires that the Mayor and City Commission approve the installation of temporary banners. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMi BEACH, FLORIDA, that the Mayor and the City Commission herein approve and authorize the placement of ninety four (94) banners for the Mount Sinai Medical Center 50 Year Anniversary Celebration and Health Fair, to be held at Mount Sinai Medical Center from November 19, 1999, through December 6, 1999, as requested by the Applicant at the following locations: 41st Street from Alton Road to Pinetree Drive (both sides of street), Collins Avenue from 41st Street (approximately) to 62 Street, Alton Road in front of Medical Center and Alton Road exit from 1-95 (North & South); said banners to be affixed to light poles in the public right-of-way, measuring 3' x 7' and having copy and design as shown on the attached drawings, the banners to be installed no earlier than November 19, 1999, and removed by December 6, 1999, and shall be installed and removed in accordance with all other applicable City requirements. DATE 89 BACKGROUND The Zoning Ordinance requires that the City Commission approve the installation of temporary banners, pursuant to Section 9-3.C.4 which reads, in part: Light Pole Banners affixed to light poles or other similar structures on the public right-of-way shall be subject to the following regulations: ao The right to install, as well as the number, location and method of installation of banners shall be subject to the Design Review process and approved by the City Commission and the Public Works Department. Banners announcing special events, either to be held in Miami Beach or to be associated in some manner with Miami Beach, as determined by the City Commission, may be erected up to thirty days prior to the event being announced and must be removed within seven days after said event. fo A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct the banners to be removed at any time. ANALYSIS The purpose of the banner is to celebrate Mount Sinai Medical Center's 50 years of service and its Health Fair. If approval is granted, the proposed temporary banners are recommended to be installed no earlier than November 19, 1999 and removed no later than December 6, 1999. CONCLUSION The City Commission should approve the installation of the subject light pole banners for Mount Sinai Medical Center in Miami Beach.
