RESOLUTION NO. 328-99
A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY, APPROVING THE
GRANT OF AN EASEMENT TO THE MIAMI CITY BALLET (MCB)
FOR THE PROVISION OF A TEN FOOT EXTERIOR EXIT
PATHWAY AT THE MIAMI CITY BALLET BUILDING SITE, AS
REQUESTED BY THE CITY OF MIAMI BEACH FIRE
DEPARTMENT.
WHEREAS, the City and the Miami City Ballet (MCB) are parties to a Ground Lease
Agreement, dated April 13, 1994, as amended, for the development and construction of a permanent
facility for MCB, within the City's Cultural Campus, adjacent to Collins Park; and
WHEREAS, the City, as Lessor, retains ownership of the land; and
WHEREAS, the Miami Beach Redevelopment Agency also, at this time, retains an
ownership interest in the land; and
WHEREAS, construction of the new MCB facility is nearing completion and a ten foot
dedicated exit pathway, as requested by the City's Fire Department, is required on the north side of
the building; and
WHEREAS, in order for MCB to obtain their temporary and final Certificates of
Occupancy, the Agency must grant, the attached Easement for a ten foot dedicated exit pathway as
requested by the City's Fire Department.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND
MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, that the Chairman and
Members herein approve the grant of the attached Easement to the Miami City Ballet for the
provision of a ten foot exterior exit pathway at the Miami City Ballet building site, as requested by
the City of Miami Beach Fire Department.

CITY COMMISSION GRANT AN EASEMENT TO THE MIAMI CITY
BALLET (MCB) FOR THE PROVISION OF A TEN FOOT EXTERIOR EXIT
PATHWAY AT THE MIAMI CITY BALLET BUILDING SITE, AS

AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
AND RECORD THE EASEMENT FOR THE REQUIRED EXTERIOR EXIT

BACKGROUND:
On April 13, 1994 a Ground Lease was approved between the City of Miami Beach and the Miami
City Ballet (MCB) for the City to grant MCB a site for their proposed permanent facility.
Subsequent Amendments to the Ground Lease were approved on June 18, 1997, October 21, 1997
and January 6, 1999. The Amendments addressed changing the lqcation of the designated site,
waiver of permit fees and parking requirements. '
The location ofthe site was changed, in the First Amendment to the Ground Lease Agreement, to
the current location at a City owned property which will have a new address of 2200 Liberty
Avenue. The new MCB building is being constructed at this site.

ANALYSIS:
Construction of the Miami City Ballet building is now almost complete. The building design calls
for a fire exit located on the north side of the property. The City's Fire Department has asked for
a dedicated ten foot easement along the building's north wall to allow for an exterior exit pathway
in either direction from the fire exit door.
CONCLUSION:
The granting of the easement by the Mayor and City Commission for the dedicated ten foot exit
pathway, and the execution and recording by the Mayor and the City Clerk, is necessary for the
Miami City Ballet to obtain their temporary and final Certificates of Occupancy.
