36-85 RDA RESOLUTION NO. 36-85 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING FROM THE CITY OF MIAMI BEACH THE CONVEYANCE OF THE TWO PARCELS OF LAND ON EITHER SIDE OF REBECCA AND HOPE TOWERS AND THE ORIGINAL MIAMI BEACH MARINA SITE MORE PARTICULARLY REFERRED TO IN THE STIPULATION AND ORDER IN SOUTH SHORE DEVELOPERS ET AL. V. CITY OF MIAMI BEACH, FLORIDA, AND MIAMI BEACH REDEVELOPMENT AGENCY. WHEREAS, a Stipulation and Order (attached hereto as Exhibit "A") has been proposed by the litigants in South Shore Developers, Inc. et al. v. Ci ty of Miami Beach, Flor ida, and Miami Beach Redevelopment Agency, Eleventh Circuit Court Case No. 82-24526 (19) in an attempt to resolve all controversies resulting from the September 18, 1984 Final Judgment; and WHEREAS, Paragraph 1 (n) of said Stipulation and Order defines the subject parcels of said Stipulation as "the two parcels of land on either side of Rebecca and Hope Towers and the or ig inal Miami Beach Mar ina si te generally bordered on the North by MacArthur Causeway, on the East by Alton Road, on the South by Block 8 (the so-called Cheezem parcel) and on the West by Biscayne Bay and more particularly descr ibed in Exhibi ts Band C hereto"; and WHEREAS, said parcels are presently owned by the City of Miami Beach; and WHEREAS, the Ci ty of Miami Beach wishes to convey said parcels to the Miami Beach Redevelopment Agency; and WHEREAS, said conveyance is necessary in order to effectuate a resolution of the remaining controversies resulting from the above-styled litigation, WHEREAS, the Redevelopment Agency of the Ci ty of Miami Beach wishes to accept the conveyance of the aforesaid parcels. NOW, THEREFORE, BE IT DULY RESOLVED BY THE REDEVELOPMENT AGENCY OF THE CITY OF MIAMI BEACH, FLORIDA that the two parcels of land on ei ther side of Rebecca and Hope Towers and the or iginal Miami Beach Marina site generally bordered on the North by MacArthur Causeway, on the East by Al ton Road, on the South by Block 8 (the so-called Cheezem parcel) and on the West by Biscayne Bay, more particularly described in Exhibits "B" and "c" of the Stipulation and Order in South Shore Developers et ale v. City of Miami Beach, Flor ida and Miami Beach Redevelopment Agency, are hereby accepted by the Miami Beach Redevelopment Agency.
