HomeMy WebLinkAbout2005-25807 Reso RESOLUTION NO. 2005-25807 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE APPROPRIATION OF FUNDS FROM THE SANITATION ENTERPRISE FUND RETAINED EARNINGS TO COMPLETE REMEDIATION WORK FOR THE CITY'S GREEN WASTE FACILITY, LOCATED AT 28TH STREET AND NORTH MERIDIAN AVENUE, FOR FISCAL YEAR 2004/2005, IN THE AMOUNT OF $326,761. WHEREAS, since the early 1930's, the City has operated a transfer station facility in an enclave adjacent to the grounds of the Miami Beach Golf Club at 28th Street and North Meridian Avenue (the Site); and WHEREAS, the City Commission passed Resolution 2003-25386, which limits the use of the Site to City of Miami Beach residents and no longer allows for construction, demolition debris, or white goods (such as appliances or water heaters); and WHEREAS, in order to obtain a Green Waste Facility Permit from the Miami-Dade County Department of Environmental Resources Management, certain areas of the Site required immediate screening of soil and removal of potentially hazardous materials; and WHEREAS, the soil screening and removal of potentially hazardous materials was completed in November 2004; DERM has since determined that additional screening is required to complete the environmental remediation; and WHEREAS, the soil screening and removal of potentially hazardous materials was accomplished as an urgent project to be funded from the Sanitation Enterprise Fund Retained Earnings; and WHEREAS, $326,761 is needed to complete remediation work for the Site. NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, the Mayor and City Commission hereby authorize the appropriation of funds from the Sanitation Enterprise Fund Retained Earnings to complete remediation work at the City's Green Waste Facility, located at 28th Street and North Meridian Avenue, for Fiscal Year 2004/2005, in the amount of $326,761. Enterprise Fund for the Issue: Shall the Mayor and City Commission authorize the appropriation of $326,761 from the Sanitation Enterprise Fund for the completion of remediation work at the Bayshore Green Waste Facility? Item Summa /Recommendation: In1934, the City opened the Bayshore Transfer Station to provide City residents with a place to dispose of clean landscaping waste, bulk waste, and construction and demolition debris. When the permit for the Transfer Station expired, the City took action to permit the Site as a Clean Materials Recovery Facility (MRF). The permit approval was significantly delayed primarily because the Florida Department of Environmental Protection (FDEP) insisted the facility discharge storm water to an on-site dry retention area to allow for pretreatment prior to going to the stormwater well. As of November 1, 2003, the City passed Resolution 2003-25386 that deleted Construction, Demolition Debris and White Goods from the Community Trash Recycling Center agreement. As a result, the City is currently pursuing a "Green Waste Facility" permit for the site at Bayshore based on the delay in permitting of the MRF and the aforementioned resolution adopted by the City. In order to obtain a Green Waste facility permit, the Miami-Dade Department of Environmental Resources Management (DERM) requires the City to fulfill its consent agreement with DERM and immediately screen any potentially unacceptable materials from the berms located on site. The screening was required because the berms were built with soil that contained construction debris and other unacceptable materials. A report, dated December 14, 2004, was submitted to DERM detailing the work completed and results of the soil screening tests. DERM has since inspected the site and is now requiring an additional section of the facility berm be screened in the southwest and northwest corners. Total cost to complete the environmental remediation work at the Green Waste Facility is estimated at $326,761. Meetings with the Budget Officer determined that the funds for this work would require appropriation by the City Commission. ANALYSIS In1934, the City opened the Bayshore Transfer Station to provide City residents with a place to dispose of clean landscaping waste, bulk waste, and construction and demolition debris. When the permit for the Transfer Station expired in 2000, the City took action to permit the Site as a Clean Materials Recovery Facility (MRF). The permit approval was significantly delayed primarily because the Florida Department of Environmental Protection (FDEP) insisted the facility discharge storm water to an on-site dry retention area to allow for pretreatment prior to going to the stormwater well. However, in order to comply with this request there would need to be adequate space for the retention area and no ground water contamination on site that might possibly be impacted by the discharge to the retention pond. Neither of these options is possible due to a lack of space. The City proposed the use of a Vorch-technic device (gross particle separator which works with gravity) in lieu of the on site retention. This was acceptable to Miami-Dade County DERM, but not acceptable to FDEP. In March 2004, with no resolution in sight and also because the City Commission decided that the facility should be operated as a Green Waste Facility, the permit application was withdrawn. FDEP's position regarding the on-site retention is based on a South Florida Water Management District (SFWMD) requirement to use surface discharge as the only acceptable pretreatment system and they were unwilling to vary unless the City receives a special exemption to their rules. Such an exemption would require a legal appeal, which has been granted in other cases where there were no other feasible options. On November 1,2003, the City adopted a resolution that deleted construction, demolition debris and white goods from the Community Trash Recycling Center agreement. To facilitate this, the City is currently pursuing a "green waste facility" permit for the site at Bayshore based on the delay in permitting of the MRF and the aforementioned resolution adopted by the City. To obtain a Green Waste Facility permit, DERM required the City to first fulfill its obligations under a consent agreement which required the immediate screening of the soil used to construct berms and the removal of any potentially unacceptable materials such as reinforced concrete, treated wood products, electrical wire. and scrap metals objects. Staff met with DERM in September 2004 and developed a plan of action to conform to the consent agreement. DERM approved the plan of action and required the work to be completed within thirty days. The work was authorized in October 2004 and Metcalf & Eddy, Inc. completed the screening and removed any unacceptable materials in November 2004. A report, dated December 14, 2004. was submitted to DERM detailing the work completed and results of the soil screening tests. DERM has since inspected the site and has required additional screening of the berms in the southwest and northwest corners of the site. Total facility remediation cost is approximately $326,761. It was initially intended to fund the work from the Sanitation Enterprise Fund Retained Earnings. Meetings with the Budget Officer determined that City Commission action was required to appropriate the funds from the Sanitation Enterprise Fund Retained Earnings to pay for the remediation work. A final design plan for the Green Waste Facility will be submitted to DERM in February 2005. It is estimated that costs for future site preparation, drainage and construction for the Green Waste Facility will total $1,039,500. The Administration recommends approval.
