97-22566 RESO RESOLUTION NO. 97-22566 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 10840, AS AMENDED, THAT CREATED THE CITY OF MIAMI BEACH FINE ARTS BOARD, BY REDUCING THE NUMBER OF MEMBERS FROM TWENTY- TWO (22) TO THIRTEEN (13), OF WHOM SIX (6) SHALL BE APPOINTED AT LARGE BY THE COMMISSION, AND THE REMAINING SEVEN (7) SHALL BE APPOINTED BY THE MAYOR AND INDIVIDUAL COMMISSIONERS. WHEREAS, at the City Commission meeting of October 8, 1997, a discussion was held concerning the Miami Beach Fine Arts Board's inability to conduct business due to the lack of a quorum of members at its regularly scheduled meetings; and WHEREAS, it was recommended by the Fine Arts Board members that the current membership number of twenty-two (22) be reduced to thirteen (13); and WHEREAS, the City Commission deems it advisable that the number of members on the Fine Arts Board be reduced to thirteen (13) members; six (6) of whom shall be appointed at large by the City Commission, and the Mayor and each Commissioner shall appoint one (1) member to the Board. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby amend Section 1 of Resolution No. 10840, as amended, creating the Miami Beach Fine Arts Board, as follows: 1. ADMINISTRATION RECOMMENDATION: Approve the resolution. BACKGROUND: On September 2, 1997, members of the Miami Beach Fine Arts Board sent correspondence to Mayor Seymour Gelber, expressing their concern of an on going problem with their inability to conduct business at their meetings due to the lack a quorum. This situation frequently occurred due to a number of vacancies and failures to attend the meetings. The lack of quorum prohibited the Board from voting on issues that affected the direction of the festival and in particular impacted the 1998 festival scheduled at North Shore Open Space Park on February 7th and 8th, 1998. At the request of Mayor Gelber, a discussion related to this matter was held at the Commission meeting of October 8, 1997. At the conclusion of the discussion, a motion was made and approved to reduce the number of members of the Miami Beach Fine Arts Board from twenty-two (22) to thirteen (13). It was further stated that the thirteen (13) members, six (6) shall be appointed at large by the City Commission; and the remaining seven (7) by the Mayor and individual Commissioners. CONCLUSION: The approval of this resolution will ratify the motion previously approved by the Commission at its meeting of October 8,1997.
