Amendment No. 4 :<(j~l- :2,1-/3 R b AMENDMENT NO.4 TO THE PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND CH2M HILL DATED MAY 16, 2001, IN AN AMOUNT NOT-TO-EXCEED $3,500.00, FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES, NECESSARY TO INCORPORATE CONCRETE VALLEY GUTTERS TO THE CONSTRUCTION DOCUMENTS FOR THE RIGHT OF WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO.3 - NORMANDY SHORES PROJECT. This ~ndment No. 4 to the Agreement made and entered this JI/t. day of 1J1J1-fl , 2005, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and CH2M HILL, 800 Fairway Drive, Suite 350, Deerfield, Florida 33441 (hereinafter referred to as Consultant). RECITALS WHEREAS, on May 16, 2001, the City entered into a Professional Services Agreement with CH2M Hill (the Consultant), to perform landscape architectural, and/or engineering and related professional services relative to the Project, as defined below, including: planning, design, bidding and construction administrative services (the Agreement); and WHEREAS, the Agreement was executed for a not-to-exceed amount of $620,800; and WHEREAS, the scope of the Right-of-Way Infrastructure Improvements Program Neighborhood No. 3 - Normandy Shores Project (the Project) is comprised of improvements to the following area: Normandy Shores, a residential island with approximately 200 single family homes and 43 apartment buildings surrounding the Normandy Shores Golf Course and Fairway Park, which is linked to Miami Beach at 71st Street; and WHEREAS, the Project scope of work includes: enhanced landscaping and street lighting consistent with community preferences; repair, extension or widening of sidewalks to comply with ADA - Title III; replacement of existing water mains throughout the community; street resurfacing/pavement markings and improvement of dead end streets with street lighting, landscaping, fencing, and/or parking, where appropriate; bicycle paths and pedestrian access ways; incorporation of traffic calming features, consistent with the community preferences; improved stormwater drainage collection and disposal infrastructure; and provision ofthe necessary infrastructure to accommodate the burial of overhead facilities, in the event the residents consider the creation of a special assessment district to underground electric, cable and telephone services; and WHEREAS, the Consultant's scope of work includes planning services; design services; and bidding and award services, as defined in the Schedule "A" - Scope of Services; and WHEREAS, Schedule "A" defines Task 6, "Reimbursables", with the following breakdown: reproduction services; travel and subsistence; surveying; geotechnical evaluation; and undergrounding utility verification; and WHEREAS, the paragraph defined as Task 6.5 "Underground Utility Verification," as defined in Schedule "A-2", describes the provisions for Additional Services necessary to perform undergrounding utility verification for the Project; and WHEREAS, Schedule "A-3" describes the provisions for Additional Services necessary to install a drainage test well to provide additional information for the preparation of a Letter of Reasonable Assurance to be submitted to the Florida Department of Environmental Protection (FDEP), as required in in the permit application for the Project; and WHEREAS, Schedule "A-4" describes the provisions for Additional Services necessary to incorporate 18-inch wide concrete valley gutters into the construction documents for the proposed improvements for the Project. NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment NO.4. 2. MODIFICATIONS The Agreement is amended to incorporate the additional scope of work as defined in Schedule "A-4", attached hereto. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No.4. Scope of Services: Consultant has been requested to replace the proposed 8-inch flush edge treatments in the design of the Project with 18-inch concrete valley gutters. The Basis of Design Report (BOOR) reflected the flush edge treatment as a fully "funded improvement" and the concrete valley gutters as a "bid alternate". Although the City's standards require a 1 O-foot wide clear asphalt travel lane, exclusive of curbing/gutter, due to existing physical conditions of the Project, the City would accept a typical 9.5-foot wide clear asphalt travel lane, exclusive of curbing/gutter. The typical travel lane would consist of: 9 feet - 6 inches of pavement plus 18-inch valley gutter for an overall lane width of 11 feet. The valley gutter option would effectively widen each travel lane by one foot beyond the current proposed design of flush edge treatment. Please, refer to attached letter submitted by Hazen and Sawyer, the City's Program Manager, dated October 26, 2004 and attachments. As such, the request is not approved. In support of this position, the City offers the following: · The City disagrees with the statement that Consultant Is only responsible for designing "funded improvements- particularly as it relates to the valley gutter bid alternate. This alternative bid item approach was discussed at length during the Planning Phase meetings and was Included by the Consultant in the Commission approved Basis of Design Review (BOOR) to establish consensus with neighborhood residents. Hence, the Consultant Is tasked with both the design of an 8-lnch flush conaete edge as the base bid, and an 18-lnch valley gutter design as an alternative bid item. · Per the memorandum entitled "VaUey Gutter Price Analysis" dated May 18, 2004, Consultant further indicated that an MAddltlonal design fee would not be required to make the plan change from a base bid with pavement with flush concrete edges to valley gutters so long as it was done prior to the 90% design submittal." ~ The City subsequently committed $180,000 in additional construction funding. as Identified by the Consultant In the referenced memorandum, and directed the Consultant to proceed with the valley gutter design as a base bid item. · The City recognizes that the Consultant indicated that the implementation of pavement edge treatments would reduce existing pavement widths. In fact, Page 12 of the BOOR notes that "The Inclusion of either edge treatment will effectively reduce the wIdth of the travel lanes (16 inches for flush edge treatment l8lnches per lane] or 36 Inches for valley gutters [18 inches per lane))..." However, Page 5 of the BOOR states that most r1ght-of-ways within the neighborhood have an approximate 25..(oot width. This would not result in a pennittable design. as minimum 10-foot clear asphalt travel lanes are required. To this end, to facilitate the Consultanfs effort. the City has agreed to consider a 9.5-foot travel lane to mitigate impacts on adjacent improvements and encroachments. · Hence, a permittable design requires that the Consultant design a valley gutter edge treatment cross~sectlon that retains a minimum of 19 feet of clear asphalt pavement fOf two 9.54oot travel lanes. · Through this letter, the City requests that you proceed with design of a pennlttabJe project based on valley gutters and 9.5 ft wide clear aSphalt travel lanes.. · As it is anticipated that this design will cause additional impacts to neighborhood landscaping, please provide an updated encroachment list that reflects this minimum 22-100t roadway (19 feet of asphalt and 3 feet of valley gutters.)
