RESOLUTION NO. 99-23293
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, SETTING A FIRST READING PUBLIC HEARING TO
CONSIDER A PROPOSED ZONING MAP CHANGE CONSISTING OF:
An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida,
Amending the Official Zoning District Map, Referenced in Section 142-72 of the Code
of the City of Miami Beach, Florida, by Changing the Zoning District Classification
5937 Collins Avenue (AIKIA the Bath Club) from the Current Zoning District
Classification RM-1 Residential Multi-Family Low Intensity, to the Proposed Zoning
District Category RM-2 Residential Multi-Family Medium Intensity; Amending the
Affected Portion of the City's Official Zoning District Map to Correspond with this
Change as Adopted by the City Commission; Providing for Repealer, Severability and
an Effective Date.
WHEREAS, the Planning Board considered the ordinance at its June 22, 1999 meeting, and
reviewed the amendment; and
WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Florida,
in cases in which a change to the actual zoning map designation for a parcel or parcels of land of less
than ten contiguous acres is proposed by an applicant other than the City, the proposed ordinance
may be read by title or in full on at least two separate days; and
WHEREAS, to enable the City Commission to hear the proposed amendment in a timely
manner on first reading at its September 22, 1999 meeting, the Administration is requesting that the
public hearing be set at this time;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a first reading public
hearing to consider a Zoning Map Change rezoning the subject area, is hereby scheduled on
Wednesday, September 22, 1999 at 5:45 p.m. in the City Commission Chambers at 1700
Convention Center Drive, Miami Beach, Florida, and the City Clerk is hereby authorized and
directed to publish and distribute the appropriate public notice of said public hearing at which time
all interested parties will be heard.

WHEREAS, the applicant, ZOM South Beach, Ltd., has made application to the City of
Miami Beach to rezone the property located at 1330 West Avenue (A/KJA the Parkshore); and
WHEREAS, amending the zoning of the property listed below as provided herein is
necessary to insure that development of that property will be compatible with development in
adjacent and surrounding areas, and will contribute to the health and general welfare of the City;
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENTS OF ZONING DISTRICTS AND MAP OF
COMPREHENSIVE ZONING ORDINANCE.
That the Mayor and City Commission hereby amend the Zoning Districts and Zoning District
Map of City of Miami Beach referenced in Section 142-72 of the Code of the City of Miami Beach,
Florida, by changing the zoning district classifications of the property at 1330 West Avenue (AfKlA
the Parkshore) from the existing zoning district classification RM-2 Residential Multi-Family
Medium Intensity, to the proposed zoning district classification RM-3 Residential Multi-Family High
Intensity .
SECTION 2. REPEALER.
That all Ordinances or parts of Ordinances in conflict h~rewith be and the same are hereby
repealed
SECTION 3. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 4. EFFECTIVE DATE.
This Ordinance shall take effect on the _ day of , 199 .

RECOMMENDATION
The Administration recommends that the City Commission set the required first reading public
hearing for 5:45 P.M. on September 22, 1999 for this proposed amendment to the Zoning Map
redesignating the subject property, 5937 Collins Avenue, a/k/a the Bath Club, from the existing
zoning district classification RM-l Residential Multi-Family Low Intensity to the RM-2
Residential Multi-Family Medium Intensity zoning district classification.
BACKGROUND
On June 22, 1999 the Planning Board held a public hearing, and reviewed a proposed amendment
of the City of Miami Beach Zoning Map, redesignating the subject property from the existing
zoning district classification RM-l Residential Multi-Family Low Intensity to the RM-2
Residential Multi-Family Medium Intensity zoning district classification.
To enable the City Commission to hear the proposed amendment in a timely manner at its
September 22, 1999 meeting, the Administration is requesting that the first reading public hearing
be set at this time.
CONCLUSION
Based on the foregoing, the Administration recommends that the City Commission set the first
reading public hearing regarding this proposed amendment to the Zoning Map, referenced above
and more particularly set forth in the attached ordinance, for September 22, 1999.
