99-23367 RESO RESOLUTION NO. 99-23367 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING TO CONSIDER A REQUEST FOR REVOCABLE PERMIT BY THE LA GORCE ISLAND ASSOCIATION, INC., FOR THE CONSTRUCTION OF A DOCK FACILITY WITHIN THE LA GORCE BRIDGE CITY RIGHT-OF-WAY, TO BE USED BY THE ISLAND'S NOCTURNAL SECURITY BOAT PATROL. WHEREAS, the La Gorce Island Association, Inc. ,(the Association) represent the La Gorce Island property owners; and WHEREAS, the Association, which presently owns the property at 6695 Pine Tree Lane, is contemplating selling this property; and WHEREAS, the Association maintains a docking facility at this property which is being used by the Island's security patrol boat; and WHEREAS, the Association is requesting to relocate the dock into the City's La Gorce Island bridge right-of-way; and WHEREAS, the Association, has submitted an application for a Revocable Permit for the use of said right-of-way; and WHEREAS, pursuant to the City of Miami Beach Code, Chapter 82, Article III, Division 2, Section 82-93, the Mayor and City Commission are required to hold a public hearing to consider the afore stated request. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider a request by the La Gorce Island Association, Inc., to erect a docking facility within the City's La Gorce Island bridge right-of-way, is hereby called to be held before the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on November 17, 1999 beginning at~ p.m. and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties will be heard. FOR THE CONSTRUCTION OF A DOCK FACILITY WITHIN THE LA GORCE BRIDGE CITY RIGHT-OF-WAY, TO BE USED BY THE ISLAND'S NOCTURNAL SECURITY BOAT PATROL. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. BACKGROUND: Pursuant to City Code, Chapter 82, Article III, Division 2, upon receipt of a complete application, the City Commission shall schedule a public hearing to consider a request for a Revocable Pemlit. The La Gorce Island Association, Inc. representing the La Gorce Island property owners, has completed the application requirements for a Revocable Permit requesting the construction of a dock facility within the La Gorce Island bridge right-of-way, to be used by the island's nocturnal security boat patrol. ANALYSIS: Pursuant to City Code, Chapter 82, Article III, Division 2, Section 82-92, "Revocable Permits", the applicant has complied with the application requirements, submitted the application fee and provided a list of property owners within a radius of375 f~et to be notified of the scheduled public hearing. AGENDAITEM~ DATE 10-71-:>-:14 The La Gorce Island Association, Inc. presently owns the property located at 6695 Pine Tree Lane, where they maintain a dock for the Island's security patrol boat. Since the Association is contemplating the sale of this property, they are requesting to relocate their security boat docking facility, to the adjacent City right-of-way, where they will be installing a floating dock approximately 18 feet long by 8 feet wide. The City Commission is required to schedule a public hearing allowing fifteen days notice to the property owners within 375 feet of the site, in order to consider this application for a Revocable Permit.
