A RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF MIAMI BEACH, FLORIDA DECLARING
ACQUISITION OF THOSE PROPERTIES IDENTIFIED
AND DESCRIBED AS: (825-833 FIRST STREET) LOTS
16, 17, 18 AND 19, BLOCK 78, OCEAN BEACH
ADDITION NO.3, PLAT BOOK 2, PAGE 81, TO BE A
PUBLIC NECESSITY FOR THE PROJECT KNOWN AS THE
OLD POLICE STATION SITE REDEVELOPMENT
PROJECT, AUTHORIZING THE ACQUISITION OF SAID
PROPERTIES BY PURCHASE, DONATION OR THE
FILING OF EMINENT DOMAIN PROCEEDINGS AND
DECLARATION OF TAKING, AS NECESSARY; AND
REPEALING MIAMI BEACH REDEVELOPMENT AGENCY
RESOLUTION NO. 60-88.
BE IT RESOLVED BY THE MIAMI BEACH REDEVELOPMENT AGENCY OF
THE CITY OF MIAMI BEACH, FLORIDA THAT:
SECTION 1:
WHEREAS, the City of Miami Beach, through Resolution No. 76-
14961 of February 17, 1976, created the Miami Beach Redevelopment
Agency in order to administer and exercise the community
redevelopment powers of the City of Miami Beach in accordance
with the provisions of the Community Redevelopment Act of 1969,
Chapter 163 of the Florida Statutes; and
WHEREAS, the City Commission of the City of Miami Beach,
through Resolution No. 83-17403 of July 6, 1983, declared itself
to be the Miami Beach Redevelopment Agency pursuant to the
authority of the Community Redevelopment Act of 1969, Section
163.357, Florida Statutes (1979); and
WHEREAS, the City Commission of the City of Miami Beach,
through Resolution No. 88-19434
of November 2, 1988, gave its
specific approval of actions by the Miami Beach Redevelopment
Agency in acquiring Blocks 78 and 80 of Ocean Beach Addition No.
3, Plat Book 2, Page 81, Public Records Dade County, Florida, as
a public necessity for the project known as the Old Police
station Site Redevelopment Project, and further approved the
actions of the Redevelopment Agency in authorizing the
acquisition of said properties by purchase, donation or the
filing of eminent domain proceedings and declaration of taking,
as necessary; and

WHEREAS,
the Redevelopment Agency of Miami Beach is
empowered to designate certain slum and blighted neighborhoods as
redevelopment areas and undertake the necessary efforts to
redevelop them according to approved plans; and
WHEREAS, South pointe is the only designated community
redevelopment area within the city of Miami Beach; and
WHEREAS, the South pointe Revitalization Strategy and
supporting corridor Studies, approved by the City of Miami Beach,
recognize that a key consideration in redevelopment efforts
through the South pointe area is the availability of suitably
large parcels, as the small size of existing lots and ownership
patterns makes land assembly difficult; and
WHEREAS, Blocks 78 and 80 of Ocean Beach Addition No. 3 have
been identified as a suitable redevelopment site for the
construction of attractively-designed residential units; and
WHEREAS, in Miami Beach Redevelopment Agency Resolution No.
48-87, the Redevelopment Agency of the City of Miami Beach
authorized the Executive Director of the Agency to seek
appraisals for Blocks 78 and 80 of Ocean Beach Addition No.3,
authorized the Executive Director to negotiate options on
privately owned parcels within those two blocks, and authorized
the Agency's attorney to select and hire qualified bond counsel
for the purposes of issuing tax increment revenue bonds when
deemed appropriate; and
WHEREAS, the following legally described properties are
included within those parcels which the Executive Director was
authorized to negotiate options for in the aforementioned Miami
Beach Redevelopment Agency Resolution No. 48-87:

; and
WHEREAS, the acquisition of the above legally described
properties will be used for the construction of residential units

in the project area known as the Old Police station site
Redevelopment Project; and
WHEREAS, the Executive Director of the Agency recommends
that the Miami Beach Redevelopment Agency authorize the Agency
attorney to institute eminent domain proceedings on the
aforementioned properties for acquisition in the Project known as
the Old Police station site Redevelopment Project; and
WHEREAS, the Miami Beach Redevelopment Agency finds,
determines and declares that it is necessary to acquire fee
simple title to such properties for use in the Old Police station
site Redevelopment Project; and
WHEREAS, the Miami Beach Redevelopment Agency finds,
determines and declares that the acquisition of the above-
described properties is a public necessity and is necessary,
practical and in the best interest of the city of Miami Beach;
and
WHEREAS, the Miami Beach Redevelopment Agency finds,
determines and declares that the acquisition of the above-
described properties by purchase, donation, or eminent domain
proceedings including declaration of taking is for the public use
and benefit.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MIAMI BEACH
REDEVELOPMENT AGENCY, THAT:
1. The Miami Beach Redevelopment Agency finds, determines
and declares that those matters set out in the foregoing recitals
are true and correct, and they are hereby incorporated as a
portion of this Resolution.
2. The recommendation of the Executive Director of the
Agency that the Agency's Attorney institute condemnation
proceedings in order to acquire the parcels described hereinbelow
for the Old Police Station Site Redevelopment Project, is hereby
accepted and approved.
3. The Miami Beach Redevelopment Agency declares that it
is necessary to acquire fee simple title to:

and
4. The Miami Beach Redevelopment Agency finds, determines
and declares that the above-described properties by purchase,
donation, or eminent domain proceedings, including declaration of
taking, is for the public use and benefit.
5. The Miami Beach Redevelopment Agency finds, determines
and declares that the acquisition of the above-described
properties is a public necessity and is necessary, practical and
in the best interest of the City of Miami Beach.
6. The Miami Beach Redevelopment Agency authorizes the
Executive Director of the Agency and the Agency's Attorney,
through their staffs or through special counsel engaged for such
purposes, to acquire the above-described properties through
purchase, donation or through eminent domain proceedings,
including declaration of taking.
SECTION 2:
Miami Beach Redevelopment Agency Resolution No. 60-88 is
hereby repealed in its entirety.
