HomeMy WebLinkAboutMemorandum of Agreement MEMORANDUM OF AGREEMENT BETWEEN UNITED STATES COAST GUARD CUTTERS VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and VISITING COAST GUARD CUTTERS AND MIAMI BEACH FIRE DEPARTMENT 1. This memorandum of agreement (MOA) outlines the agreement between the U.S. Coast Guard Cutters (USCGC) VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and VISITING COAST GUARD CUTTERS and the MIAMI BEACH FIRE DEPARTMENT (MBFD) with regards to firefighting and emergency operations aboard the aforementioned cutters. 2. The authority for U.S. Coast Guard Cutters (USCGC) VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and VISITING COAST GUARD CUTTERS to enter into this MOA is found in COMDTINST M5l00.47, the Safety and Environmental Health Manual. Any dispatch ofMBFD equipment and personnel pursuant to this agreement is subject to the following conditions: a. All requests for fire or emergency medical equipment and personnel shall be made by telephone via the 911 operator. b. Any request for aid under this agreement will include a description of the type of nature of the fire or emergency to which the response is requested and specify the location aboard the ship. However, the amount and type of equipment and number of personnel to be furnished will be determined by the MBFD. 4. The MBFD fully recognizes and understands that the USCGC VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and VISITING COAST GUARD GUTTERS are federal property and the Commanding Officers (CO) have ultimate authority for what takes place onboard. The MBFD will not come aboard any vessel against the wishes of the CO or the CO's designated representative, the Officer of the Day (OOD). 5. Upon arriving to the cutter requesting assistance, the first arriving fire officer shall be briefed by the CO, OOD, or Junior Officer of the Day (JOOD). This briefing will include the location and status of emergency, Coast Guard ability to assist, and special circumstances that could hamper firefighting or endanger the lives of the firefighters. 6. If assistance is requested, the MBFD Officer in Charge and vessefs CO or OOD will decide if it is necessary to commit the MBFD manpower and equipment. In the event the MBFD is used, the MBFD will be in charge of all firefighting equipment and personnel. Coast Guard personnel will assist the MBFD when requested via the CO or OOD. In the event of response by other Coast Guard units, the MBFD will remain in charge of all firefighting onboard the unit with guidance provided by the CO or OOD. MBFD will not incur any liabilities for damages to cutters if services are refused or personnel are withdrawn. 7. USCGC VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and VISITING COAST GUARD CUTTER personnel will work in a spirit of cooperation with the members of the MBFD in any evolution that requires joint efforts. However, should a disagreement regarding firefighting operations that occur that cannot be resolved to both parties satisfaction, the MBFD is within it rights to withdraw its personnel and equipment. In addition, if the CO or OOD feels as though the MBFD tactics and assistance are jeopardizing the integrity of the cutter or lives of Coast Guard personnel, the services of the MBFD may be refused. MBFD will not incur any liabilities for damages to the cutter if services are refused or personnel are withdrawn. 8. All equipment used by the MBFD in carrying out this agreement will, at the time of action hereunder, be owned by, under the control of, or be employed in accordance with existing Mutual Aid Agreements, and all personnel acting for the MBFD under this agreement will, at the time of such action, be an employee or a volunteer member of the MBFD or acting in accordance with existing Mutual Aid Agreements. 9. Reimbursement to the MBFD for the cost of firefighting on the cutters is governed by Section 2210, Title 15, United States Code and the implementing regulations set forth at Part 151, Title 44, Code of Federal Regulations. Any such claim for reimbursement for firefighting cost may also include cost associated with emergency medical services to the extent normally rendered by a fire service in connection with a fire. 10. USCGC VALIANT, GENTIAN, MANITOU, MATAGORDA, CHANDELUER, BARANOF, FARALLON, MAUl, HUDSON, and MBFD personnel will conduct joint training and drills as often as deemed necessary by both parties, which in the very least, will consist of familiarization tours for MBFD personnel. 11. There are no reporting requirements for this agreement. 13. This agreement shall become effective upon the date ofthe last party to sign and shall remain in effect until cancelled upon 30 days written notice by either party involved. This agreement shall be reviewed on an annual basis, and may be modified by any writing si@ the original . atories or their successors.
