RESOLUTION NO. 97-22546
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA EXTENDING COMMISSIONER
MARTIN SHAPIRO'S TERM AS VICE-MAYOR THROUGH AND
INCLUDING EITHER THE COMMISSION MEETING OF NOVEMBER 5,
19~n OR, IF A RUNOFF ELECTION IS REQUIRED, THROUGH AND
INCLUDING NOVEMBER 19, 1997
WHEREAS, pursuant to Section 2.04 of the Miami Beach City Charter, the City
Commission shall elect from its membership a Vice-Mayor who, during the absence or disability of
the Mayor, shall perform the duties of Mayor; and
WHEREAS, pursuant to Section 2.04 of the Miami Beach City Charter, "the City
Commission shall, at its first meeting after each general election, which shall be within three (3) days
after the general election (or within thirty (30) days after the runoff election, if a runoff election is
held) elect from its membership a Vice-Mayor"; and
WHEREAS, the City Commission has established a policy of rotating the position of
Vice-Mayor every four months; and
WHEREAS, for the term commencing July 1, 1997, through and including October 31,
1997, the City Commission has elected Commissioner Martin Shapiro to serve as Vice-Mayor of the
City of Miami Beach; and
WHEREAS, at either the November 5, 1997 Commission meeting or, if a runoff election
is required, at the November 19, 1997 Commission meeting, the new Commission will appoint a
Vice-Mayor, therefore, the term of Vice-Mayor Martin Shapiro should be extended through this
interim period.

NOW, THEREFORE, BE IT DUL Y RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that Commissioner Martin
Shapiro's term as Vice-Mayor ofthe City of Miami Beach is hereby extended through and including
either November 5, 1997 or, if a runoff election is required, through and including November 19,
1997.

EXTENDING T TERM OF THE VICE-MAYOR UNTIL AFTER THE
NOVEMBER GENERAL ELECTION

ADMINISTRATION RECOMMENDA nON:
The Administration recommends that the Mayor and City Commission approve a resolution
extending the term of the vice-mayor until after the November general election.
BACKGROUND:
As established by this Commission, the vice-mayor duties are rotated every four months. The
vice-mayor terms are July through October, November through February, and March through
June.
At the June 18, 1997 Commission meeting, resolution 97-22419 was passed electing
Commissioner Shapiro as the Vice-Mayor for the Term July 1, 1997 through and including
October 31,1997.
Pursuant to Section 2.04 of the Miami Beach City Charter, "The City Commission shall, at its
first meeting after each general election, which shall be within three (3) days after the general
election (or within thirty (30) days after the runoff election, if a runoff election is held) elect from
its membership a Vice-Mayor who during the absence or disability of the Mayor, shall perform
the duties of Mayor."
CONCLUSION:
Since Vice-Mayor Shapiro's term as vice-mayor expires October 31, 1997 and, in accordance
with the City Charter, a new vice-mayor will be appointed by the new City Commission, it is
recommended that Vice-Mayor Shapiro's term be extended until a new vice-mayor is appointed
at either the November 5, 1997 Commission meeting or, if a runoff election is required, at the
November 19, 1997 Commission meeting.
